Pursuant to Decree No. 16/2015/NĐ-CP dated February 14, 2015 of the Government on the mechanism of autonomy for public service units;
Pursuant to Decree No. 44/2014/NĐ-CP dated May 15, 2014 of the Government on land prices;
Pursuant to Decree No. 36/2017/NĐ-CP dated April 4, 2017 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
Based on the proposal of the Director of the Science and Technology Department and the Director of the Legal Department;
The Minister of Natural Resources and Environment issues this Circular regulating criteria and indicators for evaluating the quality of public service provision funded by state budget for land price surveying, information collection, framework establishment, and adjustment.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular regulates criteria and indicators for evaluating the quality of public service provision funded by state budget for land price surveying, information collection, framework establishment, and adjustment.
Article 2. Applicability
This Circular applies to:
1. State management agencies in natural resources and environment sector to evaluate the quality of public service provision for land price surveying, information collection, framework establishment, and adjustment.
2. Public service units with appropriate functions and tasks, capable of providing services for land price surveying, information collection, framework establishment, and adjustment.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
1. The quality of public service provision for land price surveying, information collection, framework establishment, and adjustment is the aggregate result of various indicators reflecting the level of satisfaction of users with the service.
2. Criteria for evaluating the quality of public service provision for land price surveying, information collection, framework establishment, and adjustment are the contents and requirements that the service provider must meet to satisfy customer expectations regarding service quality.
3. Indicators for evaluating the quality of public service provision for land price surveying, information collection, framework establishment, and adjustment are the levels of requirement and conditions concerning a specific aspect of the evaluation criteria.
4. Products of the process of providing public services for land price surveying, information collection, framework establishment, and adjustment include: collected documentation, survey forms system, reports on market land price situation and results at all levels.
Chapter II
CRITERIA AND INDICATORS FOR EVALUATING THE QUALITY OF PUBLIC SERVICE PROVISION FOR LAND PRICE SURVEYING, INFORMATION COLLECTION, FRAMEWORK ESTABLISHMENT, AND ADJUSTMENT
1. Criterion 1: Functions, tasks, material and technical foundations of organizations providing services to prepare national environmental status reports.
1. Criterion 1: Functions, tasks, or business registration of organizations providing services for land price surveying, information collection, framework establishment, and adjustment.
2. Criterion 2: Material and technical infrastructure serving land price surveying, information collection, framework establishment, and adjustment activities.
3. Criterion 3: Human resources implementing land price surveying, information collection, framework establishment, and adjustment activities.
4. Criterion 4: Compliance with technical procedures and economic-technical norms for land price surveying, information collection, framework establishment, and adjustment.
5. Criterion 5: Survey information and data.
6. Criterion 6: Service attitude during land price surveying, information collection, framework establishment, and adjustment activities.
7. Criterion 7: Products of land price surveying, information collection, framework establishment, and adjustment services.
1. Evaluation Indicators:
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) Established in accordance with the law, having functions, tasks, and organizational structure for land price surveying, information collection, framework establishment, and adjustment;
b) Experience in providing services for land price surveying, information collection, framework establishment, and adjustment.
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
a) Documents stipulating functions, tasks, and organizational structure; licenses and business registrations of service providers;
b) Experience in providing services for land price surveying, information collection, framework establishment, and adjustment confirmed by the service provider's capacity dossier.
Article 6. Indicators and Basis for Evaluating Criterion 2
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) System of machinery, equipment, and tools serving land price surveying, information collection, framework establishment, and adjustment;
b) Buildings, construction works, auxiliary equipment, and means serving land price surveying, information collection, framework establishment, and adjustment activities.
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
a) Annual asset statistics report of the service provider; contracts for renting machinery, equipment, office buildings, and auxiliary means serving land price surveying, information collection, framework establishment, and adjustment activities;
b) Economic-technical norms for equipment for each content of land price surveying, information collection, framework establishment, and adjustment work;
c) Decision approving (and adjusting if necessary) the project for land price surveying, framework establishment, and adjustment as the basis for establishing land price lists at localities and the explanatory notes of the project approved by competent authorities.
Article 7. Indicators and Basis for Evaluating Criterion 3
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) Number of direct human resources conducting land price surveying, information collection, framework establishment, and adjustment;
b) Quality of direct human resources conducting land price surveying, information collection, framework establishment, and adjustment.
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
a) Statistical data, personnel files, and labor contracts (if any) of the service provider;
b) Economic-technical norms for labor in land price surveying, information collection, framework establishment, and adjustment.
c) Decision approving (and adjusting if necessary) the project for land price surveying, framework establishment, and adjustment as the basis for establishing land price lists at localities and the explanatory notes of the project approved by competent authorities.
