Pursuant to Decree No. 35/2013/NĐ-CP dated April 22, 2013, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Clause 3, Article 4 of Decree No. 73/2013/NĐ-CP dated July 15, 2013 of the Government on adjusting pensions, social insurance allowances, and monthly allowances for village cadres who have retired (Decree No. 73/2013/NĐ-CP);

The Minister of National Defense and the Minister of Finance issue this Circular guiding the adjustment of monthly allowances for military personnel and individuals engaged in confidential work receiving salaries equivalent to those of military personnel and public security officers who have been demobilized, discharged, or retired and are currently receiving monthly allowances,
Article 1. Scope of Regulation and Applicability
This Circular guides the adjustment of the amount of monthly allowances for the following subjects:
1. Military personnel who have been demobilized, discharged, or retired and are currently receiving monthly allowances according to Decision No. 142/2008/QĐ-TTg and Decision No. 38/2010/QĐ-TTg.
2. Military personnel and individuals engaged in confidential work receiving salaries equivalent to those of military personnel and public security officers who have been demobilized, discharged, or retired and are currently receiving monthly allowances according to Decision No. 62/2011/QĐ-TTg.
Article 2. Method of calculation and adjustment level
1. Increase the monthly allowance by 9.6% for the subjects guided in Article 1 of this Circular according to the following formula:
The monthly allowance received from July 1, 2013 = Monthly allowance received at the time of June 2013 x 1.096
2. The adjusted monthly allowance for the subjects in Article 1 of this Circular is as follows:
- From 15 to less than 16 years, the allowance is 1,282,000 VND/month;
- From 16 to less than 17 years, the allowance is 1,347,000 VND/month;
- From 17 to less than 18 years, the allowance is 1,411,000 VND/month;
- From 18 to less than 19 years, the allowance is 1,475,000 VND/month;
- From 19 to less than 20 years, the allowance is 1,539,000 VND/month.
1. The funding for the implementation of the policy on exemption and subsidy of tuition fees shall be guaranteed by the state budget in accordance with the provisions of the law on the decentralization of budget management.
The funds for paying monthly allowances to these subjects shall be guaranteed by the central budget. The Ministry of Finance shall ensure the allocation based on the proposal of the Ministry of Labor, Invalids, and Social Affairs to authorize the Department of Labor, Invalids, and Social Affairs to pay out.
Article 4. Effective date
1. This Circular takes effect 45 days from the date of issuance.
2. The subjects guided in Article 1 of this Circular shall have their monthly allowances increased from July 1, 2013.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. The Ministry of National Defense shall take the lead and coordinate with the Ministry of Finance to direct, guide, and inspect agencies, units, and localities in implementing this Circular.
2. For subjects who had decisions on receiving monthly allowances before the effective date of Decree No. 73/2013/NĐ-CP, the competent labor, invalids, and social affairs authorities shall be responsible for adjusting the level of benefits according to the guidelines of this Circular. For subjects under consideration for receiving benefits, the Ministry of National Defense shall be responsible for adjusting the level of benefits according to the guidelines of this Circular.
3. During implementation, if there are any difficulties, agencies, units, and localities shall report to the Ministry of National Defense for coordination with the Ministry of Finance to examine and resolve them./.
