Regulations on fee quotas for importing and exporting materials and equipment in national reserves at State Reserve warehouses directly managed by the General Department of State Reserves

Pursuant to the Law on Technical Standards and Regulations No. 68/2006/QH11 dated June 29, 2006 of the National Assembly of the Socialist Republic of Vietnam;

Pursuant to the Ordinance on National Reserves No. 17/2004/PL-UBTVQH11 dated April 29, 2004 of the Standing Committee of the National Assembly;

Pursuant to the Government Decree No. 196/2004/NĐ-CP dated December 2, 2004 detailing the implementation of the National Reserve Ordinance;

Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance.

The Ministry of Finance hereby stipulates the fee quotas for importing and exporting materials and equipment in national reserves at State Reserve warehouses directly managed by the General Department of State Reserves as follows:

Article 1. Scope of Regulation

This Circular stipulates the fee quotas for importing and exporting materials and equipment in national reserves at State Reserve warehouses directly managed by the General Department of State Reserves (annexed).

Article 2. Usage and adjustment of import and export quotas

Clause 1. The quotas specified in the list of import and export fee quotas for materials and equipment in national reserves issued together with this Circular shall be used as a basis for building and implementing plans for importing and exporting materials and equipment in national reserves from the 2012 fiscal year. From 2013 to 2014, if the average price increase index reaches 5% or more, the storage fee quota for the planning year will be adjusted accordingly based on the average price increase index of the reporting year for products, goods, and services published by the General Statistics Office.

Clause 2. The Director of the General Department of State Reserves shall base on the lists of import and export fee quotas in this Circular and the provisions in Decision No. 21/2006/QĐ-BTC dated April 3, 2006 of the Minister of Finance on the issuance of regulations on the construction, promulgation, and management of storage fee quotas for national reserve goods to guide and organize implementation, but not exceeding the prescribed quotas.

Article 3. Implementation Organization

Clause 1. This Circular takes effect from February 2, 2012, and replaces Circular No. 99/2009/TT-BTC dated May 20, 2009, on the issuance of import and export fee quotas for materials and equipment in national reserves at State Reserve warehouses.

Clause 2. Heads of units related to the management of national reserve goods are responsible for organizing implementation./.
