Detailed regulations on decentralization, deconcentration, and determination of state management authority
in the dike and flood control sector

On the basis of Law on Government Organization dated February 18, 2025;

On the basis of Law on Local Administration Organization dated June 16, 2025;

Pursuant to Resolution No. Decision 190/2025/QH15 dated February 19, 2025 of the National Assembly regarding handling certain issues related to the restructuring of the state apparatus;

Decree No. 35/2025/NĐ-CP dated February 25, 2025, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Decree No. Decision 131/2025/NĐ-CP dated June 12, 2025 of the Government on determining the authority of local administrations at two levels in the field of management by the Ministry of Agriculture and Rural Development;

Decree No. Decision 136/2025/NĐ-CP dated June 12, 2025 of the Government on decentralization and deconcentration in the agriculture and environment sector;

At the proposal of the Director of the Dike Management and Flood Control Department;

The Minister of Agriculture and Rural Development promulgates this Circular detailing the determination of state management authority in the dike and flood control sector.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the determination of state management authority in the dike and flood control sector, including:

1. Detailed provisions and guidance for implementing Decrees on decentralization, deconcentration, and determination of authority in the agriculture and environment sector.

2. Amending and supplementing some articles of normative legal documents within the promulgation authority of the Minister of Agriculture and Rural Development to implement the determination of authority.

Article 2. Applicability

This Circular applies to central administrative agencies, local governments, and other organizations and individuals related to the dike and flood control sector.

Chapter II
DETAILED PROVISIONS AND GUIDANCE FOR IMPLEMENTING DECREES ON DECENTRALIZATION, DECONCENTRATION, AND DETERMINATION OF AUTHORITY IN THE AGRICULTURE AND ENVIRONMENT SECTOR

Article 3. Components of the dossier for the review of investment projects for construction works using river beaches, floating islands, or inland areas where there are no existing construction works as prescribed in Article 28 of Decision No. 136/2025/NĐ-CP dated June 12, 2025 of the Government on decentralization and deconcentration in the agriculture and environment sector

The dossier for submitting to the Ministry of Agriculture and Rural Development for the review of investment projects for construction works as stipulated in Clause 3 and Clause 4, Article 26 of the Dike Law shall be implemented according to Clause 3, Article 10 of this Circular.

Article 4. Components of the dossier and forms for procedures prescribed in Decision No. 131/2025/NĐ-CP dated June 12, 2025 of the Government on determining the authority of local administrations at two levels in the field of management by the Ministry of Agriculture and Rural Development

1. Components of the dossier and forms for procedures for providing financial support for medical examination and treatment, and accident allowances (excluding cases of accident allowances reducing work capacity by 5% or more) for members of emergency response forces at the commune level who have not joined health insurance or social insurance as stipulated in Clause 4, Article 19, are as follows:

a) Components of the dossier for medical examination and treatment support include: Application form of the member of the emergency response force at the commune level or their legal representative according to Model No. 01 attached to this Circular; laboratory test results, prescription, receipt, discharge summary.

b) Components of the dossier for accident allowance include: Application form of the member of the emergency response force at the commune level or their legal representative according to Model No. 02 attached to this Circular; discharge summary; copy of medical records or certificate of injury issued by the healthcare facility that provided first aid and treatment; investigation report of the police department (in case of traffic accidents).

2. Components of the dossier and forms for procedures for providing accident allowances reducing work capacity by 5% or more or death benefits for members of the emergency response force at the commune level who have not joined health insurance or social insurance as stipulated in Clause 5, Article 19, are as follows:

a) Components of the dossier for death benefits include: Application form of the legal representative of the member of the emergency response force at the commune level according to Model No. 02 attached to this Circular; discharge summary or copy of medical records or death certificate or extract from the death registration; investigation report of the police department (in case of death due to traffic accidents).

b) Components of the dossier for accident allowance (for cases of accident reducing work capacity by 5% or more) include: Application form of the member of the emergency response force at the commune level or their legal representative according to Model No. 02 attached to this Circular; discharge summary; copy of medical records or certificate of injury issued by the healthcare facility that provided first aid and treatment; assessment report on the degree of reduced work capacity by the medical board of provincial hospitals and equivalent facilities; investigation report of the police department (in case of traffic accidents).

