ON THE TASKS AND POWERS OF MILITARY ORGANIZATIONS, MILITARY COMMAND BOARDS OF CENTRAL AGENCIES AND ORGANIZATIONS IN THE FIELD OF NATIONAL DEFENSE AND SECURITY EDUCATION

MINISTER OF NATIONAL DEFENSE

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Issuance of Regulatory Legal Documents dated November 12, 1996, amended and supplemented some articles on December 16, 2002;

Pursuant to Decree No. 30/2004/CP dated January 16, 2004 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

Pursuant to Decree No. 116/2007/NĐ-CP dated July 10, 2007 of the Government on National Defense and Security Education;

Implementing Directive No. 12-CT/TW dated May 3, 2007 of the Political Bureau of the Central Committee of the Communist Party of Vietnam (Xth tenure) on Strengthening the Leadership of the Party over National Defense and Security Education Work in the New Situation;

Considering the proposal of the General Chief of Staff;

DECISION:

Article 1. This Decision stipulates the tasks and powers of military organizations, military command boards of central agencies and organizations in implementing Directive No. 12-CT/TW dated May 3, 2007 of the Political Bureau of the Central Committee of the Communist Party of Vietnam (Xth tenure) on Strengthening the Leadership of the Party over National Defense and Security Education Work in the New Situation; Decree No. 116/2007/NĐ-CP dated July 10, 2007 of the Government on National Defense and Security Education (hereinafter referred to as Decree No. 116/2007/NĐ-CP); Decision No. 1404/QĐ-TTg dated October 16, 2007 of the Prime Minister on the establishment of the Central Council for National Defense and Security Education and Military Regions (hereinafter referred to as Decision No. 1404/QĐ-TTg).

Article 2. The General Staff is the central coordinating agency with agencies inside and outside the military, tasked with advising the Minister of National Defense on state management of national defense and security education; coordinating and cooperating with ministries, ministerial-level agencies, government agencies, central political-social organizations (hereinafter referred to as ministries, departments, agencies, and organizations) related and provincial people's committees (hereinafter referred to as provincial level) in performing the tasks of the Ministry of National Defense as prescribed in Clause 1, Article 14 of Decree No. 116/2007/NĐ-CP; deciding on the organization, positions, and staffing of management cadres of the Permanent Office assisting the Council for National Defense and Security Education as prescribed in Clause 2, Article 7 of Decree No. 116/2007/NĐ-CP.

1. The Civil Defense Department

a) Is the Permanent Office for National Defense and Security Education of the Ministry of National Defense and the Central Council for National Defense and Security Education, assisting the Head of the Ministry of National Defense and the General Staff in state management of national defense and security education; advising and proposing tasks, contents, organization, and methods of national defense and security education; organizing coordination and cooperation with functional agencies within the military and ministries, departments, agencies, organizations, and localities in performing the tasks of the Ministry of National Defense as prescribed in Clause 1, Article 14 of Decree No. 116/2007/NĐ-CP.

b) Drafting and participating in drafting documents for the Party, Government, Central Council for National Defense and Security Education, Ministry of National Defense, and General Staff on national defense and security education work.

c) Taking the lead and coordinating with functional agencies of the Ministries of Public Security, Education and Training, Labor, Invalids and Social Affairs, and relevant agencies and organizations, proposing standards of knowledge in national defense and security for the subjects as prescribed in Article 4 of Decree No. 116/2007/NĐ-CP; developing programs, directing the content of textbook compilation, materials, and assisting the Board of Examination of the Ministry of National Defense in organizing the examination of programs, textbooks, and materials for training knowledge in national defense and security for the subjects as prescribed in Article 5 of Decree No. 116/2007/NĐ-CP.

