Pursuant to Decree No. 184/2004/NĐ-CP dated November 2, 2004 of the Government detailing the implementation of the Self-Defense Law;

Pursuant to Decree No. 119/2004/NĐ-CP dated May 11, 2004 of the Government on defense work in Ministries, agencies at ministerial level, government agencies, and localities;

Pursuant to Decree No. 30/2004/NĐ-CP dated January 16, 2004 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Ministry of National Defense;

At the proposal of the Chief of General Staff.

DECISION:

Chapter I:

RESPONSIBILITIES, TASKS AND WORKING RELATIONSHIPS OF CADRES OF THE MILITARY COMMAND BOARD OF AGENCIES AND ORGANIZATIONS

Article 1. Responsibilities, tasks, and working relationships of the Commander of the Military Command Board of agencies and organizations

1. Responsibilities

The Commander of the Military Command Board of state administrative agencies, public service units, economic organizations, political organizations, and socio-political organizations (hereinafter referred to collectively as agencies and organizations) is responsible before the Party committee and the head of the agency or organization for defense and military work; subject to the direction, command, and management of the superior military authority; directly directs and organizes the implementation of defense and military work of the agency or organization in accordance with the law.

2. Tasks

a) Together with the Military Command Board, take the lead in studying and implementing resolutions, directives, and orders regarding defense and military tasks from superiors; advise the Party committee and the head of the agency or organization to draft leadership and guidance documents and plans for implementing defense and military work within their own agencies and organizations.

b) Advise the Party committee and the head of the agency or organization to lead and direct the dissemination and education on national defense, and the training of national defense knowledge for cadres, civil servants, employees, and workers in units under their own agencies and organizations in accordance with the law.

c) Propose to the Party committee and the head of the agency or organization about combining economy and society with national defense and security in planning and development programs within the fields managed by their agencies and organizations; coordinate with the locality where their headquarters are located to build a people's defense foundation, contributing to building provinces and centrally-administered cities (collectively referred to as provinces) into solid defense areas; directly assist the Party committee and the head of the agency or organization in building and implementing Plan B, mobilization plans for material and technical resources for the military, civil defense plans, and directing and directly participating in exercises according to orders from higher-level sectoral authorities and local military authorities where their headquarters are located.

g) Assist the Party committee in coordinating with units in the area to disseminate and educate the Law on Defense, the Law on National Security, and other legal regulations on defense and security to cadres, workers, and employees; comply with orders for young men to enlist; implement registration and management of citizens in the age range for self-defense, male citizens in the age range for enlistment, and reserve military personnel.

e) Together with the Political Commissar, advise the Party committee and the head of the agency or organization to build and implement plans for organizing, training, and activities of self-defense forces; improve the cadre team of the Military Command Board and self-defense leaders; enhance the competence, management, and command skills of self-defense cadres under their jurisdiction.

Regularly review and consolidate self-defense forces with appropriate numbers and high quality, organize political education and military training according to prescribed programs and mission requirements; comply with orders for mobilizing personnel and equipment for the military; participate in exercises and readiness inspections as prescribed by competent military authorities.

g) Maintain combat readiness routines and manage weapons and equipment within the establishment of self-defense forces. Direct and command self-defense forces to cooperate with other forces in the area to protect production, maintain social order and security, prevent and mitigate the consequences of natural disasters, and fire prevention and control within the agency or organization and its operational area.

h) Annually prepare budgets, execute, and settle accounts for the budget to ensure the fulfillment of defense and military tasks of the agency or organization.

i) Be well informed about political and social situations, together with the Political Commissar, propose to the Party committee and the head of the agency or organization to direct and implement policies and systems for self-defense forces, reserve military personnel, and military rear support policies.

k) Direct and guide subordinate agencies and units under their management in various localities to fulfill defense and military tasks; implement reporting, briefing, inspection, mid-term review, and final summary systems for defense and military work as prescribed.

3. Working Relationships

a) With the Party Committee of the agency or organization: This is a relationship between leadership and being led. Under the leadership of the Party Committee, the Commander of the Military Command Board of the agency or organization is responsible for organizing the implementation of resolutions on defense and military work and regularly reports on the implementation of defense and military tasks to the Party Committee of the agency or organization.

b) With the head of the agency or organization: This is a relationship between direction and management and being directed and managed. The Commander of the Military Command Board of the agency or organization complies with the direction, management, and operation of the head of the agency or organization; at the same time, advises and proposes measures to organize the implementation of defense and military work tasks.

c) With the Military Command Board of the superior agency or organization: This is a relationship between subordinate and superior. The Commander of the Military Command Board of the agency or organization is subject to the direction and command of the superior Military Command Board regarding the defense and military work of their unit.

d) With the Ministry of National Defense and local military authorities:

- The Commander of the Military Command Board of ministries, agencies at the level of ministries equivalent to ministries, agencies under the Government, and state-owned corporations established by Decision of the Prime Minister: Shall be directly guided by the Minister of National Defense on defense work in accordance with the provisions of Decree No. 119/2004/NĐ-CP dated May 11, 2004 of the Government; shall be uniformly commanded by the Minister of National Defense regarding self-defense forces and reserve mobilization forces under central ministries and agencies through the direct command of local military authorities at all levels; shall be directed and guided within the scope of functions and powers of the General Staff and the General Departments under the Ministry of National Defense.