Chapter III
AMENDMENTS AND SUPPLEMENTS TO SOME ARTICLES OF CIRCULARS IN THE DIKE MANAGEMENT AND FLOOD CONTROL SECTOR

Article 5. Amending and supplementing some articles of Circular No. 01/2009/TT-BNN dated January 6, 2009, issued by the Minister of Agriculture and Rural Development guiding patrols and guarding embankments during flood season

1. Amending and supplementing Clause 4 and Clause 5 of Article 6 as follows:

“4. The People's Committee of communes having embankments shall be responsible for purchasing equipment and books as prescribed in Clause 2 of this Article to provide to patrol and guard teams.

5. After the flood season, the team leaders of patrol and guard teams shall be responsible for compiling, summarizing, and returning the equipment as prescribed at point a of Clause 2 of this Article for storage according to the guidance of the People's Committee of the commune.”

2. Amending and supplementing Article 16 as follows:

Article 16. Responsibilities of the People's Committee of communes having embankments

1. Organizing patrol and guard forces for embankments; guiding activities and inspecting, urging patrol and guard work for embankments during the flood season on embankment routes within their jurisdiction.

2. Taking the lead and coordinating with the Embankment Management Station or specialized management agency for embankments to organize professional training for patrol and guard forces on embankments for flood prevention and storm resistance.

3. Equipping and guiding the management and use of equipment and books for patrol and guard teams according to Article 6 of this Circular.

4. Directly managing and directing patrol and guard forces for embankments according to the provisions of this Circular.”

3. Amending and supplementing Clause 2 of Article 17 as follows:

“2. Coordinating with the People's Committee of communes to organize and guide the activities of patrol and guard forces for embankments; directing specialized management forces for embankments to directly guide professional matters for these forces before and during the flood season.”

Article 6. Amending and supplementing some articles of Circular No. 26/2009/TT-BNN dated May 11, 2009, issued by the Minister of Agriculture and Rural Development guiding the organizational structure, funding sources, and remuneration system for civilian embankment management forces

1. Amending and supplementing Clause 3 of Article 2 as follows:

“3. Civilian embankment management forces operate under the management and direction of the People's Committee of communes and technical guidance from the Economic Department or the Economic, Infrastructure, and Urban Department of the People's Committee of communes and the Embankment Management Station or specialized management agency for embankments.”

2. Amending and supplementing Clause 1 of Article 3 as follows:

“1. Implementing the division of labor of the People's Committee of communes and technical guidance from the Economic Department or the Economic, Infrastructure, and Urban Department of the People's Committee of communes and the Embankment Management Station or specialized management agency for embankments.”

3. Amend and supplement Clause 2 of Article 4 as follows:

“2. The People's Committee of communes shall be responsible for compiling reports of embankment management personnel and reporting to the Embankment Management Station or specialized management agency for embankments once a month.”

4. AMENDING AND SUPPLEMENTING ARTICLE 6 AS FOLLOWS:

Article 6. Responsibilities of the People's Committee of the commune where there are dykes

1. Organize the people's dyke management force within its jurisdiction. Directly manage, guide, supervise activities, and urge the implementation of tasks by this force.

2. Taking the lead and coordinating with the Embankment Management Station or specialized management agency for embankments to train about professional and operational matters related to embankment management, protection, and guarding for civilian embankment management forces.

3. Paying remuneration expenses and implementing policies for embankment management personnel according to state regulations.”

5. Amending and supplementing Clause 1 and Clause 2 of Article 7 as follows:

“1. Advising the People's Committee of provinces, coordinating with the People's Committee of communes having embankments to organize and guide the activities of civilian embankment management forces.

2. Organizing and directing the Embankment Management Station or specialized management agency for embankments to coordinate with the People's Committee of communes to organize training about professional and operational matters related to embankment management, protection, and guarding for civilian embankment management forces.”

Article 7. Amend and supplement some articles of Circular No. 54/2013/TT-BNNPTNT dated December 17, 2013 of the Minister of Agriculture and Rural Development guiding the classification of dikes and specifying permissible load for motor vehicles traveling on dikes

1. Amend and supplement Clause 4 of Article 14 as follows:

“4. The Department of Agriculture and Environment of provinces and cities with dikes shall take the lead and coordinate with the Construction Departments, People's Committees at the commune level to install warning signs limiting the load for motor vehicles traveling on dikes according to the contents of this Circular and manage and inspect the implementation of these regulations.”

