Issuing the Environmental Protection Action Program

of the People's Public Security for the period 2006-2010

Pursuant to Decree No. 136/2003/ND-CP dated November 14, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Pursuant to Resolution No. 41/NQ-TW dated November 15, 2004 of the Political Bureau on environmental protection during the period of accelerating industrialization and modernization of the country;

Pursuant to the Government's Action Program implementing Resolution No. 41/NQ-TW of the Political Bureau issued together with Decision No. 34/2005/QD-TTg dated February 22, 2005 of the Prime Minister;

Pursuant to Directive No. 04/2000/CT-BCA (E11) dated November 22, 2000 of the Minister of Public Security on "strengthening the implementation of environmental protection tasks and combating environmental crimes";

At the proposal of the General Director of the Technical General Department,

 

DECISION:

Article 1. Issued together with this Decision The Environmental Protection Action Program of the People's Public Security for the period 2006-2010.

Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 3. The General Directors, Heads of units under the Ministry, Provincial Police Chiefs, Chief of Police of centrally governed cities shall be responsible for implementing this Decision./.

ENVIRONMENTAL PROTECTION ACTION PROGRAM

 

OF THE PEOPLE'S PUBLIC SECURITY FOR THE PERIOD 2006-2010

(Issued together with Decision No. 1869/2005/QD-BCA(E11) dated December 19, 2005

of the Minister of Public Security)

I. OBJECTIVES

Implementing Resolution No. 41/NQ-TW dated November 15, 2004 of the Political Bureau and the Government's Action Program on environmental protection (EP) during the period of accelerating industrialization and modernization of the country, the Ministry of Public Security has developed the EP Action Program for the period 2006-2010 with the following objectives:

1. Effectively combat various types of environmental crimes and violations of EP laws.

2. Monitor global and regional environmental security situations affecting domestic environmental security to timely propose effective solutions for combating environmental crimes, contributing to national security (NS) and maintaining public order and safety (PO&S). 3. Implement measures to manage, research, and apply science and technology to prevent, limit, and mitigate pollution, degradation, and environmental incidents within premises and areas under the jurisdiction of the People's Public Security (PPS).

II. TASKS

1. Propagate and educate to raise awareness and sense of responsibility among PPS officers and the community regarding EP and combating environmental crimes and violations of EP laws.

a) Organize training, propaganda, dissemination, and education on knowledge and laws related to EP to enhance the sense of responsibility of PPS officers in EP work and combating environmental crimes and violations of EP laws.

b) Propagate and mobilize the people to participate in EP and combating environmental crimes and violations of EP laws through mass movements for national security and through mass media.

Strengthen capacity and effectively implement the task of combating environmental crimes and violations of EP laws.

2. a) Develop normative legal documents in the field of combating environmental crimes and violations of EP laws.

b) Establish mechanisms for management and coordination among forces within the PPS to implement the task of combating environmental crimes and violations of EP laws.

c) Develop a proposal to establish an Environmental Police force.

d) Train and equip knowledge and laws related to EP for specialized forces.

đ) Collect information on the situation and trends of global and regional environmental security affecting domestic environmental security; the plots and activities of foreign hostile organizations and forces attempting to destroy our environment to promptly handle, recommend, and propose solutions to ensure environmental security, contributing to NS and maintaining PO&S.

e) Invest in equipment to serve the task of combating environmental crimes and violations of EP laws. Strengthen capacity and effectively implement EP tasks within the PPS. a) Improve organizational structures, train cadres, and invest in equipment to serve environmental management tasks.

b) Promote state management activities on EP within the PPS: organizing the development and implementation of programs, plans, projects, and proposals; developing normative legal documents in the field of environmental management; conducting surveys, assessments, building databases, and preparing current status reports on the environment; guiding and reviewing environmental impact assessment reports; organizing inspections and checks on the implementation of EP laws at facilities within the PPS.

