Based on Decree No. 95/2017/NĐ-CP dated August 16, 2017 of the Government detailing the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

At the proposal of the Director General of the Forest Protection Department;, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPThe Standardization Agency under the Ministry of Science and Technology and the Legal Department Director;
The Minister of Science and Technology issues this Circular stipulating in detail certain mandatory contents to be displayed on product labels for some groups of electronic products.
Article 1. Scope of Regulation
This Circular stipulates in detail certain mandatory contents to be displayed on product labels for some groups of electronic products as provided for in point d, Clause 1, Article 10 of Decree No. 43/2017/NĐ-CP dated April 14, 2017 of the Government on product labeling, which has been amended and supplemented by Clause 5, Article 1 of Decree No. 111/2021/NĐ-CP dated December 9, 2021 of the Government amending and supplementing some articles of Decree No. 43/2017/NĐ-CP dated April 14, 2017 of the Government on product labeling, specifically as follows:
1. Mandatory contents to be displayed on product labels for some groups of electronic products from Section 25 to Section 38; Sections 40, 44, 50, 51, 52, 53 and Sections 58 to 64 as specified in Appendix I attached to Decree No. 43/2017/NĐ-CP, which has been amended and supplemented by Decree No. 111/2021/NĐ-CP.
2. Groups of products specified in Appendix I attached to Decree No. 43/2017/NĐ-CP, which has been amended and supplemented by Decree No. 111/2021/NĐ-CP, are not subject to the provisions of Clause 1 of this Article and other contents not included in the Appendices issued with this Circular shall not apply electronic labeling as prescribed in this Circular.
3. Medical devices that implement electronic product labeling shall comply with the regulations set forth in the legal documents issued by the relevant ministries and agencies managing the respective sectors and fields.
Article 2. Applicability
This Circular applies to the following entities:
1. Organizations and individuals producing, trading in goods in Vietnam and organizations and individuals importing goods;
2. State agencies and related organizations and individuals.
Article 3. Principles for displaying certain mandatory contents electronically
1. Organizations and individuals responsible for labeling products may choose to label products electronically or label directly on the product label, packaging, or accompanying documentation as prescribed in Decree No. 43/2017/NĐ-CP, which has been amended and supplemented by Decree No. 111/2021/NĐ-CP. The group of products and the contents to be displayed electronically must comply with the provisions in the Appendix "Certain Contents According to the Nature of the Product Displayed Electronically" attached to this Circular.
2. Organizations and individuals responsible for labeling products when displaying labeling contents electronically as prescribed in this Circular must ensure the following requirements:
a) Electronic methods must clearly display the link on the product label, such as barcode number, QR code, on the electronic screen of the product or other common electronic methods;
b) Ensure that the means, equipment, and/or instructions for customers to access the electronic content of the product label at the location are available;
c) The content displayed electronically must correspond to the content displayed directly on the label, without causing misinterpretation of the nature of the product by the reader, viewer, or listener.
Article 4. Organization of Implementation
1. The Ministry of Science and Technology shall take the lead and coordinate with sectoral and local management agencies to manage, inspect, and handle violations related to product labeling. The state management agency under the Ministry of Science and Technology responsible for standardization, measurement, and quality control shall assist the Minister of Science and Technology in managing product labeling; researching and applying information technology to manage electronic product labeling.
2. Ministries, ministerial-level agencies, and government agencies within their respective functions, tasks, and powers shall cooperate with the Ministry of Science and Technology to manage electronic product labeling. Based on the practical management requirements for products in their respective fields, these ministries and ministerial-level agencies shall guide electronic product labeling after reaching consensus with the Ministry of Science and Technology.
3. Provincial People's Committees and municipal people's committees directly under the central government shall cooperate with the Ministry of Science and Technology and directly manage, inspect, and supervise electronic product labeling in their localities according to the law.
4. Responsibilities of organizations and individuals producing, importing, and trading in goods labeled electronically:
a) Comply with the laws and regulations on product labeling and this Circular; abide by the regulations on inspection, supervision, administrative penalties, and bear legal responsibility for electronic product labeling produced, imported, and traded by themselves;
b) Organizations and individuals producing, importing, and trading in goods labeled electronically must ensure they have sufficient tools and means to allow the electronic product labeling content to be accessed and logged in immediately, providing complete electronic product labeling content to consumers when selecting goods.
1. During implementation, if issues arise or difficulties occur, organizations and individuals shall promptly reflect in writing to the Ministry of Science and Technology for guidance or research on amendments and supplements to ensure compliance.
Article 5. Effective Date
2. The Minister, the Head of a ministry-level agency, the Chairman of the People's Committee of a province or centrally governed city shall be responsible for organizing the implementation of this Circular./.
Article 6. Responsibility for Implementation
1. During implementation, if issues arise or difficulties occur, organizations and individuals应及时以书面形式向科学技术部反映,以便获得指导或研究修改、补充,使之符合规定。
2. The Minister, the Head of a ministry-level agency, the Chairman of the People's Committee of a province or centrally governed city shall be responsible for organizing the implementation of this Circular./.