Article 8. Amend and supplement some articles of Joint Circular No. 43/2015/TTLT-BNNPTNT-BKHĐT dated November 23, 2015 of the Ministers of Agriculture and Rural Development and Planning and Investment guiding the statistics and assessment of losses caused by natural disasters

1. Amend and supplement Point a of Clause 1 of Article 1 as follows:

“a) This Circular stipulates the criteria, forms, content, methods, procedures, and responsibilities for conducting statistics and assessing losses caused by natural disasters of Ministries, ministerial-level agencies; provinces and centrally-run cities (hereinafter referred to collectively as provincial level); communes, wards, special administrative regions under provincial level (collectively referred to as commune level).”

2. Amend and supplement Clause 1 of Article 9 as follows:

“1. Rapid report

a) The Civil Defense Command at the commune level shall prepare and submit a rapid report on the situation of natural disasters and losses to the People's Committee at the commune level, the Department of Agriculture and Environment, and the Civil Defense Command at the provincial level before 4 PM daily.

b) The Department of Agriculture and Environment shall take the lead in advising the Civil Defense Command at the provincial level to compile and prepare a rapid report on the situation of natural disasters and losses to be submitted to the People's Committee at the provincial level, the Ministry of Agriculture and Rural Development, and the National Civil Defense Steering Committee before 5 PM daily.

c) The Civil Defense Commands of ministries and ministerial-level agencies shall prepare a rapid report on the situation of natural disasters and losses (if any) within their management scope to be submitted to the Ministry of Agriculture and Rural Development and the National Civil Defense Steering Committee before 5 PM daily.

d) In addition, reporting units may exchange information by phone, text messages, or email to update and monitor the situation of natural disasters and losses caused by natural disasters. In case of emergency situations, the People's Committee at the commune level shall immediately report to the People's Committee at the provincial level; the People's Committee at the provincial level and ministries and ministerial-level agencies shall promptly submit supplementary reports to the Ministry of Agriculture and Rural Development and the National Civil Defense Steering Committee.”

Article 9. Amend and supplement some articles of Circular No. 02/2021/TT-BNNPTNT dated June 7, 2021 of the Minister of Agriculture and Rural Development guiding the development of disaster prevention and control plans at various levels in localities

1. Amend and supplement Article 5 as follows:

Article 5. Characteristics of population, socio-economic conditions, and infrastructure in the province

1. Characteristics of population and socio-economic conditions:

a) Population characteristics include total population, density, distribution, vulnerable groups, ethnic minorities, poverty rate, near-poor households, number of households in high-risk areas requiring relocation; housing characteristics (permanent, semi-permanent, poorly constructed, simple) and distribution by commune administrative units; education, health, cultural, ethnic, and customs.

b) Socio-economic characteristics include major economic sectors affected by natural disasters (agriculture, forestry, fisheries, industry, trade, tourism, and services), socio-economic development orientation of the locality.

2. Infrastructure characteristics:

Statistics and evaluation of main infrastructure within the management scope, including: transportation system, irrigation, flood and storm defense systems; power grid, communication network, radio, television; drainage, clean water supply, environmental treatment systems; school, hospital, industrial zone systems; rescue and evacuation routes, and other infrastructure. Comprehensive statistics and evaluation of the entire province, centrally-run city, and detailed statistics for key areas affected by natural disasters at the commune level.”

2. Amend and supplement Clause 2 of Article 6 as follows:

“2. Civil defense system at all levels and coordination regulations: describe the organizational structure of the Civil Defense Command at all levels; resources, equipment, facilities of the agency assigned the main responsibility for disaster prevention and control work at the provincial level; specify the division of tasks among members and coordination regulations between related agencies.”

3. Amend and supplement Article 17 as follows:

“Article 17. Contents of the commune-level disaster prevention and control plan

1. Legal basis for developing the plan: Law on Disaster Prevention and Control; Law Amending and Supplementing Certain Articles of the Law on Disaster Prevention and Control and the Law on Dikes; Water Resources Law; provincial disaster prevention and control plan; guiding documents of the Law and related documents.