d) Coordinating with functional agencies of the Ministry of National Defense and relevant agencies under ministries, departments, agencies, and organizations, directing, guiding, monitoring, and organizing the implementation of the Program of National Defense and Security Education for the subjects as prescribed in Articles 4 and 5 of Decree No. 116/2007/NĐ-CP; coordinating with the Cadre Training Department under the Organization Commission of the Central Committee and the National Defense Academy to advise, convene, organize, and monitor the results of training knowledge in national defense and security for subject 1 at the National Defense Academy; unifying the number and composition of subject 2 of central agencies and organizations located within the Military Region as prescribed in Point b, Clause 1, Article 5 of Decree No. 116/2007/NĐ-CP to inform the Commanders of the Military Regions and the Political and Military Academy to implement training knowledge in national defense and security.

e) Coordinating with functional agencies under the Ministry of Education and Training and relevant agencies under ministries, departments, agencies, and organizations in developing projects, programs, textbooks, plans, and organizing the training and retraining of lecturers, teachers, and managers of the subject of National Defense and Security Education as prescribed in Article 12 of Decree No. 116/2007/NĐ-CP.

f) Leading and coordinating with the Planning and Investment Department, the Finance Department under the Ministry of National Defense, the National Defense Education Department under the Ministry of Education and Training, and relevant agencies in formulating proposals for building and consolidating centers for national defense and security education in military schools of military regions and provincial military schools as prescribed in Clause 4, Article 11 of Decree No. 116/2007/NĐ-CP; preparing budgets for constructing specialized classrooms, equipment, and military supplies for the tasks of national defense and security education of national defense and security education centers, sports clubs for vocational orientation in national defense and military technology, and investment projects in the field of national defense and security education managed by the Ministry of National Defense, reporting to the Minister of National Defense for approval by the Government. Directing national defense and security education centers, sports clubs for vocational orientation in national defense and military technology under the Ministry of National Defense to operate according to regulations and achieve practical effectiveness.

g) Develop and organize the implementation of the Work Plan of the Central National Defense and Security Education Council; prepare content, ensure and organize meetings of the Central National Defense and Security Education Council and its Standing Office. Maintain close relations with members of the Central National Defense and Security Education Council, ministries, agencies, organizations, and provincial/municipal people's committees under the central government to grasp and synthesize the results of national defense and security education tasks.

h) Urge, inspect, participate in audits, and compile results of the implementation of national defense and security education tasks; report to the General Staff Department, Ministry of National Defense, and the Central National Defense and Security Education Council; coordinate with the General Staff Department Office, Ministry of National Defense Office, and related agencies to prepare content and ensure work for mid-term and final review conferences on national defense and security education.

i) Organize delegations to study, exchange experiences in national defense and security education and civil defense work abroad and conduct scientific research on national defense and security education.

k) Annually prepare the budget estimate to ensure the national defense and security education tasks; manage, use, and settle the budget allocated for implementing national defense and security education tasks in accordance with state budget laws and guiding documents.

2. The School Administration Bureau

a) Coordinate with the Militia Self-Defense Forces Bureau to direct the implementation of plans to enhance knowledge of national defense and security for cadres at the National Defense Academy, Political Military Academy, military schools of military regions, and provincial military schools according to their respective levels; participate in compiling, revising, and supplementing curricula, textbooks, and materials for enhancing national defense and security knowledge for cadres at all levels as per the Ministry's plan.

b) Coordinate with functional agencies under the Ministry of Education and Training, Ministry of National Defense, Ministry of Public Security, and related agencies to develop proposals, programs, and plans for joint training of lecturers, teachers, and educational management staff in national defense and security as stipulated in Article 12 of Decree No. 116/2007/ND-CP; direct and guide military schools to implement the Ministry of National Defense's plan on training and enhancing lecturers, teachers, and educational management staff in national defense and security according to the joint training program.

c) Coordinate with the Militia Self-Defense Forces Bureau, the National Defense Education Department under the Ministry of Education and Training, and related agencies to develop proposals for building and consolidating national defense and security education centers in military schools managed by the military; direct military schools with national defense and security education centers to operate in accordance with regulations and achieve practical effectiveness.