Article 8. Indicators and Basis for Evaluating Criterion 4
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) Compliance with technical procedures for land price surveying, information collection, framework establishment, and adjustment;
b) Compliance with economic-technical norms for land price surveying, information collection, framework establishment, and adjustment.
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
a) Circular No. 69/2017/TT-BTNMT dated December 29, 2017 of the Ministry of Natural Resources and Environment on the Procedures for Establishing and Adjusting Land Price Frameworks (hereinafter referred to as Circular No. 69/2017/TT-BTNMT);
b) Circular No. 70/2017/TT-BTNMT dated December 29, 2017 of the Ministry of Natural Resources and Environment on Economic-Technical Norms for Establishing and Adjusting Land Price Frameworks (hereinafter referred to as Circular No. 70/2017/TT-BTNMT);
c) Decision approving (and adjusting if necessary) the project for land price surveying, framework establishment, and adjustment as the basis for establishing land price lists at localities and the explanatory notes of the project approved by competent authorities.
Article 9. Indicators and Basis for Evaluating Criterion 5
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) List of types of information as prescribed in Article 7 of Circular No. 69/2017/TT-BTNMT;
b) Compile, analyze, and process information, data, and materials collected and investigated related to establishing and adjusting land price frameworks;
c) The source of input information and data;
d) Ensure data security and confidentiality according to regulations during the investigation and collection of information for establishing and adjusting land price frameworks;
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
a) A list of information as stipulated in Article 7 of Circular No. 69/2017/TT-BTNMT, with quantities specified in point b and c, Clause 2, Article 3 of Circular No. 69/2017/TT-BTNMT;
b) Information and data collected during the investigation (clearly indicating the source), reports on the handling of investigation information from service providers;
c) The preservation and backup of investigation information, data, and figures by service providers;
d) Regulations on data confidentiality during the investigation and collection of information for establishing and adjusting land price frameworks;
Article 10. Indicators and Basis for Evaluating Criterion 6
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) Timely report on developments during the provision of services; be ready to meet urgent requirements of the ordering agency;
b) Self-inspection and supervision of the investigation and collection of information for establishing and adjusting land price frameworks by service providers;
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
a) Periodic and urgent reports from the service provider organization;
b) Inspection records periodically or urgently conducted by the ordering agency, annual acceptance documents from the supervisory level, and other related documents concerning urgent requirements of the ordering agency (if any);
c) Self-inspection and supervision plan for investigative activities by the service provider organization; inspection records or documentation, evidence of self-inspection and supervision by the service provider organization.
Article 11. Indicators and Basis for Evaluating Criterion 7
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) Product quality;
b) Quantity of products and progress of implementation;
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
a) Decision approving (and amending if necessary) the Investigation Project for Establishing Land Price Frameworks as the basis for developing land price lists at localities and the detailed explanation of the approved Project by the competent authority;
b) Inspection and acceptance evaluation records of the ordering agency or the competent state management agency;
c) Statistical reports and submission of products from service providers conducting investigations and collecting information for establishing and adjusting land price frameworks, confirmed by the competent authority;
Article 12. Evaluation of Quality of Public Service Activities Related to Investigation and Collection of Information for Establishing and Adjusting Land Price Frameworks;
1. The quality evaluation of public service activities related to investigation and collection of information for establishing and adjusting land price frameworks shall be conducted through scoring. The scoring scale is 100 points. Specific scores are determined for each evaluation index under the criteria set forth in Articles 5, 6, 7, 8, 9, 10, and 11, and detailed in the Appendix attached to this Circular;
2. Service quality is evaluated at four levels:
a) Excellent: When the total score reaches 80 points or more, including a total score of 18 points or more for the evaluation indices stipulated in Article 11 of this Circular;
b) Good: When the total score reaches 70 points to less than 80 points, including a total score of 15 points or more for the evaluation indices stipulated in Article 11 of this Circular;
c) Satisfactory: When the total score reaches 50 points to less than 70 points, including a total score of 12 points or more for the evaluation indices stipulated in Article 11 of this Circular;
d) Unsatisfactory: When the total score is less than 50 points, or the total score of the evaluation indices stipulated in Article 11 of this Circular is less than 12 points;
Chapter III
IMPLEMENTING PROVISIONS
Article 13. Effective Date
This Circular takes effect from December 6, 2019. In case the referenced legal documents applied in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new regulations;
Article 14. Implementation Organization
1. The Department of Science and Technology, Ministry of Natural Resources and Environment shall be responsible for organizing guidance on the implementation and monitoring the execution of this Circular;
2. Units under the Ministry of Natural Resources and Environment and relevant organizations and individuals are responsible for implementing this Circular.
During the implementation, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to promptly reflect them to the Ministry of Natural Resources and Environment for research, consideration, and appropriate amendment;