- The Commander of the Military Command Board of organizations under provincial level: Shall be guided by the Commander of the Provincial Military Command Board on defense and local military work within the fields managed by their own organization; at the same time, shall have coordination and cooperation relationships on some aspects of work related to defense such as: national defense education; construction of defense zones and civil defense; building political and economic potential, building people's armed forces. Shall be commanded and directed by the Commander of the Military Command Board of districts, towns, cities, counties (collectively referred to as districts) where their headquarters are located regarding the construction, training, and activities of self-defense forces; management of reserve mobilization forces; registration of male citizens of conscription age and recruitment; combat - public security activities, protecting the organization within the local defense zone.

- The Commander of the Military Command Board of organizations under district level: Shall be directly commanded and directed by the Commander of the District Military Command Board on defense and local military work within the scope of their own organization.

e) With the Political Commissar of the Military Command Board of organizations: Is a relationship of coordination in work, sharing responsibility for organizing and implementing defense and military tasks in their own organization.

g) With the Deputy Commander of the Military Command Board of organizations: Is a commanding relationship between superiors and subordinates, assigning the Deputy Commander appropriate tasks based on his capabilities; at the same time guiding and assisting the Deputy Commander to complete his tasks.

h) With departments, mass organizations under the organization: Is a relationship of coordination and cooperation in organizing and implementing defense and military work according to resolutions of the Party committee and plans of the head of the organization.

i) With local Party committees and governments: Is a relationship of coordination and cooperation according to assigned tasks and plans. Periodically, the Commander reports on the situation of national defense and security of their own organization and coordinates with the locality on plans for joint activities on defense and military work.

k) With organizational security forces: Is a relationship of coordination and cooperation according to relevant functions and tasks related to defense, military, and security work.

Article 2. Responsibilities, tasks, and working relationships of the Political Commissar of the Military Command Board of organizations

1. Responsibilities

The Political Commissar of the Military Command Board of organizations is responsible before the Party Committee of their own level and the political department under the local military authority where their headquarters are located for all activities of Party work and political work (CTĐ, CTCT) in performing defense and military tasks and building self-defense and reserve mobilization forces of their organization.

The Political Commissar of the Military Command Board of organizations operates under the leadership and direct guidance of the Party Committee, the head of the organization; is directed by the local Party Committee, the local military Party Committee, and the political department under the local military authority where their headquarters are located on performing defense and military tasks of their unit.

2. Tasks

a) Together with the Commander of the Military Command Board, study and implement tasks, assess the situation, propose to the Party Committee and the head of the organization policies and measures for leading and directing and implementing various aspects of defense and military work in the organization, while coordinating to implement these policies and measures.

b) Take the lead in conducting political education, ideological leadership, and directly organizing political education, disseminating the Party's guidelines and state laws on national defense and security for self-defense and reserve mobilization forces; together with the Commander, coordinate with relevant functional agencies to conduct nationwide national defense education.

c) Carefully build and improve the overall quality of self-defense and reserve mobilization forces. Maintain the system of reviewing and selecting personnel for self-defense forces, ensuring political reliability; directly discover, nurture sources to develop party members, and regularly educate and nurture to fully play the role of party members and youth league members in self-defense and reserve mobilization forces. Educate officers and soldiers to enhance revolutionary vigilance, strictly comply with internal protection systems, prevent espionage, and maintain confidentiality.

d) Master the situation and nurture political qualities, revolutionary morals, and experience in Party work and political work for the cadre of self-defense forces under their jurisdiction; coordinate with units receiving reserve mobilization sources, manage, and create conditions for reserve mobilization forces under their organization to participate in training exercises achieving quality and effectiveness.

g) Launch and maintain the Quyet Thang Competition Movement in self-defense and reserve mobilization forces; promptly identify, nurture, and commend exemplary individuals and deeds in performing defense and military tasks within their organization's scope; at the same time, closely monitor ideological trends and correct and guide deviations in political ideology in self-defense and reserve mobilization forces.

h) Together with the Commander, maintain the readiness combat system, manage weapons and equipment in the self-defense force's establishment. Direct and command self-defense forces to cooperate with other forces in the area to protect production, maintain public order and security, prevent and mitigate the consequences of natural disasters, fires, and explosions within the organization and the standing ground area.

i) Implement and organize the implementation of the system and policies for the self-defense force and reserve mobilization forces; the military rear support policy of the Party and the State.

k) Organize the conduct of defense work and political work in the construction and operation of the self-defense force and reserve mobilization forces; the recruitment and call-up of citizens for military service and the execution of mobilization tasks; other national defense and military tasks within the agency or organization.