3. The Troop Mobilization Bureau

a) Take the lead and coordinate with the Militia Self-Defense Forces Bureau, the Cadre Bureau, and related functional agencies to advise the Chief of the General Staff Department and the Ministry of National Defense on decisions regarding the organization, positions, and staffing of officers for the National Defense and Security Education Council's Standing Office as prescribed in Clause 2 of Article 7 of Decree No. 116/2007/ND-CP, Clause 6 of Article 1 and Clause 6 of Article 3 of Decision No. 1404/2007/QD-TTg; organize the staffing of officers assigned to manage and teach national defense education as prescribed in Clause 3 and Clause 5 of Article 8 of Decree No. 116/2007/ND-CP;

b) Direct and guide military regions to ensure firearms and ammunition for training as prescribed in Clause 1 of Article 11 of Decree No. 116/2007/ND-CP.

4. The Operations Bureau

Coordinate with relevant agencies and units to direct the protection of military secrets in national defense and security education work; plan and strictly manage the activities of sports clubs for vocational national defense and military technical training.

5. The Training Bureau

Coordinate with relevant agencies to guide standards, specifications for learning tools, drill grounds, fields, and training sites for tactical and command procedures suitable for the National Defense and Security Education Program for subjects within the national education system to provide the Ministry of Education and Training with a basis to guide schools under its jurisdiction and national defense and security education centers to implement.

Article 3. General Political Department

Direct party and political work activities to strengthen the leadership of party committees at all levels over national defense and security education work. Collaborate with the General Staff Department to assist the Ministry of National Defense in coordinating with related agencies under ministries, departments, and commissions to organize and implement national defense and security education tasks for the subjects specified in Articles 4 and 5 of Decree No. 116/2007/ND-CP.

1. The Propaganda Bureau

Is the advisory body and permanent office assisting the head of the Political Bureau in coordinating with functional agencies to carry out national defense and security education work. Specifically:

a) Lead and coordinate with functional agencies under the Ministry of National Defense to direct units to implement political and ideological education, raise awareness and responsibility among military personnel and militia self-defense forces and reserve mobilization forces regarding comprehensive national defense and specifically national defense and security education; advise, direct, and guide the implementation of commendation and reward work in carrying out national defense and security education tasks.

b) Direct subordinate agencies to promote through various propaganda and mobilization activities to raise public awareness and knowledge of national defense and security, focusing on civil servants, students, and trainees; coordinate with related agencies to propose content, forms, and models of political and ideological work for subjects studying and enhancing national defense and security knowledge at national defense and security education centers, county-level political training centers, provincial military schools, military region schools, and the National Defense Academy.

c) Participate in developing curricula, reviewing, and approving textbooks and teaching materials for national defense and security education, including contents related to the Party and State's viewpoints and policies on national defense and military affairs.

d) Chair and coordinate with functional agencies of the Ministry of National Defense, the Central Organization Board, the Ministry of Interior, the Ministry of Public Security, the Ministry of Education and Training to assist the head of the Political Bureau in establishing knowledge standards on national defense and security corresponding to the positions of cadres holding leadership and management positions at all levels and sectors.

2. The Cadre Department

Coordinate with relevant functional agencies to organize, define titles, rank ceilings, ensure quality and quantity of staff for the standing office assisting the council on national defense and security at all levels, and the cadre contingent assigned to work in some key provinces and centrally governed cities as prescribed in Clause 2, Article 7 of Decree No. 116/2007/NĐ-CP.

3. The Organization Department

Assist the Political Bureau, the Ministry of National Defense in coordinating with functional agencies inside and outside the military to study organizational models and Party activity systems for the cadre contingent assigned to work in ministries, universities, colleges, and national defense education centers.

4. The Policy Department

Assist the Political Bureau in coordinating with functional agencies inside and outside the military to advise the Ministry of National Defense and the Government on policies and regulations for organizations and individuals involved in national defense and security education.

5. Military news agencies, press, cultural, and artistic units, military museums

Based on tasks assigned by the Political Bureau, coordinate with related agencies to innovate methods, improve the quality of national defense and security education through military museums, information media, and art forms to raise awareness and knowledge of national defense and security among the general public, cadres, civil servants, and young generations within the military and students.

