CIRCULAR
Regulations on providing information, updating, exploiting, and managing the national database on crop production concerning crop production
Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Law on Crop Production dated November 19, 2018;
At the proposal of the Director of the Plant Cultivation Department;
The Minister of Agriculture and Rural Development issues this Circular to regulate the provision of information, updating, exploitation, and management of the national database on crop production.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular regulates the provision of information, updating, exploitation, and management of the national database on crop production including: Database on crop varieties; fertilizers; crop production; land for crop production; processing and market of crop products; legal regulations on crop production; directives related to crop production; research results and technological development; standards and technical regulations on crop production.
Article 2. Applicability
This Circular applies to organizations and individuals involved in activities related to the provisions set forth in Article 1 of this Circular.
Chapter II
CONTENTS OF THE NATIONAL DATABASE ON CROP PRODUCTION
Article 3. Database on legal regulations and directives related to crop production
The database on legal regulations and directives related to crop production includes:
1. Data on legal regulations and directives regarding crop varieties.
2. Data on legal regulations and directives regarding fertilizers.
3. Data on legal regulations and directives regarding crop production.
4. Data on legal regulations and directives regarding storage, preliminary processing, and processing.
Article 4. Database on crop varieties
1. Data on organizations and individuals meeting the conditions for producing crop varieties: Name, main office address; production objects, production volume, seed production level; announced standards applied, conformity declaration.
2. Data on organizations conducting trials and tests; organizations certifying registered or designated crop varieties: Name, organization address, code number (if applicable), issuing authority, decision number, and designated or registered field of activity.
3. Data on mother plants, mother plant gardens: Name of organization or individual; address; detailed information about mother plants, mother plant gardens in the Mother Plant Certificate.
4. Data on import and export of crop varieties: Name, address of importing and exporting organizations or individuals; name of crop variety, quantity of imported and exported crop varieties.
5. Data on standards and technical regulations on crop varieties.
6. List of major crop species.
7. List of crop varieties permitted to circulate in Vietnam.
8. List of prohibited sources of crop variety seeds for export.
9. Data on research results and technological development on crop varieties.
10. List of protected crop varieties.
Article 5. Database on fertilizers
1. Data on organizations and individuals meeting the conditions for producing fertilizers: Name, main office address; production address; list of produced fertilizers, production volume; production form; announced standards applied, conformity declaration; issuing authority of the Certificate of Eligibility, Certificate of Eligibility number.
2. Data on organizations and individuals meeting the conditions for trading fertilizers: Name, main office address of the trading entity; issuing authority of the Certificate of Eligibility, Certificate of Eligibility number.
3. Data on organizations conducting trials and tests on fertilizers; organizations certifying registered or designated fertilizers: Name, organization address, code number (if applicable), issuing authority, decision number, and designated or registered field of activity.
4. Data on import and export of fertilizers: Name, address of importing and exporting organizations or individuals; type of fertilizer, quantity of imported and exported fertilizers.
5. Data on standards and technical regulations on fertilizers.
6. List of fertilizers recognized for circulation in Vietnam.
7. Data on research results and technological development on fertilizers.
Article 6. Database on crop production
1. Production data: Planted area, new planting area, area yielding products, yield of perennial crops; planted area, yield of annual crops.
2. Data on production linkage and cooperation: Forms of linkage, planted area, yield of each type of crop.
3. Data on genetically modified crop production: Name, main office address of the production entity; production address; crop object, area, yield; standards for public announcement and conformity declaration.
4. Data on high-tech application crop production: Region name, province or centrally governed city name; crop object, area, yield, applied technology.
5. Data on organizations conducting trials and certifying registered or designated crop products: Name, organization address, code number, issuing authority for designation, registration field activity unit, decision number for designation, registration field activity number.
6. Data on food safety compliant entities, VietGAP, certified organic production: Name, main office address; production address; production object, area, yield, production form; decision number for certification issuance or certificate number.
7. Data on cultivation zone codes: Zone name, cultivation zone address, production object, area, yield; cultivation zone code certification.