3. 4. Promote research, application, and transfer of science and technology (ST&T) to serve the task of combating environmental crimes and violations of EP laws, preventing, handling, and mitigating the consequences of natural disasters, pollution, and environmental incidents.

a) Promote research, application, and transfer of environmental ST&T; improve the qualifications of cadres and the capabilities of the Environmental Analysis Laboratory of the Ministry of Public Security. b) Invest in equipment, organize training, and drills to enhance the ability to prevent, handle, and mitigate the consequences of natural disasters and environmental incidents.

c) Prevent and handle pollution sources at concentrated facilities: headquarters, schools, hospitals, prisons, detention centers, production facilities, etc., within the PPS. d) Handle weapons, equipment, and evidence that have exceeded their service life and affect the environment. Strengthen cooperation with domestic and international organizations

to study, learn, and exchange experiences in the field of combating environmental crimes and violations of EP laws and in the field of environmental management, researching, and applying ST&T in handling pollution and mitigating environmental incidents.

a) Develop mechanisms and policies, establish relationships, and strengthen cooperation between the police force and relevant agencies and forces in implementing state management tasks on EP and combating environmental crimes and violations of EP laws. b) Strengthen cooperation with countries and international organizations, especially INTERPOL, ASEANAPOL, etc., in the field of transnational and international environmental crime prevention and suppression.

b) Invest in equipment, organize training, and conduct drills to enhance capabilities in preventing, combating, and mitigating the consequences of natural disasters and environmental incidents.

c) Prevent and handle pollution sources at concentrated facilities with large populations such as headquarters, schools, hospitals, prisons, detention centers, production facilities, etc., within the Public Security Force.

d) Dispose of weapons and operational means that have exceeded their service life, and evidence and specimens from cases affecting the environment. b) Invest in equipment, organize training, and drills to enhance the ability to prevent, handle, and mitigate the consequences of natural disasters and environmental incidents.

5. Strengthen cooperative relationships with domestic and international organizations to study, learn, and exchange experiences in the field of crime prevention and combat, violations of environmental protection laws, and in environmental management areas, researching and applying science and technology in pollution treatment and environmental incident response. violate environmental protection laws and in the field of environmental management, research and application of science and technology in pollution treatment and emergency response. environmental emergencies.

III. IMPLEMENTATION

1. The General Department VI shall be responsible for organizing the implementation of state management work on environmental protection in the Public Security Force and organizing research, application of environmental science and technology, forensic examination of crimes, and violations of laws on environmental protection: 2. a) Take the lead and coordinate with V19 and competent agencies under the Ministry of Natural Resources and Environment to organize the drafting and submission for approval by the Minister of normative legal documents on environmental protection in the Public Security Force.

b) Take the lead and coordinate with public security units and localities to build and implement programs, plans, projects, and proposals on environmental protection in the Public Security Force.

c) Take the lead and coordinate with General Department III, V19 to organize propaganda, education to raise awareness about environmental protection, and training of managers and environmental science and technology officers in the Public Security Force.

d) Take the lead and coordinate with scientific and technological agencies, relevant units, and localities to conduct investigations, surveys, evaluations, establish databases, and prepare reports on the current environmental status in the Public Security Force.

đ) Take the lead in organizing the review and approval of environmental impact assessment reports for investment projects and operating facilities in the Public Security Force; Review environmental protection fees for facilities in the Public Security Force according to the provisions of the law.

e) Take the lead and coordinate with V24, V19 to organize inspections and checks on the implementation of legal regulations on environmental protection at facilities in the Public Security Force.

g) Take the lead in organizing research, application, and transfer of environmental science and technology, building an environmental analysis laboratory to serve the struggle against crime and violations of laws on environmental protection, and in preventing, handling, and mitigating the consequences of natural disasters, accidents, and environmental pollution. 2. General Departments I, II, and V shall be responsible for organizing the work of combating crime and violations of laws on environmental protection.

3. Organize the work of combating crime and violations of laws on environmental protection. a) General Departments I, II, and V, based on their assigned functions and tasks, shall coordinate with General Department VI, V19, the Ministry of Natural Resources and Environment, and related agencies to draft normative legal documents in the field of combating crime and violations of laws on environmental protection.

b) General Departments I, II, and V, based on their assigned functions and tasks, shall coordinate with General Department VI, V19 to organize training, equip knowledge and laws on environmental protection for specialized forces directly involved in combating environmental crime.

c) General Departments I and II shall be responsible for assigning specific tasks to specialized forces under their departments to cooperate with functional agencies such as Environmental Inspectors, Customs, Forest Rangers, Fisheries Protection, etc., to intensify the work of detecting, investigating, and handling crimes and violations of laws on environmental protection.

d) General Department V shall be responsible for collecting information and materials to monitor global and regional environmental security trends affecting domestic environmental security and the plots and activities of foreign hostile organizations and forces that aim to destroy our environment, to promptly address, propose solutions, and combat them.

