JOINT CIRCULAR
Guidelines on the allowance system for volunteers implementing legal aid

Implementing Decision No. 734/TTg dated September 6, 1997 of the Prime Minister on the establishment of organizations providing legal aid to the poor and policy beneficiaries. The Joint Circular of the Government's Organization and Cadre Department, Ministry of Finance, and Ministry of Justice provides specific guidelines on the allowance system for volunteers implementing legal aid as follows:
I. OBJECTIVE AND SIGNIFICANCE
Legal aid activities are specialized and professional activities aimed at serving political, social, and humanitarian tasks without charging fees, involving voluntary participation from experts, lawyers, and attorneys.
The State has an allowance system for volunteers to compensate for their efforts and enhance their responsibility in legal aid activities.
The State also encourages volunteers to provide legal aid without accepting allowances.
II. APPLICABLE SUBJECTS AND ALLOWANCE LEVELS
1. Volunteers representing and defending before courts shall enjoy the allowance system as stipulated for appointed lawyers under Circular No. 614/TTLN dated July 21, 1995 of the Ministry of Finance, Ministry of Justice, and the Supreme People's Court regarding allowances during court sessions.
2. Volunteers providing legal advice shall be entitled to the following allowance levels:
a. For oral legal consultations and guidance:
- Simple consultations and guidance: VND 5,000/hour.
- Complex consultations and guidance: VND 8,000/hour.
b. For written legal consultations and guidance:
- Simple consultations and guidance: VND 8,000/per document.
- Complex consultations and guidance: VND 15,000/per document.
In addition to the allowance, when implementing mobile legal aid, volunteers shall be reimbursed travel expenses as for civil servants on official business trips.
III. IMPLEMENTATION
Annually, the Legal Aid Bureau and Centers shall prepare budgets for operational expenses including allowance and travel expenses (if applicable) for volunteers to submit to the competent authority for approval according to current regulations.
The use of funds for volunteer allowances shall be settled according to the annual financial expenditure system.
This Circular takes effect fifteen days from the date of issuance.
Any difficulties or issues encountered during implementation should be reported to the relevant ministries for consideration and resolution.