Article 4. The Logistics General Department

1. Direct the Personnel Department to cooperate with the Militia and Self-Defense Forces Department and related agencies to design uniforms for teachers and lecturers teaching the National Defense and Security Education course (non-active military personnel) and students when implementing the National Defense and Security Education Program for the Ministry of Education and Training to guide national defense and security education centers and schools under the national education system to purchase according to regulations.

2. Ensure logistics support for sports clubs oriented towards national defense and military technology, and national defense and security education centers managed by the Ministry of National Defense.

Article 5. The Technical General Department

1. Direct research and improvement, production of weapons, models, training aids, and simulation equipment to serve national defense and security education work according to the plan of the Ministry. Direct subordinate technical agencies to ensure the quality of training weapons for educational and training institutions in the area.

2. Ensure technical work for sports clubs oriented towards national defense and military technology, and national defense and security education centers managed by the Ministry of National Defense.

Article 6. Departments directly under the Ministry of National Defense

1. The Planning and Investment Department

a) Together with the Militia and Self-Defense Forces Department and related agencies, advise the Minister of National Defense on overall planning, long-term and short-term investment plans, upgrading national defense and security education centers, sports clubs oriented towards national defense and military technology, and investment projects in the field of national defense and security education managed by the Ministry of National Defense.

b) Together with the Militia and Self-Defense Forces Department, coordinate with the National Defense Education Department and related agencies under the Ministry of Education and Training in formulating overall planning, long-term and short-term investment plans, managing investment projects for upgrading and building new national defense and security education centers and other investment projects in the field of national defense and security education managed by the Ministry of Education and Training.

2. The Finance Department

Based on the tasks of national defense and security education of agencies and units, activities of the National Defense and Security Education Council at all levels, and budget expenditure tasks for national defense and security education stipulated in Articles 9 and 10 of Decree No. 116/2007/NĐ-CP guiding the preparation of budgets for national defense and security education work; examine and consolidate the budget for national defense and security education work, submit to the Ministry for approval. Organize assurance, inspection of the budget expenditure process, and settlement of national defense and security education funds in accordance with current regulations.

Article 7. Academies and Officer Schools in the Military

1. National Defense Academy

a) Coordinate with functional agencies of the Ministry of National Defense, the Central Organization Board, the Ministry of Public Security, and the Permanent Office of the Central National Defense and Security Education Council to develop programs, compile textbooks and materials, and organize the implementation of national defense and security knowledge training for target group 1 as specified in Point a, Clause 1, Article 5 of Decree No. 116/2007/NĐ-CP according to the plan of the Ministry of National Defense, the Central Organization Board, and the Ministry of Public Security.

b) Appoint lecturers to teach the National Defense and Security Education course under the joint training contract of the Ho Chi Minh National Political Academy - Administrative; participate in building programs, compiling textbooks and materials for national defense and security education for various target groups; assist other academies and universities teaching the National Defense and Security Education course; train and conduct refresher courses for lecturers and managers of national defense and security education work as assigned by the Ministry.

c) Participate in scientific research on national defense and security education work within the scope of the Academy's responsibility and general activities of nationwide national defense and security education work to serve the programs and projects of the Central National Defense and Security Education Council and the Ministry of National Defense.

2. Political-Military Academy

Participate in compiling textbooks and materials for national defense and security education; conduct scientific research on national defense and security education within the scope of the Academy's responsibility; train, enhance, and conduct refresher courses for lecturers, teachers, and managers of national defense and security education as assigned by the Ministry of National Defense; provide national defense and security knowledge training for target groups who are departments, bureaus, institutes, and equivalent units under central ministries, sectors, mass organizations, and Group 91; issue certificates for these target groups as assigned by the Ministry of National Defense. Appoint lecturers to teach the National Defense and Security Education course under the joint training contract of affiliated academies of the Ho Chi Minh National Political Academy - Administrative in the Northern region in Hanoi City, the Central region in Da Nang City, the Central Women's School, and the Central Youth and Children's Academy; assist schools in the national education system to teach the National Defense and Security Education course.

