CIRCULAR
Supplementing and abolishing administrative procedures in Circular 28/2010/TT-MCT detailing certain provisions of the Chemicals Law
and Decree 08/2008/ND-CP detailing and guiding the implementation of certain provisions of the Chemicals Law

Pursuant to Decree No. 189/2007/ND-CP dated December 27, 2007, issued by the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Chemicals Law on November 21, 2007;
Pursuant to Decree No. 26/2011/ND-CP dated April 8, 2011 of the Government amending and supplementing certain articles of Decree No. 108/2008/ND-CP dated October 7, 2008 of the Government detailing and guiding the implementation of certain provisions of the Chemicals Law;
Implementing Resolution No. 59/NQ-CP dated December 17, 2010 of the Government on simplifying administrative procedures within the scope of management functions of the Ministry of Industry and Trade;
THE MINISTER OF INDUSTRY AND TRADE:
Article 1. Supplementing and abolishing administrative procedures in Circular No. 28/2010/TT-MCT
1. Supplementing the requirement to submit certified true copies of documents related to the application dossier, certificates, licenses, and health qualification certificates for personnel in the application dossier for a Permit to produce and trade chemicals listed in the Restricted Production and Trading Chemicals List under Articles 17, 18, and 19 by one of the following methods:
a) Certified true copies: for applications submitted via postal service;
b) Photocopies with original documents for verification: for applications submitted in person.
2. Abolishing the following documents from the application dossier for a Certificate of Qualification to produce and trade chemicals listed in the Conditionally Permitted Production and Trading Chemicals List under points b and c, Clause 3, Article 9; points b and c, Clause 3, Article 10; Clauses 5 and 6, Article 11:
a) Certified true copies of bachelor's degrees in chemical fields or bachelor's degrees in technical economic majors of the General Director or Deputy General Director for Technology;
b) Certificates of participation in chemical business training courses for technical staff, employees, and workers of chemical production and trading establishments; Health qualification certificates issued by health authorities at district or higher levels.
3. During the operation of producing and trading chemicals, organizations and individuals must ensure professional conditions in chemical matters and training and safety conditions in accordance with the Chemicals Law; Decree No. 26/2011/ND-CP dated April 8, 2011 of the Government amending and supplementing certain articles of Decree No. 108/2008/ND-CP dated October 7, 2008 of the Government detailing and guiding the implementation of certain provisions of the Chemicals Law.
Article 2. Effective Date
1. This Circular takes effect from June 6, 2011.
2. In the course of implementing this Circular, if any difficulties arise, relevant organizations and individuals shall promptly report to the Ministry of Industry and Trade for appropriate amendments and supplements./.