2. Purpose and requirements: Consistent with the provincial disaster prevention and control plan; the policy of the People's Council at the commune level; actual conditions and resources at the commune level.

3. Natural, population, socio-economic, and infrastructure characteristics within the management scope as prescribed in Article 18 of this Circular.

a) Natural characteristics: Geographic location; topography, geology; meteorology, hydrology, marine conditions;

b) Population, socio-economic, and infrastructure characteristics within the management scope as prescribed in Article 18 of this Circular.

4. Local disaster situation:

a) Types of disasters frequently occurring: statistics and evaluation of intensity, frequency, and regular occurrence time;

b) Affected areas, sectors, and high-risk zones impacted by disasters;

c) Statistics of losses caused by disasters in the locality;

d) Evaluation of the current status of disaster prevention and control work at the commune level as prescribed in Article 19 of this Circular.

5. Contents and measures for disaster prevention and control as prescribed in Article 20 of this Circular.

6. Preparation of materials, means, equipment, and essential supplies for disaster prevention and control activities: based on the annual emergency response plan of the commune approved, including quantity of materials and equipment; agencies and units responsible for preparation; storage locations and contracted units ready for mobilization when disasters occur.”

7. Incorporate disaster prevention and control content into planning and development plans for the economy and society in accordance with the guidelines of the Ministry of Finance.

8. Propose resource requirements and implementation schedules in accordance with Article 20a of this Circular.

9. Determine the responsibility for organizing implementation in accordance with Article 21 of this Circular.”

4. Amend and supplement Article 18 as follows:

Article 18. Demographic characteristics, economic and social conditions, and infrastructure at the commune level

1. Characteristics of population and socio-economic conditions:

a) Demographic characteristics include total population, density, distribution of residents, especially vulnerable groups, ethnic minorities, poverty rate, near-poverty rate, number of households in high-risk areas requiring relocation due to natural disasters; housing characteristics (permanent, semi-permanent, poorly constructed, simple); education, health, cultural, and ethnic characteristics, customs;

b) Economic and social characteristics of major industries affected by natural disasters (agriculture, forestry, fisheries, industry, trade, tourism, and services), and local economic and social development orientations.

2. Infrastructure characteristics:

Statistics and evaluation of main infrastructure within the management scope, including: transportation systems, irrigation systems; power networks, information and communication systems; drainage and clean water supply systems, environmental treatment systems; school systems, medical stations, and other infrastructure.”

5. Amend and supplement Article 19 as follows:

Article 19. Evaluation of current disaster prevention and control work at the commune level

1. Civil defense command work, forces, and emergency response plans include: establishment and improvement of the Civil Defense Command Board at the commune level; establishment and improvement of the emergency force for disaster prevention and control at the commune level; development of emergency response plans and operational directives.

2. Forces, equipment, materials, supplies for disaster prevention and control: inventory quantity; agencies and units mobilizing and storing; storage locations; quality and usage period.

3. Information and communication on disaster prevention and control

Evaluate the current status of the information and communication system, disaster warning system both general and specific at the local level; methods of information dissemination and propaganda on disaster prevention and control work.

4. Community capacity and awareness in disaster prevention and control

General assessment of community awareness and skills, and training activities on disaster prevention and control at the local level.

5. Current status of disaster prevention and control facilities in the locality: Inventory and assess the capacity, degree, and resistance capability of disaster prevention and control facilities in the area.

6. Financial resources for implementing disaster prevention and control work in the locality, direct or indirect investment (through integrated content) including: regular budget expenditure; development investment budget; state budget reserve; Disaster Prevention and Control Fund; Financial Reserve Fund; support funds from international organizations; voluntary contributions from organizations and individuals, and other lawful sources.”

6. Amend and supplement Article 20 as follows:

Article 20. Contents and Measures for Disaster Prevention and Control

1. Organize information dissemination to enhance community awareness about disaster prevention and control

Organize activities for information dissemination to enhance community awareness about disaster prevention and control including: broadcasting disaster prevention and control news; distributing educational materials to residents and communities; broadcasting warning news, guidance on disaster prevention and control skills in the managed area.