Conduct inspections, mid-term reviews, and final summaries of defense work and political work in the implementation of national defense and military tasks according to the prescribed regime; report the results of defense work and political work to the same-level Party Committee and the superior political department.

3. Working Relationships

a) With the Party Committee of the agency or organization: This is the relationship between leadership and obedience, between the collective leadership and the individual responsible.

b) With the Military Party Committee and the political department under the local military agency: This is the relationship between guidance and obedience to guidance on defense work and political work for the self-defense force and reserve mobilization forces, recruitment, and mobilization work.

c) With the Chief of the Military Command Board of the agency or organization: This is the relationship of cooperation in work, sharing responsibility for organizing and implementing national defense and military tasks at the agency or organization before the same-level Party Committee regarding activities of defense work and political work in executing those tasks.

d) With the Deputy Chief of the Military Command Board of the agency or organization: This is the relationship between superiors and subordinates. The Political Commissar directs and assigns the Deputy Chief to implement certain aspects of defense work and political work.

e) With the local Party Committee and government: This is the relationship of cooperation and coordination according to assigned tasks and plans.

Periodically, the Political Commissar reports the political and ideological situation of cadres, workers, staff members, self-defense force, and reserve mobilization forces of the agency or organization and unifies the plan for defense work and political work with the locality in carrying out national defense and military work.

Article 3. Responsibilities, Tasks, and Work Relationships of the Deputy Chief of the Military Command Board of the Agency or Organization

1. Responsibilities

The Deputy Chief of the Military Command Board of the agency or organization assists and is ready to replace the Chief when absent; is responsible to the Chief and Political Commissar of the Military Command Board of the agency or organization for the contents of work assigned.

2. Tasks

a) Propose contents related to national defense and military work to the Military Command Board of the agency or organization according to the assigned tasks.

b) Carry out tasks according to the assignment of the Chief and Political Commissar of the Military Command Board of the agency or organization.

c) Master the situation and compile the results of each assigned task and report to the Chief of the Military Command Board.

3. Working Relationships

The work relationship with the Chief and Political Commissar of the Military Command Board of the agency or organization is the relationship between subordinates and superiors. The Deputy Chief is subject to the command of the Chief and Political Commissar, executes the assigned tasks, and reports the results to the Chief and Political Commissar.

Chapter II:

RESPONSIBILITIES, TASKS AND WORK RELATIONSHIPS OF THE COMMUNE MILITIA OFFICER

Article 4. Responsibilities, Tasks, and Work Relationships of the Commune Militia Officer

1. Responsibilities

The Commune Militia Officer (CMO) of the commune, ward, town (collectively referred to as the commune) is a member of the People's Committee of the commune, ward, town (collectively referred to as the commune), subject to the leadership of the Party Committee and the management of the People's Committee of the commune; together with the commune militia, ward militia, town militia (collectively referred to as the militia) advises the Party Committee and the commune administration in implementing national defense and military work; mainly coordinates with various departments, sectors, mass organizations to implement local national defense and military tasks according to directives and orders from higher military agencies, resolutions of the Party Committee, People's Council, and instructions and plans of the Chairman of the People's Committee of the commune; while directly organizing, building, and training the militia force to contribute to maintaining political security and social order and safety at the grassroots level and being ready to fight in all situations; registering and managing the reserve mobilization force, militia, male citizens of conscription age, and conducting annual recruitment work.

