Pursuant to the Education Law dated June 14, 2019;

On the basis of the Lawt Torganize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular. Children April 5, 2016;

On the basis of Decree No. 86/2022/NĐ-CP dated October 24, 2022 of At the proposal of stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to the Government Decree number Decree No. 127/2018/NĐ-CP dated September 21, 2018 of the Government on state management responsibilities for education;

On the basis of Decree No. 80/2017/NĐ-CP dated November 17 the 7 year 2017 of the Government stipulating a safe, healthy, friendly educational environment, prevention, and control of school violence;

At the proposal of the Director of the Physical Education Department guiding;

The Minister of Education and Training issues this Circular Hsafe school new rural areas accident prevention, of the National Defense, in general education institutions in general education institutions regular educational institutions. Article 1. This Circular guides the content, measures, inspection, and evaluation of building safe schools, preventing and controlling accidents and injuries in general education institutions and regular educational institutions, and the responsibilities of relevant agencies, organizations, and individuals. Article 2. This Circular applies to general education institutions, regular educational institutions, including: primary schools, secondary schools, high schools, multi-grade schools; boarding schools for ethnic minorities, part-time boarding schools for ethnic minorities; specialized schools, gifted schools, schools for persons with disabilities; centers for regular education, centers for vocational training and regular education (hereinafter referred to as schools) and relevant agencies, organizations, and individuals.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Accidents and injuries

are incidents that occur unintentionally or intentionally by a subject causing physical or mental harm to others or to the subject itself.

Article 2. Interpretation of Terms

In this Circular, the following terms are understood as follows:

1. Safe school, prevention, and control of accidents and injuries is a school where learners, managers, teachers, staff, and visitors are ensured physical and mental safety, free from school violence; protected, treated fairly, kindly, and democratic participation is promoted; minimizing risk factors for accidents and injuries.

2. Article 3. Principles for building safe schools, prevention, and control of accidents and injuries Clause 1. It is a key, ongoing task of each school, prioritized according to the needs of educational development and local conditions.

Clause 2. There should be participation from local authorities and the community; promoting active and effective involvement of learners, managers, teachers, staff, and parents.

Clause 3. Inspection and evaluation work must ensure regularity, objectivity, honesty, timeliness, transparency, and openness.

CONTENT AND MEASURES FOR BUILDING SAFE SCHOOLS,

PREVENTION AND CONTROL OF ACCIDENTS AND INJURIES

Chapter II

Article 4. Content for building safe schools, prevention, and control of accidents and injuries

Clause 1. Ensuring safety of infrastructure, equipment, means, materials, and teaching aids serving educational activities of the school.

Clause 2. Ensuring school security and order; preventing and controlling school violence, crime, social evils; guiding learners to participate safely and healthily in online environments as prescribed by law.

Clause 3. Educating knowledge and skills for preventing drowning; traffic safety; fire prevention and firefighting; responding to disasters and natural calamities; preventing falls, collisions, electric shocks, and other common types of accidents and injuries.

Clause 4. Protecting and caring for students' health: preventing and controlling school epidemics and diseases; ensuring food safety; preventing and controlling the harmful effects of tobacco and new tobacco products, alcohol, and other addictive substances.

Clause 5. Implementing codes of conduct and democratic regulations in the school; educating mental health; conducting psychological counseling for students and social work in the school.

4. Protecting and caring for students' health: preventing and controlling school epidemics and diseases; ensuring food safety; preventing and combating the harmful effects of tobacco and new tobacco products, alcohol, beer, and other addictive substances.

5. Implementing codes of conduct and democratic regulations in schools; educating mental health; providing psychological counseling services to students and social work in schools.

Article 5. Management of safe school construction activities to prevent and combat accidents and injuries

1. Issuing and implementing plans for annual and phased activities in conjunction with the educational development plan of the school; specifically identifying resources for implementation and the timeline for achieving the criteria for safe schools and accident prevention and control as stipulated in the Appendix attached to this Circular.

2. Establishing and implementing regulations for cooperation in constructing safe schools and preventing and combating accidents and injuries among organizations within the school; between the school and parents of students, clearly defining the responsibilities of each individual and organization involved.

