PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Post and Telecommunications Ordinance dated May 25, 2002;
Pursuant to Decree No. 160/2004/NĐ-CP dated September 3, 2004 of the Government detailing the implementation of certain provisions of the Post and Telecommunications Ordinance;
Pursuant to Decision No. 74/2006/QĐ-TTg dated April 7, 2006 of the Prime Minister approving the Program for Providing Universal Telecommunication Services until 2010;
Upon the proposal of the Minister of Finance and the Minister of Information and Communications,
DECISION:
Article 1Amend Clause 2, Article 6 of Decision No. 191/2004/QĐ-TTg dated November 8, 2004 of the Prime Minister on the establishment, organization and operations of the Vietnam Universal Service Fund as follows:
"2. Contributions from telecommunications enterprises
a) All telecommunications enterprises operating in Vietnam must fulfill their obligation to provide universal telecommunication services through financial contributions to the Fund. The contributions of telecommunications enterprises to the Fund starting from the fiscal year 2007 shall be calculated based on revenue from service provision to customers (excluding interconnection charges), including:
- Mobile telecommunications services, the contribution rate is 3% of revenue;
- International long-distance telephone services, international leased-line services, the contribution rate is 2% of revenue;
- Domestic long-distance telephone services between provinces, domestic leased-line services, the contribution rate is 1% of revenue.
b) The contributions of telecommunications enterprises specified in Point a, Clause 2 of this Article to the Fund are actual expenditures for fulfilling the obligation to provide universal telecommunication services and are recorded as business expenses.
c) Telecommunications enterprises must separately record revenue from services subject to contributions to the Fund and timely comply with reporting and payment procedures for such contributions according to the guidelines of the Ministry of Finance and the Ministry of Information and Communications.
d) Any adjustments or supplements to the obligations of telecommunications enterprises to contribute to the Fund shall be proposed by the Minister of Information and Communications to the Prime Minister for decision after consulting the Minister of Finance and relevant agencies."
Article 2This Decision takes effect fifteen days after its publication in the Official Gazette.
Article 3The Minister of Information and Communications; the Minister of Finance, the Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, and Chairpersons of provincial People's Committees directly under the Central Government are responsible for implementing this Decision./.
