Regarding the Provisional Announcement of the List of Inland Waterway Passenger Transport Routes
THE MINISTER OF TRANSPORTATION
Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 91/2001/NĐ-CP dated December 11, 2001 of the Government on conditions for operating certain transportation services in inland waterways;
Pursuant to the proposals of the Departments of Transport and the Departments of Transport and Public Works;
At the proposal of the Director of the Legal Department and the Director of the Vietnam Inland Waterway Transport Administration,

Article 1. Announce provisionally the List of Inland Waterway Passenger Transport Routes.
Article 2
1. The Vietnam Inland Waterway Transport Administration shall, based on the unified opinions of the Departments of Transport and the Departments of Transport and Public Works at locations where ports and wharfs accept passenger-carrying vessels, implement the confirmation of registration for passenger transport routes for the following entities:
a) Enterprises with foreign investment
b) Cross-border transport
2. The Departments of Transport and the Departments of Transport and Public Works shall implement the confirmation of registration for passenger transport routes for organizations and individuals not falling within the scope defined in Clause 1 of this Article; for inter-provincial routes, they must have the unified opinion of the relevant Departments of Transport or Departments of Transport and Public Works managing ports and wharfs where vessels are registered to pick up and drop off passengers.
Article 3
1. Organizations and individuals engaged in fixed-route inland waterway passenger transport may only register their operations on routes that have been officially announced by the competent authority. In cases where organizations and individuals wish to operate on routes that have not yet been announced, they must request the Departments of Transport or the Departments of Transport and Public Works to submit applications to the competent authority for supplementary announcement.
2. Organizations and individuals currently operating passenger transport on officially announced routes will be given priority in confirming the schedules of their vessels. Where multiple organizations and individuals apply to operate on the same route, the competent authority as stipulated in Article 2 of this Decision shall coordinate to arrange schedules to confirm the registration of operations for the vessels of these organizations and individuals.
Article 4. This Decision takes effect from September 1, 2003.
Repeal Section II, Part A of Circular No. 06/2002/TT-BGTVT dated April 25, 2002 of the Ministry of Transport.
Article 5. The Heads of the Ministry's Office, the Directors of the Legal Department, the Transport Department, the Vietnam Inland Waterway Transport Administration, the Directors of the Departments of Transport and the Departments of Transport and Public Works, the Heads of agencies and units, and related individuals are responsible for implementing this Decision.