2. Tasks

a) Study and implement directives and orders from superiors regarding national defense and military tasks; report and propose to the Party Committee and the Chairman of the People's Committee of the commune the policies and measures to implement these tasks.

b) Advise the Party Committee and the People's Committee of the commune to issue resolutions and instructions (regarding national defense and military work). Lead the planning for the construction, training, and activities of the militia; the commune combat and security plan; the commune civil defense plan according to the guidance of the County Military Command Board. Lead and coordinate with various departments, sectors, and mass organizations to implement related tasks concerning local national defense and military work.

c) Together with the Political Commissar of the militia, propose to the Party Committee and the People's Committee to regularly consolidate and improve the cadre team of the militia, unit commanders, and have plans to train to enhance their understanding and organizational, management, and command capabilities for subordinate cadres under their jurisdiction; consolidate and improve the organization and staffing of the mobile platoon, various specialized squads of the commune and county (if any), and the local militia force of villages to meet the requirements and tasks of national defense and military work.

d) Annually, lead and coordinate with various departments, sectors, and mass organizations to organize the registration of citizens of militia age, male citizens of conscription age, and the reserve mobilization force; strictly manage the quantity and quality of core militia, broad militia, male citizens of conscription age, first-class and second-class reservists.

e) Organize political education and military training for the militia force according to the training program of the County Military Command Board and the urgent requirements and tasks of superiors; organize inspections, competitions, and evaluations of the results of training activities at the level and participate in competitions and evaluations as required by superiors.

g) Organize and command the militia to cooperate with the police station and other forces in security and public order activities; be ready to fight and serve in combat, overcome the consequences of natural disasters and epidemics; organize the militia force to participate in mass mobilization work, local movements, contributing to building a strong and comprehensive grassroots base.

h) To take the lead in coordinating with various departments, mass organizations to assist the Party Committee and the People's Committee of the commune in organizing national defense education for all citizens; promoting and disseminating laws on national defense and security; contributing to enhancing the awareness and responsibility of the people in building a nationwide people's defense and a people's security posture, responding to complex situations.

i) To advise the Party Committee and the People's Committee of the commune on developing and implementing plans to combine economic, cultural, and social development with the construction of a nationwide people's defense and a people's security posture within the commune.

k) To grasp the situation firmly, together with the Political Instructor of the Commune Militia, propose to the Party Committee and the People's Committee of the commune to lead and direct the implementation of policies and regulations for the militia forces, reserve forces, and military rear support policies.

l) To maintain routines and combat readiness systems; to register and store weapons and equipment; to implement regular and ad hoc inspection and reporting systems; to conduct briefing sessions, mid-term reviews, and final summaries on defense and military work according to regulations.

3. Working Relationships

a) With the Commander of the Military Command of the district: It is a subordinate relationship regarding defense and military matters; a relationship of command execution and command. The Commune Militia Commander bases on directives and orders from the Commander of the Military Command of the district to develop and implement plans after approval, and reports the results to the Commander of the Military Command of the district.

b) With the Party Committee at the commune level: It is a relationship between leadership and being led. Under the leadership of the Party Committee, the Commune Militia Commander implements resolutions on defense and military work and reports the results to the Party Committee of the commune.

When receiving directives or orders from higher military authorities, the Commune Militia Commander reports to the Secretary of the Party Committee of the commune, proposing policies, plans, and measures for implementation.

c) With the Chairman of the People's Committee of the commune: The Commune Militia Commander is directly under the guidance and management of the Chairman of the People's Committee of the commune concerning defense and military work; develops and implements the Defense and Military Work Plan after approval by the Chairman of the People's Committee of the commune; reports the results to the Chairman of the People's Committee of the commune.

d) With the Political Instructor of the Commune Militia: It is a cooperative relationship, sharing responsibility for organizing and implementing defense and military tasks at the commune level.

e) With the Deputy Commune Militia Commander: It is a command relationship between superior and subordinate. The Commune Militia Commander assigns the Deputy Commune Militia Commander to organize and implement certain tasks suitable to their capabilities, while guiding and assisting the Deputy Commune Militia Commander in completing their duties.

g) With other departments, mass organizations at the same level: It is a cooperative relationship, coordinating to implement defense and military work related to the leadership of the Party Committee and the guidance and management of the Chairman of the People's Committee.

The Commune Militia Commander regularly informs other departments, mass organizations about the situation and tasks of defense and military work; simultaneously guides these organizations to implement according to the resolutions of the Party Committee and the guidance and management of the Chairman of the People's Committee on defense and military tasks.

h) With the Police Station of the commune: It is a cooperative relationship, coordinating according to functions and tasks related to defense and security work of the commune.

i) With units stationed in the area: It is a cooperative relationship, coordinating according to assigned tasks and plans. The Commune Militia Commander informs local conditions, unifies plans for defense and military activities with units stationed in the area and neighboring communes.

Article 5. Duties, tasks, and working relationships of the Political Instructor of the People's Militia Team

1. Responsibilities

The Political Instructor of the People's Militia Team, who is concurrently held by the Secretary of the Party Committee (branch) of the commune, is responsible for overseeing all activities related to political work and ideological work for the militia forces, reserve forces, and in implementing national defense and military tasks at the commune level. All activities of the Political Instructor of the People's Militia Team are directly led by the Party Committee (branch committee) of the commune, guided by the Military Party Committee at the district level, and directed by the Political Instructor and the Political Department of the District Military Command.

