DECISION

On the List of State Secrets of Vietnam News Agency at Confidential Level

THE MINISTER OF PUBLIC SECURITY

Pursuant to the Law on Protection of State Secrets dated December 28, 2000;

Pursuant to Decree No. 136/2003/NĐ-CP dated November 14, 2003 of the Government stipulating the functions, tasks, powers and organizational structure of the Ministry of Public Security;

Pursuant to Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Law on Protection of State Secrets;

After consultation with the General Director of Vietnam News Agency,

DECIDES:

Article 1. The List of State Secrets at Confidential Level of Vietnam News Agency includes information within the following scope:

1. Contents of negotiations and signed documents with foreign countries regarding cooperation in investment, development of science, technology, modern equipment for Vietnam News Agency involving third parties as per agreements not yet published or to be unpublished;

2. Information and materials related to internal politics, national defense, security, diplomacy obtained by Vietnam News Agency that have not been published or are to remain unpublished;

3. Information and materials collected by staff of Vietnam News Agency when attending Party, State, Ministry, sector meetings at various levels that have not been published or are to remain unpublished;

4. Information and materials obtained by Vietnam News Agency with significant content related to national security and state secrets sent to leaders at the ministry, sector, local level (excluding those classified as Top Secret or Very Confidential);

5. Historical, security, defense-related photographic documents of Vietnam News Agency involving Party, State, National Assembly, Ministries, sectors, organizations, incidents that have not been published or are to remain unpublished;

6. Annual plans for changing foreign correspondents approved but not yet published;

7. Information and materials including complaints and reports related to national security submitted to Vietnam News Agency;

8. Personnel files; annual training, cadre planning documents; cadre promotion files; personnel transfer decisions of the sector that have not been published;

9. Inspection and investigation documents during verification or conclusion stages but not yet published;

10. Design documents for computer systems in the sector; internal databases managed within computer networks, personal computers, passwords, security protocols regarding information technology application of the sector;

11. Diagrams of technical security and safety systems for offices and units of Vietnam News Agency. Diagrams of fire protection equipment installation at key locations within Vietnam News Agency offices.

Article 2. This Decision shall take effect fifteen days after its publication in the Official Gazette and shall replace Decision No. 82/2004/QĐ-BCA dated February 2, 2004 of the Minister of Public Security on the List of State Secrets of Confidential Level for Vietnam News Agency; competent agencies of Vietnam News Agency and the Ministry of Public Security are responsible for guiding and supervising the implementation of this Decision.

Article 3. Ministries, ministerial-level agencies, and government agencies; agencies and organizations mentioned in Article 2 of the Ordinance on Protection of State Secrets dated December 28, 2000, and People's Committees of provinces and centrally-run cities are responsible for implementing this Decision./.