3. Developing preventive measures and response plans before, during, and after accidents and injuries occur in the school, and coordinating responses outside the school; plans and measures to ensure safety and prevent accidents and injuries for students when the school organizes or collaborates on extracurricular educational activities.

4. Establishing channels for receiving information and systems for recording, monitoring, and supervising the progress of safe school construction and accident prevention and control activities in the school.

5. Regularly and periodically inspecting activities related to safe school construction and accident prevention and control in the school, and compliance with regulations by students, management staff, teachers, and employees.

Article 6. Ensuring material infrastructure, equipment, means, teaching materials, and learning aids

1. Completing material infrastructure, equipment, means, teaching materials, and learning aids, clean water facilities, toilets, sports facilities, and equipment serving physical education, recreational, and entertainment activities of students in accordance with legal provisions.

2. Regularly reviewing the quality of material infrastructure, equipment, means, teaching materials, and learning aids, clean water facilities, toilets, sports facilities, and equipment serving physical education, recreational, and entertainment activities of students to address potential accident risks or report to competent authorities for resolution.

Article 7. Organizing communication activities

1. Utilizing communication materials on safe school construction and accident prevention and control; ensuring standardization in content, diversity in forms and methods of communication, emphasizing the application of information technology, social media, and other appropriate communication means.

2. Conducting thematic and high-intensity communication campaigns; regularly warning about common accident risks such as drowning, traffic accidents, violence, and other types of accidents.

3. Establishing and effectively using information channels such as suggestion boxes, hotlines, and other suitable methods to collect information and warn against accident risks; diversifying information exchange formats with parents of students, local agencies, organizations, and groups regarding accident prevention and control education for students.

4. Strengthening the promotion of exemplary models, experiences, and successful models in safe school construction and accident prevention and control.

5. Leveraging the role of management staff, teachers, and employees in exemplifying behavior in implementing codes of conduct, grassroots democracy regulations, and preventing school violence.

Article 8. Training and professional development for management staff, teachers, and school employees

1. Assess the awareness, knowledge, and skills of management staff, teachers, and school employees regarding education on preventing and responding to accidents and injuries to develop appropriate training and professional development plans for each group.

2. Organize training to enhance the professional capacity of management staff, teachers, and school employees on building safe schools, preventing and responding to accidents and injuries, basic first aid skills, with particular emphasis on school health personnel, physical education teachers, class advisors, teachers responsible for psychological counseling work, social work, and youth and children's organizations.

3. Conduct teacher training on integrated educational content and methods, incorporating safe school construction and accident prevention and response into various subjects and educational activities.

Article 9. Educating students on ensuring safety and preventing accidents and injuries

1. Implement integrated and combined education on safe school construction and accident prevention and response within various subjects and educational activities.

2. Educate students on ensuring public security and social order, preventing school violence, crime, and social evils within the school, community, and online environment.

3. Educate students on drowning prevention, focusing on swimming skills and water safety skills; coordinate with families, authorities, agencies, organizations, and individuals in managing and organizing safe swimming lessons and drowning prevention for students in the community.

4. Educate students on traffic safety and cooperate with families in monitoring the implementation of traffic safety measures for students in the community.

5. Educate students on fire prevention and firefighting, environmental protection, disaster response, and other accident prevention such as falls, collisions, electric shocks, burns, poisoning, and animal attacks.

6. Organize groups, teams, clubs to help students actively engage in activities and special topics to practice accident prevention and response skills in school and support each other during travel to and from school, at home, and in the community.

Article 10. Coordination with agencies, organizations, and individuals

1. Propose to the local Party committee and government on directing, issuing, and implementing mechanisms for coordination between schools, authorities, and mass organizations in the work of building safe schools and preventing accidents and injuries for students in the area, and coordinating management and education of students in the community during holidays and summer break.

2. Coordinate to organize inspections, warnings, prevention, and elimination of drowning risks, traffic accidents, violence, and other types of accidents involving students in the community.