2. Tasks

a) Together with the Head of the People's Militia Team, study and implement resolutions, directives, and orders from superiors, understand the local national defense and security situation, and the national defense and military tasks of their level; assess the situation, propose policies and measures for leading the militia and reserve forces to the Party Committee (branch committee); build plans for political work and ideological work, and assign organizational implementation.

b) Conduct political work, lead the ideological orientation of the militia and reserve forces; directly organize political education, current affairs briefings, and propaganda on the Party's guidelines and state laws regarding national defense and security for the militia and reserve forces. Work together with the Head of the People's Militia Team and relevant staff to coordinate and cooperate in comprehensive national defense education, mobilize the people to enhance vigilance, actively participate in consolidating national defense, building the militia and reserve forces, contributing to the comprehensive strength of grassroots organizations and ensuring safe areas under control.

c) Focus on building and improving the overall quality of the militia and reserve forces, maintain the system of reviewing and selecting personnel for the militia force, ensure political reliability; work together with the Head of the People's Militia Team and the Village Militia Team Leader to select young party members and eligible members to join the militia, identify and nurture outstanding members within the militia and reserve forces for party development.

d) Work together with the Head of the People's Militia Team to closely monitor the situation of the militia cadre and reserve officers at the commune level; prepare content and organize the implementation of cadre-related decisions made by the Party Committee (branch committee), organize training for militia cadres on political qualities, revolutionary morals, and experience in political work and ideological work. Coordinate with military units to arrange and manage reserve officers in the locality.

e) Regularly review the political situation within the militia and reserve forces; strictly manage internal political situations within the militia and reserve forces; educate cadres and soldiers to enhance revolutionary vigilance, seriously follow internal protection systems, and keep secrets.

g) Initiate and maintain the "Determined to Win" competition movement and other local competition movements among the militia and reserve forces. Timely identify, nurture, and commend exemplary individuals and good deeds in fulfilling national defense and military tasks.

h) Work together with the Head of the People's Militia Team to direct and command the militia and reserve forces to collaborate with the police, mass organizations, and the people to maintain political stability and social order, prevent natural disasters and epidemics; coordinate with main force troops, local troops, and border guard units stationed in the area to participate in building a comprehensive national defense foundation locally and engage in grassroots mass mobilization work.

i) Educate, implement, and organize the execution of regulations and policies for the militia and reserve forces, and the military rear support policies of the Party and State. Mobilize the people to actively assist the families of martyrs, wounded veterans, families of serving military personnel, reserve military personnel, and militia to stabilize their lives and develop family economies.

k) Lead the implementation of political work and ideological work in various aspects of building and operating the militia and reserve forces; in preparing and calling up young men for military service; educating and motivating deserting soldiers to return to their units; participate in directing the construction of combat villages; organize civilian defense and perform other tasks in the locality.

l) Direct and organize the implementation of mid-term and final reviews of political work and ideological work, report according to the prescribed time to the Party Committee (branch committee) of the commune, the Military Party Committee at the district level, and the Political Department of the District Military Command.

3. Working Relationships

a) With the Party Committee (branch) of the commune: This is a relationship between leadership and obedience to leadership, between the leadership collective and the individual responsible.

The Political Instructor of the People's Militia Team proposes policies and measures to the Party Committee (branch) of the commune regarding leading national defense and military work at the commune level.

b) With the Military Party Committee at the district level: This is a relationship of being guided and guiding political work and ideological work for national defense and military work at the commune level. The Political Instructor leads the implementation of tasks according to the guidance of the Military Party Committee of the district.

c) With the Political Instructor and the Political Department of the District Military Command: This is a relationship between the person in charge of political work and ideological work at the lower level and the person in charge of political work and ideological work and the department responsible for political work and ideological work at the higher level. The Political Instructor of the People's Militia Team must strictly comply with directives, plans, and guidance from the Political Instructor and the Political Department of the District Military Command regarding political work and ideological work for local national defense and military work.

d) With the Head of the People's Militia Team: This is a relationship of cooperation in work, sharing responsibility for implementing national defense and military work at the grassroots level. Together with the Head of the People's Militia Team, exchange and unify plans and measures to implement resolutions of the Party Committee (branch) on national defense and military work.

e) With various departments, mass organizations in the local political system: This is a relationship of coordination and cooperation in implementing policies and measures for leading national defense and military work at the commune level as proposed by the Party Committee (branch).