8. Data on losses due to natural disasters and diseases: Affected object, area, yield.
9. Data on cultivation technical standards and regulations.
10. Data on scientific research and technological development results in cultivation.
Article 7. Database on arable land
1. Data on fertility of arable land.
2. Data on area conversion of rice crop structure to annual crops, perennial crops, rice combined with aquaculture.
3. Data on technical standards and regulations for arable land.
Article 8. Database on processing and market for crop products
1. Data on primary processing and processing facilities for crop products: Facility name, address, enterprise code (CODE), quality management system applied, capacity, product types, processed varieties, purchase volume, imported raw material volume, processed volume, product cost, export value (USD/year) and consumption market (domestic, export).
2. Data on export and import markets for crop products: Export and import markets, quantity, product types, specifications, purchase price, sale price, export and import value.
3. Data on technical standards and regulations for storage, primary processing, and processing.
Chapter III
MANAGEMENT OF ACCOUNTS, UPDATING AND UTILIZING DATABASE
NATIONAL FOR CROP PRODUCTION
Article 9. Principles for managing accounts to update the national database on crop production
1. Hierarchical levels and permissions for updating the national database on crop production.
2. Issuance and locking of update accounts for individuals (civil servants, employees), administrative agencies, and certification organizations.
3. Organizations granted accounts assign individuals within their organization to manage, update, utilize, and oversee the national database on crop production.
4. Individuals granted accounts must ensure confidentiality, manage, update, utilize, and oversee the national database on crop production and use the granted account for its intended purpose.
5. An update account will be locked if it falls under any of the following circumstances:
a. The organization granted the account is dissolved, ceases operations, or transfers ownership;
b. The individual granted the account changes jobs, retires, or leaves employment.
Article 10. Frequency of updating the national database on crop cultivation
1. Update monthly, before the 30th of each month, the contents stipulated in Article 3; Clauses 1, 2, 3, 5, 6, 7, 8, and 10 of Article 4; Clauses 1, 2, 3, 5, and 6 of Article 5; Clause 5 and 9 of Article 6; Clause 3 of Article 7; Clause 3 of Article 8 of this Circular.
2. Update semi-annually, before June 30 and December 31 of each year, the contents stipulated in Clause 4 of Article 5; Clauses 6, 7, and 8 of Article 6; Clause 2 of Article 8 of this Circular.
3. Update annually, before December 20 of each year, the contents stipulated in Clauses 4 and 9 of Article 4; Clause 7 of Article 5; Clauses 1, 2, 3, 4, and 10 of Article 6; Clause 1 and 2 of Article 7; Clause 1 of Article 8 of this Circular.
Article 11. Exploitation of the national database on crop cultivation
1. Organizations implementing the central and provincial functions of building and updating the national database on crop cultivation are entitled to exploit the national database on crop cultivation according to their respective levels.
2. Organizations and individuals are permitted to exploit and utilize the national database on crop cultivation as prescribed in Articles 3, 4, 5, 6, 7, and 8 of this Circular.
Chapter IV
MANAGEMENT OF THE NATIONAL DATABASE ON CROP CULTIVATION
Article 12. Contents of managing the national database on crop cultivation
1. Building and operating technical infrastructure and software for the national database to ensure accuracy and stability throughout the system.
2. Updating, processing, and integrating information into the national database on crop cultivation.
3. Managing the rights to update information in the database.
4. Monitoring the usage situation of the database.
5. Supporting operation and exploitation of the database.
Article 13. Ensuring security and safety for the national database on crop cultivation
1. Using appropriate software with valid licenses and applying technology to prevent and detect unauthorized intrusions.
2. Utilizing encrypted channels and user authentication for the following activities: System management login; application login; automatic data transmission between servers; data entry and editing.
3. Encrypting the transmission of the national database on crop cultivation.
4. Applying measures to ensure the authenticity and integrity protection of data in the national database on crop cultivation.
5. Implementing logging of access, creation, modification, and deletion of data for system management and monitoring purposes.
6. Establishing regular backup and disaster recovery plans to ensure continuous and stable system operation during incidents.
7. Implementing other necessary measures to ensure the safety of the national database on crop cultivation.
Chapter V
RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS
Article 14. Responsibilities of the Crop Cultivation Department
1. Leading and guiding related organizations and individuals to report data for compilation, updating, exploitation, and management of the national database on crop cultivation nationwide.
