Article 24Issuing regulations on the standard fees for storing national food reserves, materials, and equipment directly managed by the State Reserve General Department of the Ministry of Finance

Pursuant to the Law on Technical Standards and Regulations No. 68/2006/QH11 dated June 29, 2006 of the National Assembly of the Socialist Republic of Vietnam;
Pursuant to the National Reserve Ordinance No. 17/2004/PL-UBTVQH11 dated April 29, 2004 of the Standing Committee of the National Assembly;
Pursuant to the Government Decree No. 196/2004/NĐ-CP dated December 2, 2004 detailing the implementation of the National Reserve Ordinance;
/Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
The Ministry of Finance hereby stipulates the storage standards for national food reserves, materials, and equipment directly managed by the State Reserve General Department as follows:
Article 1. Scope of Regulation
1. This Circular stipulates the following standards:
a) Standard fee for storing national food reserves (rice, paddy) kept in state reserve warehouses directly managed by the State Reserve General Department (as set out in Appendix I attached hereto).
b) Standard fee for storing national reserve materials and equipment kept in state reserve warehouses directly managed by the State Reserve General Department (as set out in Appendix II attached hereto).
2. Loss standard for national reserves regarding sealed rice storage (supplemented with CO2, N2, anaerobic conditions):
a) Storage period under 12 months: 0.050%.
b) Storage period from 12 to 18 months: 0.058%.
c) Storage period over 18 months: 0.066%.
3. Loss standard for national reserves regarding ventilated paddy storage shall be implemented according to Decision No. 03/2007/QD-BTC dated January 8, 2007 of the Ministry of Finance on issuing loss standards for paddy stored in national reserves directly managed by the National Reserve Administration (now the State Reserve General Department). The loss standard for paddy stored in low-pressure conditions shall be implemented according to Circular No. 207/2010/TT-BTC dated December 15, 2010 on issuing loss standards for paddy stored in low-pressure conditions directly managed by the State Reserve General Department.
Article 2. Use and adjustment of storage standards
1. The storage fee standards specified in Appendices I and II issued together with this Circular and the loss standard for national reserves regarding sealed rice storage as stipulated in Clause 2, Article 1 of this Circular shall serve as the basis for building and implementing plans for storing national food reserves, materials, and equipment from the 2012 fiscal year. From 2013 to 2014, if the average price increase index reaches 5% or more, the storage fee standard for the planned year will be adjusted accordingly based on the average price increase index of products, goods, and services published by the General Statistics Office.
2. The Director of the State Reserve General Department shall base on the storage standards stipulated in this Circular and the provisions of Decision No. 21/2006/QD-BTC dated April 3, 2006 of the Minister of Finance on issuing the regulation on building, issuing, and managing storage standards for national reserve goods to guide and organize implementation, but not exceeding the prescribed standards.
Article 3. Implementation Organization
1. This Circular takes effect from February 2, 2012, and replaces Decision No. 86/2008/QD-BTC dated October 20, 2008 on issuing storage standards for low-pressure paddy storage directly managed by the National Reserve Administration, Circular No. 08/2011/TT-BTC dated January 14, 2011 amending and supplementing Decision No. 86/2008/QD-BTC, and Circular No. 107/2009/TT-BTC dated May 26, 2009 of the Minister of Finance on issuing storage standards for national reserve goods directly managed by the National Reserve Administration.
2. Heads of units related to the management of national reserve goods are responsible for organizing implementation./.