Article 6. Duties, Tasks, and Work Relationships of the Deputy Village Militia Team Leader

1. Responsibilities

The Deputy Village Militia Team Leader assists the Village Militia Team Leader and is ready to replace the Village Militia Team Leader when he is absent; they are subject to command and assignment by the Village Militia Team Leader, the Village Political Instructor, and are responsible to the Village Militia Team for assigned tasks.

2. Tasks

a) To thoroughly understand the situation of national defense and military work in the village, promptly identify and propose measures to the Village Militia Team for organizing and implementing each aspect of national defense and military work assigned.

b) To firmly grasp assigned tasks, study the situation, develop plans for implementation, and report to the Village Militia Team Leader. The Deputy Village Militia Team Leader directly implements citizen registration and management for citizens within the age range of militia, male citizens within the age range of potential conscription, reserve forces, and weapons and equipment at the grassroots level; assists the Village Militia Team Leader in organizing some military training contents for core militia forces; implements the village's combat-security plan; directly commands the mobile militia platoon or the permanent militia platoon (if any) to perform tasks according to the assignment of the Village Militia Team Leader.

c) To compile the situation and results of implementing national defense and military tasks according to assigned tasks, report to the Village Militia Team Leader, the Village Political Instructor, and the superior military authority when authorized.

3. Working Relationships

a) With the Village Militia Team Leader: This is a relationship between subordinate and superior, the Deputy Village Militia Team Leader must comply with and be subject to the assignment of the Village Militia Team Leader; organize the implementation of assigned tasks and report the results to the Village Militia Team Leader.

b) With the Village Political Instructor: This is a relationship between subordinate and superior. The Deputy Village Militia Team Leader must comply with and be subject to the assignment of the Village Political Instructor; organize the implementation of assigned tasks and report the results to the Village Political Instructor.

Chapter III:

DUTIES AND TASKS OF COMMANDERS OF PEOPLE'S SELF-DEFENSE UNITS

Article 7. Duties and Tasks of the People's Self-Defense Battalion Commander and Equivalent Positions

1. Responsibilities

The Battalion Commander is subordinate to the Commandant of the Provincial Military Command and is under the direction and control of the head of their own agency or organization; they are responsible to superiors and the battalion command team for building, training, and activities of the self-defense force.

The Battalion Commander must base on orders and directives from immediate superiors to implement tasks for strengthening the battalion comprehensively.

The Battalion Commander has the authority to issue orders and directives to units under their command to carry out battalion tasks.

2. Tasks

a) Command the battalion to implement the Party's policies, state laws, resolutions of the leadership body, the direction of the head of the agency or organization; directives and orders of superiors.

b) To thoroughly understand all aspects of the battalion, ensuring the battalion is ready for combat upon orders from superiors; commanding the battalion to complete all assigned tasks.

c) To establish and implement plans for building, training, and combat-security operations of the battalion after approval by the competent authority.

d) To register and strictly manage the cadre and soldier self-defense force under their command; to understand the political and ideological situation, level of understanding, capability, and conditions of activity of cadres and soldiers of the battalion.

e) To thoroughly understand the quantity and quality of weapons, equipment, and means managed by the battalion; to maintain storage and usage regulations as prescribed.

g) Together with the Battalion Political Instructor, to organize political and ideological education for cadres and soldiers under their command; to build unity, democracy, and effectively implement competition movements.

h) To guide, inspect, assist units under their command in implementing tasks related to building the self-defense force; to organize mid-term and final reviews, draw lessons, and report to the superior Military Command in accordance with regulations.

Article 8. Duties and Responsibilities of the Political Officer of the Militia Battalion and Equivalent Units

1. Responsibilities

The Political Officer of the battalion is the person in charge and responsible to superiors for political work and ideological work in the battalion; all activities of the Political Officer of the battalion are under the leadership of the Provincial Military Party Committee and the Party Committee of the unit to which the battalion belongs; they are subject to guidance from the Political Officer and higher-level political organs; together with the Battalion Commander, organize the construction of the unit to be comprehensively strong.

2. Tasks

a) Together with the Battalion Commander, implement resolutions, directives, orders of superiors, tasks of the battalion; propose contents and methods to organize and implement.

b) Directly build and organize the implementation of the Political Work Plan and Ideological Work Plan of the battalion at each period and each task.

c) Together with the Battalion Command Board, grasp the situation of the unit firmly, carry out political education and ideological work, disseminate current affairs, organize cultural and artistic activities and the "Determined to Win" movement for cadres and soldiers in the battalion.

d) Strictly manage internal political situations, educate cadres and soldiers to raise their revolutionary vigilance awareness, strictly comply with regulations on anti-sabotage, confidentiality, and building the unit comprehensively strong.

e) Chair the organization and implementation of political work and ideological work contents in unit construction, focusing on the task of organizing, training, and combat-security operations of the battalion.

g) Organize mid-term and final reviews to draw lessons from political work and ideological work in the battalion and report results to superiors as prescribed.

