Guidelines for national defense work in ministries, sectors, and localities in 2012
Based on Decree No. 119/2004/NĐ-CP dated May 11, 2004 of the Government on national defense work in ministries, agencies at ministerial level, government agencies, and localities;

Based on the Law on National Defense dated June 14, 2005;
Pursuant to the Law on Militia and Self-defense dated November 23, 2009;
The Minister of National Defense guides the implementation of national defense work in ministries, sectors, and localities in 2012 as follows:
Based on Decree No. 104/2008/NĐ-CP dated September 16, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense,
Considering the proposal of the Chief of General Staff;
These Circulars guide the implementation of Article 2, Article 4, Article 5, Article 7, Article 10, and Article 11 of Decree No. 119/2004/NĐ-CP dated May 11, 2004 of the Government on national defense work in ministries, agencies at ministerial level, government agencies, and localities; and simultaneously guide the implementation of certain contents of Decree No. 116/2007/NĐ-CP dated July 10, 2007 of the Government on national defense education and security (NDES), Decree No. 152/2007/NĐ-CP dated October 10, 2007 on Defense Zone, Decree No. 117/2008/NĐ-CP dated November 14, 2008 of the Government on Civil Defense, Ordinance on Reserve Forces, Law on Military Service, Law on Militia and Self-Defense Forces (MSDF), and Law on National Defense to be directed and implemented by ministries, sectors, and localities in 2012.
Article 1. Scope of Regulation
1. Ministries, agencies at ministerial level, government agencies, Central Party Committees, Office of the National Assembly, Office of the President, State Audit Agency, Supreme People's Procuracy, Supreme People's Court, central agencies of political-social organizations, state economic groups, and state corporations established by the Prime Minister's Decision (hereinafter referred to collectively as central ministries and sectors);
Article 2. Applicability
2. People's Committees of provinces and centrally governed cities (hereinafter referred to collectively as provincial level); People's Committees of districts, towns, and cities under provinces (hereinafter referred to collectively as district level); People's Committees of communes, wards, and towns (hereinafter referred to collectively as commune level);
3. Commandants of military regions, services, arms, corps, Border Guard Force, and units under the Ministry of National Defense;
4. Commandants of Hanoi Capital City, Ho Chi Minh City, Military District Commanders, Provincial Border Guard Commanders, Militia and Self-Defense Forces Commanders of central ministries and sectors, Militia and Self-Defense Forces Commanders of district level, Militia and Self-Defense Forces Commanders of agencies and organizations at grassroots level, and Militia and Self-Defense Forces Commanders of commune level.
Article 3. Implementation of directives, resolutions of the Party, and state policies on national defense, militia self-defense forces, and national defense education
1. Continue to thoroughly implement the Party's guidelines and state laws on national defense work and the strategy for protecting the country in new circumstances; focusing on directing and implementing effectively the tasks of strengthening national defense-security, firmly safeguarding the socialist Vietnam according to the spirit of the Eleventh National Party Congress Resolution;
2. Strengthen the implementation and organization of the execution of Party documents and legal regulations on national defense work, national defense mobilization, construction of defense zones, civil defense, militia self-defense forces work, and national defense education;
3. Central ministries and sectors, military regions, and localities need to promptly issue comprehensive leadership and guidance documents and organize the effective implementation of national defense and military tasks within their respective functions, responsibilities, ensuring efficient implementation of national defense work, militia self-defense forces work, and national defense education in 2012.
1. Actively participate in building and supplementing the legal system on national defense education to meet the requirements of national defense and security tasks in new circumstances.
Article 4. National Defense and Security Education Work
2. Continuously consolidate, improve, and enhance the quality and effectiveness of the operation of National Defense Education Councils at all levels, especially at grassroots level. Direct the effective implementation of education and training on national defense knowledge, with a focus on training for newly appointed and transferred officials after the Party Congress and the election of People's Councils in 2011. Increase the training of national defense knowledge for officials in central ministries and sectors located in localities; coordinate with relevant agencies to train religious clergy and leaders in national defense knowledge.
3. Direct the improvement of the quality and effectiveness of national defense education courses for students in secondary schools, vocational colleges, technical colleges, community colleges, universities, academies, and regular education centers and national defense education centers in accordance with regulations. Coordinate with relevant agencies to implement national defense education programs in religious schools; continue to implement teacher training programs for national defense education in accordance with Decision No. 472/QĐ-TTg dated April 12, 2010 of
4. Closely cooperate with information and communication departments, newspapers, and radio stations at central and local levels to strengthen patriotic education, the Party's viewpoints on enhancing national defense and security, focusing on improving the quality and effectiveness of nationwide national defense education; contributing to firmly safeguarding maritime and island sovereignty, border security; raising awareness against the peaceful evolution and violent overthrow plots of hostile forces against the country's industrialization and modernization cause.