2. Develop emergency response plans for various levels of disaster risk and specific types of disasters commonly encountered locally: Based on the situation and development trends of disasters in the locality, human resources, materials, and equipment for disaster prevention and control, develop emergency response plans.

3. Construct local disaster prevention and control projects according to the classification: Identify disaster prevention and control projects in the area that are classified for implementation, and prioritize project lists in the commune-level disaster prevention and control plan.

4. Establish a standing organization to update information on disaster developments as prescribed.

5. Identify hazardous areas within the management scope: Based on the disaster situation in the locality, particularly historical disasters and geographical and geological features of the managed area, determine hazardous zones.

6. Prepare evacuation sites: Based on the actual situation in the locality, the location of hazardous areas, determine the number of households needing evacuation, evacuation capabilities, to select sites, develop plans, and prepare for evacuation when required.

7. Organize training, drills, and exercises for disaster prevention and control skills.

8. Basic measures for commune-level disaster prevention and control detailed in Appendix IV issued together with this Circular.”

7. Supplement Article 20a after Article 20 as follows:

Article 20a. Proposing resource requirements for implementing the commune-level disaster prevention and control plan

1. List of disaster prevention and control works according to the annual and five-year plans: project name, location, estimated total investment, expected implementation time, annual capital allocation.

2. Annual and five-year human resources and financial needs to implement tasks: training to enhance community awareness on disaster prevention and control; surveying and statistics to identify dangerous areas caused by various types of disasters within the locality; developing response plans for specific types of disasters frequently occurring in the locality; purchasing specialized equipment for disaster prevention and control command and control activities.”

8. Amend and supplement Article 21 as follows:

Article 21. Responsibilities for organizing the implementation of the disaster prevention and control plan

Determining the responsibilities of agencies, organizations, and individuals in implementing and supervising, evaluating the commune-level disaster prevention and control plan.

1. Determining the specific responsibilities of agencies, organizations, and individuals in implementing projects and tasks under the disaster prevention and control plan.

2. Determining the responsibilities of agencies, organizations, and individuals in reviewing and supervising, evaluating the annual and five-year disaster prevention and control plan to ensure the achievement of the plan's objectives.”

9. Amend and supplement Clause 3 of Article 22 as follows:

“3. The People's Committee of the commune:

a) Directs the Economic Office or the Economic, Infrastructure, and Urban Planning Office: to take the lead and coordinate with relevant departments, offices, and organizations to organize the collection, analysis of data, draft, and advise the Chairman of the People's Committee of the commune to approve the five-year disaster prevention and control plan and the annual implementation plan; to take the lead and coordinate with relevant departments to develop response plans for specific types of disasters frequently occurring in the locality; to develop annual plans for organizing permanent disaster prevention and control work; to take the lead in identifying dangerous areas caused by various types of disasters within the locality; to coordinate with the Military Command of the commune and relevant departments to develop plans for training, drills, and skills exercises for disaster prevention and control.

b) Directs relevant departments and units according to their functions and tasks, to coordinate with the Economic Office or the Economic, Infrastructure, and Urban Planning Office in the development, implementation, and updating of the local disaster prevention and control plan.”

10. Amend the title of Appendix IV as follows: "FUNDAMENTAL MEASURES FOR COMMUNE-LEVEL DISASTER PREVENTION AND CONTROL"

Article 10. Amend and supplement some articles of Circular No. 04/2021/TT-BNNPTNT dated June 28, 2021, issued by the Minister of Agriculture and Rural Development guiding the implementation of approval and review procedures for activities related to dykes

1. Amend and supplement Article 1 as follows:

Article 1. Scope of Regulation

This Circular guides the implementation of obtaining the approval of the Ministry of Agriculture and Environment for activities related to dykes and the review of contents related to flood drainage and safety of dykes for investment construction projects on river beaches, floating islands, or land masses without existing construction works approved by the Chairman of the Provincial People's Committee.”

2. Amend and supplement Clause 1 of Article 4 as follows:

“1. Investment construction projects using river beaches, floating islands, or land masses without existing construction works before being approved by the Chairman of the Provincial People's Committee must be reviewed in accordance with laws on construction and investment, and must be reviewed by the Ministry of Agriculture and Environment regarding contents related to flood drainage and safety of dykes.”