3. Army Academy

Participate in compiling textbooks and materials for national defense and security education; conduct scientific research on national defense and security education within the scope of the Academy's responsibility; train, enhance, and conduct refresher courses for lecturers, teachers, and managers of national defense and security education as assigned by the Ministry of National Defense. Appoint teachers to teach the National Defense and Security Education course under the joint training contract of affiliated academies of the Ho Chi Minh National Political Academy - Administrative in the Southern region in Ho Chi Minh City; assist schools in the national education system to teach the National Defense and Security Education course.

4. First and Second Military Officer Schools and academies and schools under military branches and arms

Participate in compiling textbooks and materials for national defense and security education; train, enhance, and conduct refresher courses for teachers and managers of national defense and security education according to the plan of the Ministry of National Defense; appoint teachers to help schools in the national education system teach the National Defense and Security Education course according to the contract plan of each school in their respective regions.

Article 8. Military Regions

Direct the Civil Defense Department and subordinate agencies to perform national defense and security education tasks; coordinate with educational management and training agencies and related agencies at the local level to implement national defense and security education for target groups as specified in Articles 4 and 5 of Decree No. 116/2007/NĐ-CP; enhance and conduct refresher courses for teachers and full-time and part-time specialized staff in national defense and security education for provincial political schools, county-level political training centers, secondary schools, vocational colleges, and vocational training centers; coordinate with the Civil Defense Bureau, the Training Department, and related agencies to survey and build proposals for national defense and security education centers in military schools of the Military Region and provincial military schools according to the planning and proposals of the Ministry of National Defense. Specifically:

1. Organize classes to enhance national defense and security knowledge for target group 2 as specified in Point a, Clause 1, Article 5 of Decree No. 116/2007/NĐ-CP. Direct the provincial military command to coordinate with functional agencies of the Provincial Party Committee, People's Committee, and centrally governed cities to develop plans and organize national defense and security knowledge enhancement for target group 3 as specified in Point a, Clause 1, Article 5 of Decree No. 116/2007/NĐ-CP and assist provincial political schools in implementing the National Defense and Security Education course program.

2. Coordinate with functional agencies of the education and training sector to assist the Ministry of National Defense in supervising and directing national defense and security education centers in their areas to operate according to regulations; enhance and conduct refresher courses for teachers and full-time and part-time specialized staff in national defense and security education for provincial political schools and schools in the national education system; manage the cadre of officers seconded to universities, colleges, and national defense and security education centers in their areas.

3. Direct the provincial and district-level military commands and subordinate units to ensure firearms and ammunition for testing for educational and training institutions in their areas; assist educational and training institutions in their areas with teachers, training grounds, and facilities according to the capacity of each unit.

4. Regularly improve the National Defense and Security Education Council of the Military Region and its operational regulations; assign one Deputy Commander of the Military Region to be the Deputy Head of the Permanent Council of the National Defense and Security Education Council of the Military Region.

5. The Civil Defense Office of the Military Region, the Provincial Civil Defense Board, and the Military Command Board at the district level are the permanent bodies of the National Defense and Security Education Councils at the same level, with the responsibility to comprehensively compile information on national defense and security education work within their jurisdiction; assist leaders, commanders, and the National Defense and Security Education Councils at each level to organize, coordinate, and cooperate with relevant functional agencies to implement national defense and security education tasks; urge, inspect, and supervise agencies, organizations, and localities under their authority in the implementation of national defense and security education tasks.

Article 9. Air Defense - Air Force Corps, Navy, Border Guard Forces, and other arms services

1. Based on the requirements and needs for building reserve forces, selecting talents, and popularizing military knowledge among corps and arms services for target groups, primarily the youth, to organize the establishment of national defense vocational sports clubs and military technical clubs, serving as the core for national defense sports movements, supporting domestic political missions and international competitions. Coordinate with the Civil Defense Department and relevant agencies of the Ministry of National Defense to develop proposals for establishing and investment projects for national defense vocational sports clubs and military technical clubs to be submitted to competent authorities for decision-making. Manage and direct the effective, safe operation of these clubs, suitable to each type of club, while maintaining military and national defense secrecy.