3. Strengthen mobilization of resources and participation of agencies, organizations, and individuals in educating students on ensuring safety and preventing accidents and injuries, and in professional training for teaching staff.

Chapter III

MONITORING AND EVALUATING THE CONSTRUCTION OF SAFE SCHOOLS,

 PREVENTING AND RESPONDING TO ACCIDENTS AND INJURIES

Article 11. Criteria for evaluating safe schools and accident prevention

1. Schools shall organize implementation, self-assessment of the criteria for safe schools and accident prevention as set out in the Appendix attached to this Circular.

2. The results of evaluating safe schools and accident prevention are assessed at two levels:

a) Level "Achieved": At least 80% of the criteria are evaluated at the "Achieved" level, including all mandatory criteria which must be evaluated at the "Achieved" level.

b) Level "Not Achieved": Not meeting the requirements specified in point a, clause of this Article.

3. The results of evaluating safe schools and accident prevention are among the criteria for assessing and recognizing schools that meet educational quality standards and national standards according to regulations of the Ministry of Education and Training.

Article 12. Organization of assessment and reporting

1. At the end of each academic year, schools shall self-assess and report the results along with recommendations to the direct education management authority. For criteria that have not been achieved, there should be plans and measures for self-correction or recommendations to the competent authority to correct them before the new academic year begins.

2. Schools shall publicly announce the results of their self-assessment on safe schools and accident prevention on their websites, notice boards, and other appropriate public announcement methods so that managers, teachers, staff, parents, and the community can know and supervise.

4. Provincial Departments of Education and Training shall compile and summarize the results of evaluating safe schools and accident prevention for schools under their management; report to the provincial People's Committee and the Ministry of Education and Training.

1. Departments of Education and Training, District Education and Training Departments shall develop inspection plans for the results of building safe schools and accident prevention for schools under their management annually. Inspections may be conducted as separate topics or integrated into other topics during the academic year, with minutes and notifications of inspection results.

2. Departments of Education and Training, District Education and Training Departments shall take the lead or coordinate to organize inter-sectoral inspection teams when requested by competent authorities.

3. The Ministry of Education and Training shall organize inspections or coordinate with central agencies to conduct inter-sectoral inspections according to their authority.

Chapter IV

RESPONSIBILITIES OF AUTHORITIES AND ORGANIZATIONS

Article 14. Responsibilities of schools

1. Organize implementation of contents and measures, self-assessment, and reporting on building safe schools and accident prevention as stipulated in this Circular.

2. The head of the school shall be responsible to higher-level management authorities and the law for organizing the construction of safe schools and accident prevention.

1. Direct, guide, and inspect District Education and Training Departments (for Departments of Education and Training) and schools under their management in implementing this Circular.

2. Review and list schools that have "Achieved" and "Not Achieved" safe schools and accident prevention, clearly identifying reasons for unmet criteria to direct corrections or report to competent authorities to direct corrections.

3. Organize training and capacity building for managers, teachers, and staff on the work of building safe schools and accident prevention annually.

4. Summarize and report the results of building safe schools and accident prevention to the Department of Education and Training (for District Education and Training Departments), the Ministry of Education and Training (for Departments of Education and Training) at the same time as the annual summary report. Timely commendation, reward, and disciplinary action for organizations, units, and individuals within their authority.

Article 16. Responsibilities of People's Committees at all levels

1. Direct implementation, prioritize investment in resources and funds, and be responsible for the work of building safe schools and accident prevention for schools within their management scope.

2. Direct and organize regular coordination between local government forces, mass organizations, and schools in the work of inspection, supervision, warning, prevention, and elimination of common accident risks such as drowning, traffic accidents, violence, and other injuries.

Chapter V

IMPLEMENTING PROVISIONS

Article 17. Effective Date

This Circular takes effect from December 12, 2023.

Article 18. Responsibility for Implementation

The Head of the Office, Heads of the Physical Education Department, Heads of relevant units under the Ministry of Education and Training; Chairmen of provincial and centrally-run city People's Committees, Directors of Departments of Education and Training, heads of schools, organizations, and related individuals are responsible for enforcing this Circular.