Article 9. Duties and Responsibilities of the Deputy Battalion Commander of the Militia and Equivalent Units

1. Responsibilities

The Deputy Battalion Commander is subordinate to the Battalion Commander; assists the Battalion Commander in military command; is ready to replace when the Battalion Commander is absent; is responsible to the Battalion Commander and the Political Officer of the battalion for assigned tasks.

2. Tasks

a) Master the assigned tasks, collect and study relevant situations, prepare plans for implementation and report to the Battalion Commander for approval.

b) Implement according to the approved plan.

c) Grasp the situation of the battalion firmly, identify issues and promptly address them with the Battalion Commander regarding solutions to resolve these issues.

d) Assist the Battalion Commander, guide, urge, monitor, inspect, and assist units under their command to implement according to the plan. Grasp the situation and results of implementation and report to the Battalion Commander.

e) Organize the drawing of lessons from assigned tasks.

Article 10. Duties and Responsibilities of the Company Commander of the Militia and Equivalent Units

1. Responsibilities

The Company Commander is under the management of the Battalion Commander or the higher-level military organ; is personally responsible to superiors and the company command team for all aspects of the company's activities. The Company Commander has the authority to issue orders and directives to units under their command to perform the company's tasks.

2. Tasks

a) Command the company to implement the Party's policies and state laws; resolutions of the Party Committee and the leadership of the head of the organ or organization; directives and orders of superior commanders.

b) Grasp the overall situation of the company firmly, ensure that the company is ready for combat upon receiving orders from superiors; command the company to complete all assigned tasks.

c) Establish and organize the implementation of plans for building, training, and combat-security operations of the company after obtaining approval from the competent authority.

d) Register and strictly manage the cadre and self-defense soldier personnel under their command; grasp the political and ideological situation, level of understanding, capabilities, and operational conditions of cadres and soldiers in the company.

e) Be familiar with the quantity and quality of weapons, equipment, and means managed by the company; maintain proper storage and usage according to regulations.

g) Together with the Political Officer of the company, organize political and ideological education for cadres and soldiers under their command, build unity and democracy, effectively implement competition movements.

h) To guide, inspect, assist units under their command in implementing tasks related to building the self-defense force; to organize mid-term and final reviews, draw lessons, and report to the superior Military Command in accordance with regulations.

Article 11. Duties and Tasks of the Political Instructor of the Militia Platoon and Equivalent Units

1. Responsibilities

The Political Instructor of the platoon is responsible for leading and being accountable to superiors for political and ideological work at the platoon level; all activities of the Political Instructor of the platoon are under the leadership of the same-level Party Committee, the local military Party Committee, and the guidance of the superior Political Instructor and Political Department; together with the Platoon Leader, organize the construction of the unit to be comprehensively strong and complete assigned tasks.

2. Tasks

a) Together with the Platoon Leader, implement resolutions, directives, and orders from superiors, and the platoon's tasks; propose contents and methods to organize and implement them.

b) Directly build and implement the Political Work Plan of the platoon during each period and task.

c) Together with the Platoon Command, grasp the situation of the unit, carry out political and ideological education, current affairs propaganda, effectively organize the Quyet Thang Competition Movement, and cultural and artistic activities for officers and soldiers in the platoon.

d) Strictly manage internal political situations, educate cadres and soldiers to raise their revolutionary vigilance awareness, strictly comply with regulations on anti-sabotage, confidentiality, and building the unit comprehensively strong.

e) Lead the implementation of political and ideological work contents in unit construction, focusing on organizational building, training, combat operations, and security tasks of the platoon.

g) Organize mid-term and final reviews to draw lessons from political and ideological work at the platoon level and report results to superiors as prescribed.

Article 12. Duties and Tasks of the Deputy Platoon Leader and Equivalent Positions

1. Responsibilities

The Deputy Platoon Leader is subordinate to the Platoon Leader; assists the Platoon Leader in military command; is ready to replace when the Platoon Leader is absent; is accountable to the Platoon Leader and the Political Instructor of the platoon for assigned tasks.

2. Tasks

a) Grasp assigned tasks, collect and study relevant situations, prepare plans for implementation and report to the Platoon Leader for approval.

b) Implement tasks according to the approved plan.

c) Grasp the situation of the platoon, identify issues and promptly report to the Platoon Leader about measures to resolve them.

d) Assist the Platoon Leader in guiding, urging, monitoring, inspecting, and helping subordinate units to implement according to the plan. Grasp the situation and results and report to the Platoon Leader.

e) Organize the drawing of lessons from assigned tasks.