2. Direct subordinate units stationed in the area to participate in national defense and security education work for students; provide assistance in terms of teachers, weapons, training grounds, and facilities according to the capacity of each unit; participate in national defense and security educational activities in the locality.

3. The Local Military Affairs Office under the Navy Corps and the National Defense Education Board under the Air Defense - Air Force Corps shall have the responsibility to advise and assist the Corps Commander in implementing national defense and security education tasks.

4. Direct subordinate units to educate the people, students, and trainees in the area about territorial sovereignty and the responsibility to protect territorial sovereignty along land borders, airspace, seas, and islands of Vietnam.

Article 10. Military Command Board of central agencies and organizations

Advise the Party Committee, heads of agencies and organizations to coordinate with the National Defense Academy, Military Region Commands, Corps Commands, People's Committees of provinces and centrally-administered cities (where the agencies and organizations are located within the military region or locality) to implement national defense and security education tasks for cadres, party members, and employees in agencies and organizations in accordance with Article 5 of Decree No. 116/2007/NĐ-CP. Specifically:

1. Strictly manage the subjects receiving national defense and security knowledge enhancement within agencies and organizations. Annually report to the Central Steering Committee for National Defense and Security Education on the number of cadres, party members, civil servants belonging to categories 1, 2, 3, 4, and 5 who have been enhanced and those who have not received national defense and security knowledge; report plans to send category 2 cadres to receive national defense and security knowledge enhancement at military schools in military regions, category 3 at provincial military schools, and category 4 at county-level political training centers.

2. Organize national defense and security knowledge enhancement for category 5 subjects within agencies and organizations. Coordinate with relevant agencies of the Ministry of National Defense and localities to organize national defense and security knowledge enhancement for categories 3 and 4 within agencies and organizations (in cases where provincial military schools and county-level political training centers are overloaded).

3. Propose to the head or deputy head to participate in lecturing on specialized topics within the management field of the agency or organization for categories 1 and 2 as stipulated in Point a Clause 1 Article 5 of Decree No. 116/2007/NĐ-CP upon request from the National Defense Academy and the Military Region National Defense and Security Education Council.

4. Coordinate with the Ministry of National Defense agency annually to inspect, check, review, and summarize the implementation of national defense and security education and knowledge enhancement tasks; periodically every six months and annually to compile and report the results of the implementation of national defense and security education and knowledge enhancement tasks of the agency or organization to the Central Steering Committee for National Defense and Security Education.

Article 11. Agencies, units, schools, research institutes not covered by Articles 1 to 9 of this Decision

Direct subordinate agencies and units to implement national defense and security education work according to the requirements of the Ministry of National Defense; coordinate with local military agencies to assist educational institutions in providing teachers, training weapons, training grounds, and facilities according to the conditions and capabilities of the unit to help educational institutions implement the National Defense and Security Education subject.

Article 12. Funding to ensure the implementation of national defense and security education tasks

Each year, agencies and units base their budget planning for national defense and security education within their total budget estimates on the national defense and security education tasks assigned by the Ministry of National Defense and the budget allocation for national defense and security education as stipulated in Articles 9 and 10 of Decree No. 116/2007/NĐ-CP, to be submitted to competent authorities for approval.

Article 13. This Decision takes effect 15 days after its publication in the Official Gazette. This Decision replaces Decision No. 59/2002/QĐ-BQP dated April 23, 2002, issued by the Minister of National Defense regarding the Tasks of Military Units for National Defense Education Work, and Decision No. 3069/2001/QĐ-BQP dated November 21, 2001, issued by the Minister of National Defense regarding the Organization of the Permanent Body Assisting the Central Steering Committee for National Defense Education.

Article 14. Heads of agencies and units shall implement the tasks assigned in this Decision; monthly, quarterly, and annually report the results to the Ministry of National Defense (through the Civil Defense Department / General Staff) for compilation and reporting to the Central Steering Committee for National Defense and Security Education as prescribed./.
