DECISION

On the List of State Secrets of Top Secret and High Secret Levels

of Provincial Party Committees, People's Councils, People's Committees, and Related Agencies and Organizations under Central Cities and Provinces

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Ordinance on Protecting State Secrets dated December 28, 2000;

Pursuant to Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government Government detailing the implementation of the Ordinance on the Protection of State Secrets;

Considering the proposal of the Minister of Public Security,

DECISION:

Article 1. The List of State Secrets of Top Secret Level of Provincial Party Committees, People's Councils, People's Committees, and Related Agencies and Organizations under Central Cities and Provinces (hereinafter referred to as provinces) includes information within the following scope:

1. Special important programs, projects, plans of Provincial Party Committees and provincial People's Committees regarding security, defense, implementation plans for general mobilization orders to protect the country within the province.

2. Policies and guidelines of the province within the scope of functions concerning international cooperation in the fields of security and defense, border management; complex situations involving security and public order in special residential areas that have not been or will not be announced.

Article 2. The List of State Secrets of High Secret Level of provinces includes information within the following scope:

1. Resolutions of Provincial Party Committees, directives, decisions, and documents of People's Councils and People's Committees of the province regarding security and defense; economic and social development, science, technology, and industry of the province that have not been announced.

2. Contents of work meetings between Party and State leaders and the Standing Committee of the Provincial Party Committee, the Standing Body of the People's Council, and the People's Committee of the province on internal politics, security, defense, economy, and society that have not been or will not be announced.

3. Plans and deployment schemes of provincial forces when the state declares a state of emergency within the province. Plans and coordination schemes among provincial forces to prevent and combat terrorism, disorder, and riots; handling complex situations involving security and public order affecting national security in special residential areas.

4. Schemes for protecting Party and State leaders and heads of foreign states and international organizations visiting, working, or passing through the province.

5. Files, documents, and political internal protection plans of provincial-level Party agencies, district-level Party committees, town-level Party committees, city-level Party committees under the province, and affiliated Party committees.

6. Negotiation and agreement contents of the province with state organizations and non-governmental organizations from foreign countries, international organizations on economic and social cooperation, science, technology, and industry that both parties agree not to announce.

7. Absolute figures on national reserves within the province.

8. Prevention and protection plans for the security and safety of transmission and broadcasting systems of the province.

Article 3. This Decision shall take effect fifteen days after its publication in the Official Gazette. The Minister of Public Security shall be responsible for guiding and supervising the implementation of this Decision.

Article 4. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, and Chairpersons of provincial People's Committees and municipal People's Committees directly under the Central Government are responsible for enforcing this Decision./.