5. Continue to direct the implementation of the construction of national defense education centers in accordance with Decision No. 638/QĐ-TTg dated May 21, 2009 of
the Prime Minister to meet the requirements and tasks of national defense education in the coming years. 1. Building local military agencies at all levels as strong and comprehensive; continuously consolidating and improving the Militia and Self-Defense Forces Commanders of central ministries and sectors, Militia and Self-Defense Forces Commanders of agencies and organizations at grassroots level, and Militia and Self-Defense Forces Commanders of communes. Continue to direct the improvement of the quality and effectiveness of advisory and implementation functions assigned to local military agencies and Militia and Self-Defense Forces Commanders at all levels.
Article 5. Building local armed forces and implementing conscription, recruitment, and calling up citizens for military service
1. Building local military agencies at all levels to be comprehensively strong; regularly consolidating and improving the Military Command Board of central ministries and sectors, the Military Command Board of grassroots agencies and organizations, and full-time and part-time defense officials in ministries, sectors, and localities. Continuing to direct the improvement of quality and effectiveness in advisory work and the effective performance of assigned functions and tasks for local military agencies and Military Command Boards at all levels.
2. Military regions, ministries, sectors, and localities continue to implement effectively Decision No. 1602/QĐ-TTg dated August 27, 2010 of the Prime Minister approving the Plan on organizing propaganda and popularizing the Law on Militia and Self-defense Forces. Direct the implementation of the mid-term review and final assessment of model construction according to Decision No. 1902/QĐ-TTg dated October 15, 2010 of the Prime Minister for the Military Command of Vietnam Post and Telecommunications Corporation, the Military Command of Vietnam Coal Industry-Mineral Group Limited Company, the Military Command of the Department of Natural Resources and Environment of Vinh Phuc Province, and build models regarding the organization, training, and activities of militia and self-defense forces in localities to draw lessons for widespread application.
3. Organize training and upgrading military and national defense knowledge for cadres in charge of military affairs at ministries, sectors, and localities; pay special attention to organizing training and upgrading for cadres of military commands at all levels, full-time and part-time military cadres in charge of military work of ministries and sectors to promptly meet requirements and tasks. Direct the effective implementation of training for local reserve forces, mobilized reserve forces, and militia and self-defense forces in accordance with actual timeframes and contents; organize contests and seminars at each level to ensure quality, effectiveness, safety, and economy. The Vietnam Rubber Industry Corporation closely coordinates with military regions and related localities to effectively implement the organization of the National Defense Sports Meet in 2012.
4. Strengthen the review and inspection of registration and strict management of mobilization sources (reserve military personnel and technical equipment); improve the organization, manpower, and equipment of reserve mobilization units in accordance with the provisions of the Ordinance on Reserve Mobilization Forces; build a reserve mobilization force with firm political resolve and high combat readiness. Direct the effective implementation of registration and management of citizens of conscription age and citizens of militia and self-defense service age. Effectively carry out the selection and call-up of citizens for conscription and militia and self-defense service.
5. Consolidate the organization and enhance the quality and effectiveness of operations of militia and self-defense forces, especially maritime militia and self-defense forces and anti-aircraft militia and self-defense forces. Closely coordinate with the Police, Border Guard, Navy, Coast Guard, Forest Rangers, and other forces in performing tasks to protect border, sea, and island sovereignty; actively participate in forest protection and fire prevention, contributing to maintaining political security and social order and safety. Enhance the combat readiness of permanent militia and self-defense forces, maritime militia and self-defense forces, and militia and self-defense forces in key areas. Increase training and exercises of combat plans, participation in disaster prevention and mitigation, epidemic control, search and rescue, and prompt handling when situations arise.
Article 6. Closely combine the implementation of political tasks, economic and social development with strengthening and consolidating national defense and security and building defensive zones.
1. Focus on directing the implementation of political tasks, linking the achievement of economic development targets and ensuring social welfare; closely combine with the tasks of strengthening and enhancing national defense and security, particularly in border provinces, western mountainous, central highland, and southwestern provinces; during the process of transitioning production and business models and adjusting regional planning, make practical contributions to enhancing the potential and defensive posture of localities.
