Regarding the List of State Secrets of Confidential Level for the Government and the Government Office

THE MINISTER OF PUBLIC SECURITY

Pursuant to the Ordinance on Protection of State Secrets dated December 28, 2000;

Pursuant to the Decree No. 136/2003/NĐ-CP dated November 11, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Pursuant to the Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Ordinance on Protection of State Secrets;

Considering the proposal of the Minister, Head of the Government Office,

DECISION:

Article 1. The List of State Secrets of Confidential Level for the Government and the Government Office includes:

1. Information and documents related to the activities of the Government, directives from the Prime Minister regarding national security work, plans, finance, prices, national reserves (not within the scope of Top Secret and Absolute Secret) that have not been or will not be published;

2. Design documents for construction areas of the Government and the Government Office; documents on protection and fire prevention plans at these areas;

3. Information and documents related to the program of work of the Government, the Prime Minister, and Deputy Prime Ministers; schedules of domestic and foreign trips of the Prime Minister and Deputy Prime Ministers that have not been or will not be published;

4. Handwritten comments on instructions and resolutions for handling work by the Prime Minister and Deputy Prime Ministers noted on submission forms, letters, and documents (excluding information classified as Absolute Secret and Top Secret) that have not been or will not be published;

Handwritten comments by the Minister, Head of the Government Office, and Deputy Heads of the Government Office proposing suggestions and recommendations about the organization and management of Government work and daily document processing at the Government Office according to their functions and responsibilities that have not been or will not be published;

5. Regular reports on the activities of the Government and the Prime Minister using information and documents classified as state secrets;

6. Personnel files under the management of the Government; files of officers from specialist level upwards in the Government Office; personnel files of civil servants in the security, service, and technical positions at the Government and Government Office working areas; files of receptionists, security guards, service staff, and technicians in units subordinate to the Government Office;

7. Files and documents during ongoing inspections and audits; reports on the results of internal inspections and audits of the Government Office that have not been published;

8. Statistical and accounting figures, income and expenditure of the Government Office that have not been authorized to publish;

9. Design documents for computer networks, special-purpose software programs, and protective software of the Government and the Government Office. Prescribed codes and passwords for ensuring the security and safety of national databases, computer networks, and personal computers containing internal data;

10. Reports and other documents using information and documents listed in the List of State Secrets of Confidential Level of other agencies.

Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette and replace Decision No. 650/2004/QĐ-BCA(A11) dated July 9, 2004 of the Minister of Public Security on the List of State Secrets of Confidential Level for the Government and the Government Office. Competent agencies of the Government Office and the Ministry of Public Security are responsible for implementing this Decision.

Article 3. The Minister, Heads of Ministries equivalent to Ministries, Heads of agencies under the Government; Heads of agencies and organizations mentioned in Article 2 of the Ordinance on Protection of State Secrets dated December 28, 2000 and Chairpersons of People's Committees of provinces and centrally-administered cities are responsible for implementing this Decision./.