Article 13. Duties and Tasks of the Militia Squad Leader and Equivalent Positions

1. Responsibilities

The Squad Leader is subordinate to the command of the Platoon Leader or Village Team Leader, the Head of the Military Command Office, organization, or the County Military Command Head; is accountable to superiors for all aspects of the squad. The Squad Leader has the authority to issue orders to Sub-Squad Leaders and soldiers under their command to perform squad tasks.

2. Tasks

a) Command the squad to strictly follow the Party's policies, State laws, orders, and directives from superiors.

b) Grasp the overall situation of the squad, maintain readiness for combat; command the squad to complete all assigned tasks.

c) Directly organize political education and military training for the squad according to assigned contents.

d) Closely manage personnel strength according to the establishment, grasp the political and ideological situation, health status, level of understanding, and operational capabilities of officers and soldiers in the squad.

e) Manage the quantity and quality of weapons, equipment, and other assets of the squad; educate about responsibility in maintaining, preserving, and using weapons and equipment.

g) Carry out political work activities in the squad, educate awareness of vigilance and confidentiality; promote democracy in military work.

i) Conduct mid-term and final reviews, draw lessons from all aspects of work, and report results to superiors as prescribed.

Article 14. Duties and Tasks of the Village Militia Captain and Equivalent Positions

1. Responsibilities

The Village Militia Captain, Hamlet Militia Captain, Ward Militia Captain, Village Militia Captain, Commune Militia Captain, Sóc Militia Captain, Phum Militia Captain, Cluster Militia Captain, District Militia Captain (hereinafter referred to collectively as Village Militia Captain and equivalent positions) concurrently holds the position of group leader or squad leader, or local militia platoon leader under the command of the Commune Militia Captain. The Village Militia Captain is directly commanded by the Commune Militia Captain regarding national defense and military work in the village, hamlet, ward, village, commune, sóc, phum, residential community, cluster, or district (hereinafter referred to collectively as village); is led and directed by the village party cell committee and village head; and is responsible to higher authorities for the results of national defense and military work in the village.

2. Tasks

a) Advising and proposing to the commune militia captain and directly implementing national defense and military work in the village.

b) Registering and strictly managing core militia members, broad-based militia members, reserve forces, male citizens of conscription age, and citizens of militia age in the village, motorized vehicles, and communication equipment in the village; organizing core militia members in the village to conduct regular activities.

c) Organizing annual military training for the local militia force in the village according to the directives of the commune militia captain, or mobilizing this force to participate in military training organized by the commune militia captain.

d) Commanding the local militia force to cooperate with the village police and other forces to maintain political security and social order in the village, protect the lives and property of the people, collective property, and state property within the area; participating in disaster prevention and mitigation, epidemic control; doing well in propaganda and mobilization work among the people; participating in building a comprehensive strong grassroots base according to the directives of the commune militia captain.

e) Organizing mid-term and final reviews of national defense and military work in the village according to the directives of the commune militia captain.

Article 15. Duties and Tasks of the Self-Defense Militia Squad Leader and Equivalent Positions

1. Responsibilities

The squad leader is under the management of the platoon leader, village militia captain, commune militia captain, or the commander-in-chief of the People's Military Command of the agency or organization; is commanded by immediate superiors; is responsible to superiors and the squad collective for all aspects.

2. Tasks

a) Commanding the squad to implement the Party's policies and guidelines; state laws; regulations, orders, and directives from superiors.

b) Being thoroughly aware of all aspects of the squad's situation, maintaining the squad in a constant state of readiness to fulfill all assigned tasks.

c) Directly commanding the squad in training, combat operations, public security, and other tasks according to superior orders.

d) Setting an example by complying with established regulations; ensuring the squad adheres to living routines and regulations as stipulated.

e) Strictly managing the squad's authorized personnel strength, understanding the thoughts, circumstances, capabilities, aspirations, and wishes of each member of the squad.

g) Building unity within the squad, promoting democracy, encouraging competition to build a comprehensive strong squad.

h) Timely drawing lessons from the squad's task execution, reporting results to immediate superiors as prescribed.

Chapter IV:

IMPLEMENTATION

This Decision shall take effect fifteen days from the date of publication in the Official Gazette. Provisions contrary to this Decision are abolished.

Article 17. The Chief of General Staff, Chiefs of the Departments, Commanders of Military Regions and Naval Forces, Military Affairs Committees of central ministries and agencies, Provincial and Central City Military Commands, cadres of Military Affairs Committees of agencies and organizations, village militia cadres, cadres commanding self-defense forces units, and heads of related agencies and units are responsible for implementing this Decision./.
