DECREE
Regarding the tasks, authorities, and organizational structure of the Investment Development General Department under the Ministry of Finance
THE GOVERNMENT
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to Government Decrees No. 15/CP dated March 2, 1993 on the tasks, authorities, and state management responsibilities of ministries and ministerial-level agencies; No. 177/CP dated October 20, 1994 on promulgating the Regulations on Investment Management and Construction; and No. 178/CP dated October 28, 1994 on the tasks, authorities, and organizational structure of the Ministry of Finance;
promulgates this Decree stipulating the environmental protection fees for mineral exploration and exploitation.
DECREE:
Article 1
The Investment Development General Department is an organization under the Ministry of Finance with the task of assisting the Minister of Finance in performing state financial management functions for development investment, organizing the implementation of budget capital allocation from the State for investment and preferential credit capital from the State for projects, objectives, and programs as determined annually by the Government.
Article 2
The Investment and Development General Department has the following specific tasks and authorities:
1- Assisting the Minister of Finance in performing state financial management functions for development investment:
1. Studying policies and regulations on investment capital management to be issued by the Minister of Finance within their authority or submitted to the Prime Minister for issuance.
2. Participating in opinions with state agencies regarding policies, plans, and long-term and short-term strategies related to state investment.
3. Reviewing from a financial perspective and participating in tender evaluation and selection processes for projects using state investment capital.
4. Announcing the state investment capital plan to investors according to the annual plan approved.
5. Inspecting the use of such capital by investors; recommending necessary policies and measures to improve the efficiency of state investment capital usage to competent authorities.
Requesting investors to provide relevant documentation and explanations concerning the management of investment capital and preferential credit capital from the State.
2- Organizing the implementation of budget capital allocation for investment; granting and recovering preferential credit capital from the State for projects, objectives, and programs as designated annually by the Government;
1. Allocating capital to investors according to the approved investment plan by competent authorities.
2. Granting and recovering preferential credit capital for projects, objectives, and programs as listed by the Government.
3. Having the right to temporarily suspend capital allocation and preferential credit grants when violations of state investment capital management regulations are detected, and reporting immediately to the Minister of Finance for handling.
4. Organizing accounting, statistics, and payment settlement work for capital allocation and recovery of preferential credit capital for investment in accordance with current state regulations; assisting the Minister of Finance in conducting audit and approval of final accounts for investment projects as stipulated in the Government's Investment and Construction Management Regulations.
Article 3
The organizational structure of the Investment Development General Department consists of systems from central to provincial levels.
1- AT At the central level, there is the Investment Development General Department under the Ministry of Finance.
The Investment Development General Department has a Director and Deputy Directors assisting him/her. The Director is appointed (or relieved of duty) by the Prime Minister upon the recommendation of the Minister of Finance, and Deputy Directors are appointed (or relieved of duty) by the Minister of Finance upon the recommendation of the Director of the Investment Development General Department.
The staff supporting the Director includes:
Economic Planning Department,
Investment Capital Allocation Department,
Preferential Investment Credit Department,
Accounting Department,
Inspection-Supervision Department,
Office of the General Department.
The Minister of Finance shall specify the tasks and organizational structures of these units.
2- AT Provinces and centrally-administered cities have Investment Development Departments under the Investment Development General Department. Investment Development Departments at provincial and centrally-administered city levels implement tasks of allocating investment capital and granting preferential investment credit capital in their respective areas.
3- In regions with large volumes of state investment capital or projects belonging to Group A, the Minister of Finance may establish Investment Development Offices or Sub-offices under the Investment Development Departments or General Departments. Investment Development Offices or Sub-offices will be dissolved after project completion.
Article 4
The Investment Development General Department, Investment Development Departments, and Investment Development Sub-offices are state financial management organizations, possessing legal personality, having their own seals, and being able to open accounts at the State Treasury.
Article 5
The staffing of the Investment Development General Department is decided by the Minister of Finance within the total staffing quota of the Ministry of Finance.
The operating expenses of the Investment Development General Department are funded by the state budget and are included in the consolidated budget of the Ministry of Finance.
When implementing preferential credit tasks, the Investment Development General Department can collect fees. Management of such fees is carried out in accordance with government regulations.
Article 6
This Decree takes effect from the date of issuance. Previous provisions in other documents that conflict with this Decree are abolished.
The Minister of Finance, ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, chairpersons of provincial and centrally-administered city People's Committees, and the Director of the Investment Development General Department are responsible for enforcing this Decree./.