3. Amend and supplement Clause 3 of Article 4 as follows:

“3. Method of requesting review

The Provincial People's Committee sends the Ministry of Agriculture and Environment a set of Review Request Documents through direct submission or postal service, including:

a) A report from the Provincial People's Committee;

b) Written opinions of the Department of Agriculture and Environment submitted to the Provincial People's Committee;

c) Project documents for investment construction that include contents related to flood prevention planning of the river with dykes, dyke planning, provincial planning, land use planning, urban and rural planning according to the law on planning, and calculation results meeting the requirements for safety of dykes and flood drainage as stipulated in Clause 3 of Article 26 of the Dyke Law, Clause 13 of Article 13 of the Law amending and supplementing certain provisions of 37 laws related to planning, and Article 5 of Decree No. 113/2007/ND-CP dated June 28, 2007 of the Government detailing and guiding the implementation of certain provisions of the Dyke Law;

d) Other documents related to the construction and implementation of the project (if any);

đ) An independent consulting firm's review document on the impact of the project on the safety of dykes and flood drainage in the riverbed, specifically about the reduction in design flood flow rate; increase in design flood water level; impact on adjacent, upstream, and downstream flows; stability of the riverbed; stability of the dyke body and foundation in the construction area;

e) A document from the Provincial People's Committee related to projects affecting two provinces or more.”

4. Amend and supplement Clause 4 of Article 4 as follows:

“4. Receiving and processing review request documents

a) The Directorate of Dyke Management and Disaster Prevention and Control under the Ministry of Agriculture and Environment is the agency responsible for receiving and processing review request documents.

b) In cases where the documents are incomplete or require additional materials, within three working days from the date of receipt, the Directorate of Dyke Management and Disaster Prevention and Control reports to the Ministry of Agriculture and Environment to issue a written notice to the Provincial People's Committee requesting supplementation and completion of the documents.

c) Within fifteen working days from the date of receipt of complete documents, the Directorate of Dyke Management and Disaster Prevention and Control examines the documents, organizes the review, reports to the Ministry of Agriculture and Environment for written comments, and sends them to the Provincial People's Committee.”

Article 11. Amend and supplement some articles of Circular No. 13/2021/TT-BNNPTNT dated October 27, 2021 issued by the Minister of Agriculture and Rural Development on ensuring requirements for natural disaster prevention and control in the management, operation, and use of mineral extraction areas, other natural resource exploitation areas, urban areas, tourism sites, industrial zones, historical relics; tourist spots; rural residential areas; flood control works, transportation, power, telecommunications, and other technical infrastructure. 1. Amend and supplement Point a Clause 3 Article 11 as follows:

"a) Advise the People's Committee of the province to instruct the People's Committee of the commune to protect the stations installed within the province for monitoring and warning natural disasters."

2. Repeal Section 2 Chapter II including Articles 11, 12, 13, 14, 15, 16 and Clause 2 Article 22 of Circular No. 02/2021/TT-BNNPTNT dated June 7, 2021 issued by the Ministry of Agriculture and Rural Development guiding the construction of natural disaster prevention and control plans at all levels in localities.

Chapter IV
IMPLEMENTING PROVISIONS

Article 12. Effective Date

1. This Circular takes effect from July 1, 2025.

3. Natural disaster prevention and control plans at all levels that have been approved shall continue to be implemented until the end of their implementation cycle or until they are amended, supplemented, or replaced according to Article 9 of this Circular.

1. The People's Council of the Special Administrative Region, the People's Committee of the Special Administrative Region, the Chairman of the People's Committee of the Special Administrative Region, and specialized agencies under the People's Committee of the Special Administrative Region shall exercise the powers and responsibilities of the People's Councils, People's Committees, Chairmen of People's Committees, and specialized agencies under the People's Committees of coastal districts.

Article 13. Responsibility for Implementation

2. The People's Councils of communes, People's Committees of communes, Chairmen of People's Committees of communes, and specialized agencies under the People's Committees of communes shall exercise corresponding powers and responsibilities of the People's Councils, People's Committees, Chairmen of People's Committees, and specialized agencies under the People's Committees of districts.

3. During the implementation of this Circular, if there are difficulties or obstacles, agencies, organizations, and individuals shall promptly report to the Ministry of Agriculture and Environment for guidance and research to amend and supplement.