2. Leading the organization of operations, maintenance, supervision, and upgrading of technical infrastructure, software, and security and safety measures for the national database on crop cultivation.
3. Organizing the issuance and suspension of update accounts for individuals (civil servants, public officials, staff members), administrative agencies, and certification organizations.
4. Managing administrative accounts, assigning update and exploitation permissions for the national database on crop cultivation.
5. Directing, guiding, and periodically or randomly inspecting the provision of information, updates, exploitation, and management of the national database on crop cultivation. Organizing training and guidance on the work of updating, exploiting, and managing the national database on crop cultivation.
6. Evaluating and ranking the capacity of organizations in performing updates, exploitation, and management of the national database on crop cultivation, and publicly announcing these evaluations annually.
7. Cooperating with relevant units to handle issues arising during the implementation of updates, exploitation, and management of the national database on crop cultivation.
8. Investing in and constructing infrastructure to serve the updating, exploitation, and management of the national database on crop cultivation.
9. Assigning personnel to perform management, updating, exploitation, and management of the national database on crop cultivation.
10. Implementing the data updates stipulated in Clause 1 and 3 of Article 3; Clauses 2, 4, 5, 6, 7, 8, 9, and 10 of Article 4; Clause 5 of Article 6 for organizations registered or designated by itself; Clauses 9 and 10 of Article 6; Clause 1 and Clause 3 of Article 7 of this Circular.
Article 15. Responsibilities of the Plant Protection Department
1. Direct and guide organizations and individuals related to report data for compilation, updating, exploitation, and management of the fertilizer database.
2. Inspect and supervise the implementation of regulations stipulated in this Circular regarding updating, exploitation, and management of the fertilizer database.
3. Bear responsibility for the timeliness, completeness, security, safety, and accuracy of information updated into the fertilizer database.
4. Implement data updates as prescribed in Clause 2, Article 3 and Article 5 of this Circular.
Article 16. Responsibilities of the Processing and Market Development Department for Agricultural Products
1. Direct and guide organizations and individuals related to report data for compilation, updating, exploitation, and management of the database on product preservation and processing; export and import markets for crop products.
2. Inspect and supervise the implementation of regulations stipulated in this Circular regarding updating, exploitation, and management of the database on product preservation and processing; export and import markets for crop products.
3. Bear responsibility for the timeliness, completeness, security, safety, and accuracy of information updated into the database on product preservation and processing; export and import markets for crop products.
4. Implement data updates as prescribed in Clause 4, Article 3 and Article 8 of this Circular.
Article 17. Responsibilities of the Quality Management Department for Forestry, Agriculture, and Aquatic Products
1. Implement data updates as prescribed in Clause 5, Article 6 of this Circular for organizations registered for operation or designated by itself.
2. Bear responsibility for the timeliness, completeness, and accuracy of information updated into the database on testing organizations and product certification organizations according to assigned functions and tasks.
Article 18. Responsibilities of the Information Technology and Statistics Center
Provide information on crop production and export and import markets for seedlings and crop products to specialized departments when requested.
Article 19. Responsibilities of Certification Organizations
1. Implement data updates on VietGAP production bases and organic production bases as prescribed in Clause 6, Article 6 of this Circular.
2. Bear responsibility for the timeliness, completeness, and accuracy of information updated into the database on VietGAP production bases and organic production bases as prescribed in Clause 6, Article 6 of this Circular.
Article 20. Responsibilities of Provincial Departments of Agriculture and Rural Development under Central Cities
1. Direct and guide organizations and individuals related to report data for compilation, updating, exploitation, and management of the national crop database within their province.
2. Coordinate with the Crop Production Department to update, exploit, and manage the national crop database according to分级翻译任务,以下是第1部分的翻译结果:

Chapter VI
IMPLEMENTATION
Article 21. Implementation clause
1. This Circular takes effect from January 1, 2020.
2. During the implementation process, if there are difficulties or obstacles, they should be promptly reported to the Crop Production Department for consolidation and reporting to the Ministry of Agriculture and Rural Development for consideration and amendment.
