Amending and supplementing certain provisions of Circular No. 18/2010/TT-BKHCN
dated December 24, 2010 issued by the Minister of Science and Technology on the management of scientific and technological tasks related to gene banks
Regarding the management of scientific and technological tasks related to gene banks

Pursuant to Decree No. 20/2013/NĐ-CP dated February 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;
Pursuant to Decree No. 65/2010/NĐ-CP dated June 11, 2010 of the Government detailing and guiding the implementation of certain articles of the Law on Biodiversity;
Pursuant to Decree No. 08/2014/NĐ-CP dated January 27, 2014 of the Government detailing and guiding the implementation of certain provisions of the Law on Science and Technology;
At the proposal of the Department Head of the Department of Science and Technology for Economic and Technical Industries, the Department Head of the Legal Affairs Department,
The Minister of Science and Technology issues this Circular amending and supplementing certain provisions of Circular No. 18/2010/TT-BKHCN dated December 24, 2010 issued by the Minister of Science and Technology on the management of scientific and technological tasks related to gene banks.
Article 1. Amending and supplementing certain provisions of Circular No. 18/2010/TT-BKHCN dated December 24, 2010 issued by the Minister of Science and Technology on the management of scientific and technological tasks related to gene banks as follows:
1. Replace the phrase "state level" with the phrase "national level" throughout this Circular and its appendices.
2. Amend and supplement Clauses from Clause 4 to Clause 8 of Article 3:
"4. Gene conservation task is a scientific and technological project implementing research activities, collection, conservation, evaluation of biological indicators, and documentation of genetic resources.
5. Gene exploitation and development task is a scientific and technological project implementing research and application activities to exploit and develop conserved genetic resources for economic, health, security, defense, scientific, and environmental purposes.
6. Genetic resource assessment task is a scientific and technological project implementing research and application activities using genetic breeding techniques, molecular genetics, biostatistics, bioinformatics, etc., to assess genetics for the purpose of screening genetic resources and mapping genomes of certain genetic resources of particular importance in agriculture, industry, health, security, and defense.
7. National-level gene bank task is a scientific and technological task related to gene banks that meets the criteria specified in Clause 1 of Article 25 of Decree No. 08/2014/NĐ-CP dated January 27, 2014 of the Government detailing and guiding the implementation of certain articles of the Law on Science and Technology.
The national-level gene bank task is approved and contracted for implementation by the Minister of Science and Technology.
8. Ministry-level gene bank task, provincial-level gene bank task is a scientific and technological task related to gene banks that meets the criteria specified in Clause 1 of Article 26 and Clause 1 of Article 27 of Decree No. 08/2014/NĐ-CP dated January 27, 2014 of the Government detailing and guiding the implementation of certain articles of the Law on Science and Technology.
The ministry-level and provincial-level gene bank tasks are approved and contracted for implementation by the Minister, the head of the equivalent ministry, and the Chairman of the People's Committee of the province.
3. Amend and supplement Clause 2 of Article 10:
"2. Management authority is defined as follows:
a) The Ministry of Science and Technology directly manages and implements national-level gene bank tasks and oversees the management of ministry-level and provincial-level gene bank tasks.
The Department of Science and Technology for Economic and Technical Industries is the lead unit assisting the Minister of Science and Technology in managing gene bank tasks nationwide; it collaborates with the funding units to sign contracts for the implementation of national-level gene bank tasks.
b) Ministries, sectors, and provincial people's committees directly manage and implement ministry-level and provincial-level gene bank tasks.
The science and technology management units of ministries, sectors, and provincial departments of science and technology are the lead agencies assisting the Minister, the head of the equivalent ministry, and the Chairman of the People's Committee of the province in managing and signing contracts for gene bank tasks within their respective jurisdictions."
4. Amend and supplement Point a Clause 2 of Article 13:
"2. For gene exploitation and development tasks:
a) Annually, organizations and individuals within the gene bank network propose gene exploitation and development tasks to the ministries, sectors, and provincial people's committees according to the model prescribed in Appendix 3 of Circular No. 18/2010/TT-BKHCN dated December 24, 2010 issued by the Minister of Science and Technology on the management of scientific and technological tasks related to gene banks.
Ministries, sectors, and provincial people's committees compile lists of proposed orders for national-level gene exploitation and development tasks to be submitted to the Ministry of Science and Technology and compile lists of orders for ministry-level and provincial-level gene exploitation and development tasks."
Article 2. Implementation
1. This Circular takes effect from August 1, 2014.
2. In the course of implementation, if there are any difficulties, organizations and individuals are requested to promptly report them to the Ministry of Science and Technology for consideration and resolution./.
