PRIME MINISTER

Pursuant to Article 20 of the Government Organization Law dated September 30, 1992;

To advise the Prime Minister on important issues related to the development of architecture, urban construction, and environmental landscape nationwide,

DECISION:

Article 1. Now hereby promulgating with this Decision the Regulations on the organization and operation of the National Architecture Council.

Article 2. These Regulations shall take effect from the date of issuance.

The National Architecture Council, Ministers, Heads of ministerial-level agencies, agencies under the Government, Chairpersons of Provincial People's Committees, and Municipal People's Committees directly under the Central Government are responsible for implementing this Decision.

REGULATIONS

ON THE ORGANIZATION AND WORKING PROCEDURES OF
THE NATIONAL ARCHITECTURE COUNCIL

PART I

FUNCTIONS, DUTIES, AND POWERS OF THE NATIONAL ARCHITECTURE COUNCIL
THE NATIONAL ARCHITECTURE COUNCIL

Article 1. The National Architecture Council is an advisory body to the Prime Minister regarding important issues concerning the development of architecture, urban construction, and environmental landscape nationwide.

Article 2. The National Architecture Council has the duty to assist the Prime Minister in:

1. Directions and strategies for the development of architecture, urban construction, and priority space utilization programs during each period.

2. Major policies to promote the development of architectural art and urban construction.

3. Drafting national regulatory documents (Laws, Ordinances, Resolutions, Decrees of the Government) on the organization and activities of architecture, urban planning, and environmental space.

4. Reviewing and selecting comprehensive architectural solutions and design projects for planning and specific construction works that are significant in terms of economic, cultural, and social aspects of the country.

5. Content and methods of training and developing the architectural workforce as well as construction experts.

6. Providing opinions on other important issues related to architecture and urban construction as requested by the Prime Minister or deemed necessary by the Council to propose to the Prime Minister.

Article 3. - The term of office of the National Architecture Council is five years.

Article 4. - Duties of members of the National Architecture Council:

1. The Chairman has the responsibility to:

Lead the Council's operations according to its functions, duties, and powers as stipulated in Articles 1 and 2, Chapter I of these Regulations.

Convene and chair meetings of the Council.

Prepare the content of issues to be discussed at the Council meetings.

2. The Vice-Chairman has the responsibility to:

Assist the Chairman in leading the Council's general work and be accountable to the Chairman for the tasks assigned.

Represent the Chairman in managing and resolving Council matters within the Chairman's authority when the Chairman is absent.

3. Members of the Council participate in the Council as individuals without representing the agencies or organizations they head, and have the responsibility to:

Fully attend all Council sessions.

Prepare adequately to contribute opinions on issues to be discussed or provide comments on documents sent by the Chairman and Vice-Chairman.

Safeguard all documents and data according to the common regulations of the State and the Council.

Article 5. - The National Architecture Council has an office located at the Vietnam Association of Architects, comprising some staff members of the Vietnam Association of Architects who serve concurrently.

Article 6. - Members of the Council have the right:

1. To be provided with necessary information on economic, social, scientific, and cultural issues of the nation and to access relevant materials and data related to the content of Council meetings.

2. To be guaranteed necessary working conditions according to the prescribed regime to fulfill the duties stipulated in Articles 1 and 2 of these Regulations.

PART II

METHODS OF OPERATION AND WORKING RELATIONSHIPS

OF THE NATIONAL ARCHITECTURE COUNCIL

Article 7. - The main mode of operation of the National Architecture Council is advisory and critical review of issues prepared by state functional agencies, as requested by the Prime Minister; in cases where necessary, the National Architecture Council may express its own opinions or recommendations on issues not proposed by the functional agencies.

Article 8. - The National Architecture Council convenes regularly once every quarter.

When there is urgent business or upon request by the Prime Minister, the Chairman may convene extraordinary meetings.

Article 9. - At least two-thirds of the total number of Council members must attend the National Architecture Council meetings.

When necessary, the Chairman may invite some experts and representatives of related agencies to attend but not to vote on Council issues.

Article 10. - The working method of the National Architecture Council is discussion, contribution of opinions, and voting according to the majority recommendations of the Council. All opinions expressed at the Council must be fully recorded for the Prime Minister's reference and for archival purposes.

Recommendations and minutes of Council meetings are submitted to the Prime Minister signed by the Chairman of the National Architecture Council and the session secretary.

Article 11. - The operating budget of the National Architecture Council is funded from the State Budget through the Vietnam Association of Architects.

CHAPTER III

FINAL PROVISIONS

Article 12. - Any amendments or supplements to these Regulations are proposed by the National Architecture Council and decided upon by the Prime Minister.

Article 13. - These Regulations take effect from the date of issuance./.
