Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Legislative Regulatory Documents dated November 12, 1996, amended and supplemented some articles on December 16, 2002;

Considering the proposals of the Minister of National Defense, the Minister of Labor, War Invalids and Social Affairs, and the Minister of Finance,

DECISION:

Article 1. Amending and supplementing the subjects implementing the regime prescribed in Decision No. 290/2005/QĐ-TTg dated November 8, 2005 of the Government on the regime and policies for certain subjects directly participating in the resistance war against America to save the country but not yet enjoying the policies of the Party and the State (hereinafter referred to as Decision No. 290/2005/QĐ-TTg) as follows:

1. Non-commissioned officers, soldiers of the army and police fighting and operating in the B, C, K battlefields but without kinship required to be directly supported in the North and village (ward) cadres operating in the South who directly participated in the resistance war against America to save the country from July 1954 to April 30, 1975 shall enjoy a one-time benefit regime as stipulated in point b, Clause 1, Article 1 of Decision No. 290/2005/QĐ-TTg.

2. Village and hamlet militia in the South who directly participated in the resistance war against America to save the country from July 1954 to April 30, 1975, who have returned home and currently do not fall under the category of enjoying retirement, invalidity, or monthly labor disability benefits shall enjoy a one-time allowance as stipulated in point c, Clause 1, Article 1 of Decision No. 290/2005/QĐ-TTg.

3. Concentrated people's militia who directly participated in the resistance war against America to save the country belonging to seven border villages north of the Ben Hai River along the 17th parallel (including the communes: Vinh Giang, Vinh Quang, Vinh Thanh, Vinh Lam, Vinh Son, Vinh O, Vinh Ha) and five villages within the demilitarized zone (including the communes: Vinh Tan, Vinh Thach, Vinh Hoa, Vinh Hien, Vinh Thuy) in Vinh Linh district, Quang Tri province, shall be entitled to a one-time allowance regime during the period from July 1954 until their dissolution and return home.

Article 2. The Ministry of National Defense shall take the lead and coordinate with the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Finance to guide the implementation of this Decision.

Article 3. This Decision shall take effect fifteen days after its publication in the Official Gazette.

Article 4. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decision./.
