DECREE
DECREE NO. 188-CP OF DECEMBER 20, 1994ON THE ESTABLISHMENT OF THE NATIONAL DEFENSE ACADEMY
THE GOVERNMENT
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to Decree No. 15-CP dated March 2, 1993 on the tasks, powers, and responsibilities for state management of ministries and ministerial-level agencies;
Considering the proposals of the Minister of National Defense and the Minister of Education and Training;
DECREE:
Article 1. - The National Defense Academy is established based on the Higher Military Academy.
Article 2. -The National Defense Academy, under the Government, is a center for training and developing high-ranking military officers; providing national defense knowledge to high-ranking officials of the Party, State, and mass organizations; conducting military scientific research.
The Government entrusts the Ministry of National Defense with direct management. Relevant state agencies shall participate in building the Academy according to their functions and responsibilities.
The operation of the National Defense Academy shall be governed by its own regulations stipulated by the Prime Minister.
Article 3. - The National Defense Academy has the following tasks:
1. Training and developing high-ranking military commanders, strategic and operational staff; local military affairs; teaching staff; military science researchers; postgraduate and doctoral studies in military science according to the state's degree regulations.
2. Providing national defense knowledge to provincial-level key cadres and equivalent positions, and leaders of central Party, State, and mass organization agencies.
3. Conducting military scientific and art research.
4. International cooperation in training and developing high-ranking military officers.
Article 4. -The organizational structure and training capacity of the National Defense Academy shall be determined by the Minister of National Defense.
Article 5. - The location of the National Defense Academy in Hanoi is specified in the Prime Minister's Notification No. 159-TB dated November 26, 1994.
Article 6. - This Decree takes effect from the date of issuance. All previous provisions contrary to this Decree are abolished.
Article 7. - Ministers of Ministries, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of Provincial People's Committees directly under the Central Government are responsible for implementing this Decree.