đ) General Department II shall take the lead and coordinate with General Departments III, VI, V11, V19, the Ministry of Natural Resources and Environment, and the Ministry of Home Affairs to study and propose plans for establishing an Environmental Police force.

e) General Department II shall take the lead and coordinate with General Departments IV, VI, public security units and localities, and related agencies to organize rescue operations and mitigate the consequences of natural disasters and environmental accidents when requested by the State and local authorities.

g) General Department II (INTERPOL Office) shall take the lead and coordinate with V12, V19, and General Departments I, II, VI to organize research, learning, exchange of experiences, and cooperation with other countries in the work of combating transnational and international environmental crime.

3. General Department III shall be responsible for:

a) Taking the lead and coordinating with General Department VI, V19, and public security units and localities to intensify propaganda work on environmental protection through mass media, through the Patriotic Civil Defense Movement to mobilize the people's active participation in environmental protection and assist public security forces in detecting, investigating, and handling crimes and violations of laws on environmental protection.

b) Taking the lead and coordinating with General Department VI to organize the implementation of the project to include environmental protection content in the curriculum of public security schools.

c) Taking the lead and coordinating with General Department VI and relevant units and localities within the sector to implement the project on state management of environmental protection in the public security force. In the short term, allocate staff positions for environmental management officers at public security units and localities.

4. General Department IV shall be responsible for:

a) Taking the lead and coordinating with General Department VI, V19 to draft and submit to the Minister for issuance of normative legal documents and organize the implementation of programs, projects, and plans on flood prevention and control, "Clean Water and Sanitation," in the sector.

b) Taking the lead and coordinating with General Department VI to study and invest in equipment to serve environmental management work, combating crime, and violations of laws on environmental protection, and preventing, handling, and mitigating the consequences of natural disasters, accidents, and environmental pollution for public security units and localities.

5. V21 shall be responsible for taking the lead and coordinating with General Departments I, II, V, VI, V19, and the Ministry of Natural Resources and Environment to organize research on the impact of environmental security on national security and social order and safety, to assist the Ministry of Public Security in advising the Party and State on proactive measures to effectively prevent and combat such issues.

6. V26 shall be responsible for coordinating with General Department VI to draft and implement programs, plans, and projects on environmental protection at facilities under its jurisdiction. 7. V22 shall be responsible for taking the lead and coordinating with General Department VI and public security units and localities to develop plans to ensure funding for environmental protection work in the Public Security Force, researching the establishment of a Public Security Environmental Protection Fund for reinvestment in environmental protection work.

8. Leaders responsible for investment projects, enterprises, scientific research institutions, medical facilities, etc., in the Public Security Force must strictly comply with the requirement to prepare environmental impact assessment reports in accordance with the provisions of the law. 9. Public security units and localities shall be responsible for implementing environmental protection work and combating crime and violations of laws on environmental protection within their jurisdiction, in accordance with their functions, tasks, and directives from the Minister; Develop and implement environmental protection plans for the period 2006-2010 for their units and localities.

7. V22 is responsible to take the lead and coordinate with the General Department VI, local public security units to develop plans to ensure funding for environmental protection activities of the Public Security Force, and to research the establishment of a Public Security Environmental Protection Fund for reinvestment in environmental protection work.

8. Leaders responsible for investment projects, enterprises, scientific research institutions, healthcare facilities, etc., within the Public Security Force must strictly comply with the legal requirements for preparing environmental impact assessment reports. in accordance with the provisions of the law.

9. Local public security units are responsible for carrying out environmental protection work and crime prevention and combat related to environmental protection laws within their jurisdiction, according to their functions, tasks, and directives from the Minister; Develop and implement environmental protection plans for their units and regions for the period 2006-2010.

Direct the General Department VI to take the lead, coordinate with the Ministry's Office to monitor and compile the situation and results of implementing the Environmental Protection Action Program, and report periodically every six months to the Ministry's leadership./.
