REGARDING THE ESTABLISHMENT OF THE SECURITIES DEPOSITORY CENTER

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

PURSUANT TO THE PROPOSAL OF THE CHAIRMAN OF THE STATE SECURITIES COMMISSION,

Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Finance;

Pursuant to Decision No. 161/2004/QD-TTg dated September 7, 2004 of the Government Chairman on the functions, tasks, powers, and organizational structure of the State Securities Commission;

At the proposal of the Minister of Finance,

DECISION:

Article 1. The Securities Depository Center is established under the State Securities Commission - Ministry of Finance.

The Securities Depository Center is a service organization with revenue, having legal personality, its own seal and separate account, with operating funds provided by the state budget.

Article 2. The Securities Depository Center has its main office in Ha Noi and a branch in Ho Chi Minh City.

International trade name in English: Vietnam Securities Depository (abbreviated as VSD).

Article 3. The Securities Depository Center shall perform registration, depository, settlement, and securities payment tasks, and provide support services for securities trading activities.

The Minister of Finance shall specify in detail the tasks, powers, and organizational structure of the Securities Depository Center.

Article 4. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 5. The Minister of Finance, ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairmen of People's Committees of provinces and centrally governed cities are responsible for implementing this Decision./.