2. Provinces and centrally governed cities focus on strengthening guidance in implementing the construction of comprehensive strong bases to meet the requirements of national defense and security tasks in the new situation according to Directive No. 36/2005/CT-TTg dated October 17, 2005 of the Prime Minister; Directive No. 07-CT/TW dated October 3, 2011 of the Central Committee of the Communist Party of Vietnam on strengthening leadership in implementing Resolution No. 28-NQ/TW of the Politburo (Xth Tenure) on continuing to build provinces and centrally governed cities into solid defensive zones in the new situation; Decree No. 152/2007/NĐ-CP dated October 10, 2007 of the Government and guiding documents on the construction and operation of defensive zones.
3. For central ministries and sectors, closely cooperate with the Ministry of National Defense and military regions, localities to direct and guide specialized tasks within their jurisdiction to effectively implement the construction, operation, and exercise of defensive zones of provinces and centrally governed cities; direct the deployment of the plan to ensure defense needs in the first year of war (Plan B) according to Directive No. 12/2008/CT-TTg dated March 26, 2008 of the Prime Minister; while directing agencies and units under their authority to actively participate in building defensive zones in localities where they are based.
4. Military regions and localities timely direct the review, adjustment, and supplementation of combat determination and defense battle plans in line with the situation and tasks; supplement and complete plans for constructing, mobilizing, and receiving reserve mobilization forces; industrial mobilization plans and material reserves for handling possible situations.
5. Functional agencies of the Ministry of National Defense closely cooperate with ministries, sectors, military regions, and localities to uniformly guide the implementation of surveys and the establishment of a system of national defense mobilization plans, primarily the plan to ensure defense needs in the first year of war; continue to thoroughly implement and guide the construction and implementation of mobilization work plans according to the decision of the Prime Minister.
Submit to the National Assembly for comments the Draft Law amending and supplementing the Law on Officers of the Vietnam People's Army amended and supplemented in 2008 and the Law on Military Service amended and supplemented in 2005 at the fifth session.
1. Functional agencies of the Ministry of National Defense take the lead and coordinate with relevant agencies and units inside and outside the military to assist the Ministry of National Defense in completing the Draft Law on National Defense and Security Education to report to the Government for submission to the National Assembly at its fourth session (XIIIth Tenure) for consideration and decision. Actively organize surveys and seminars to ensure the progress of drafting the Draft Law on the People's Army of Vietnam and the Draft Ordinance on National Defense Work in ministries, sectors, and localities.
2. The Military Regions, military agencies, and units complete the summary of legal documents on building the Vietnam People's Army as the basis for drafting the Law on the Vietnam People's Army in the first quarter of 2012. Complete regulatory legal documents guiding the implementation of Resolution No. 28-NQ/TW of the Politburo and Decree No. 152/2007/NĐ-CP of the Government on building defense areas in the first quarter of 2012.
3. Strengthen inspection and supervision work on the implementation of Decree No. 119/2004/NĐ-CP dated May 11, 2004 of the Government on national defense work in ministries, ministerial-level agencies, government-affiliated agencies, and localities according to the plan approved by the competent authority. Successfully organize inspections of the results of national defense work at the Vietnam Chemical Industry Group, the Vietnam National Oil and Gas Group; conduct comprehensive inspections of local national defense work in Lang Son Province/Military Region 1 and Khanh Hoa Province/Military Region 5. The General Staff Department shall take the lead and coordinate with relevant ministries, sectors, and localities to assist the Central Steering Committee for National Defense and Security Education in organizing inspections of national defense and security education work for the Military Region 1 Steering Committee, the Steering Committee for National Defense and Security Education in Thai Nguyen Province, Bac Ninh Province; the Ministry of Health, the Communist Party of Vietnam Central Propaganda Department, the Communist Youth Union of Vietnam Central Committee according to the 2012 Work Plan of the Central Steering Committee for National Defense and Security Education. The Office of the Ministry of National Defense shall organize inspections of national defense work at the Vietnam Railway Corporation, the Vietnam Social Security; the Office of the Central Steering Committee for National Defense and Security Education shall inspect national defense and security education work at the Steering Committee for National Defense and Security Education in Hai Duong Province/Military Region 3, Ninh Thuan Province/Military Region 5, Binh Thuan Province/Military Region 7, and Dong Thap Province/Military Region 9. Ministries, sectors, military units, and localities must strictly implement the system of meetings, reports, inspections, mid-term reviews, and final summaries of national defense work, militia self-defense work, and national defense and security education in accordance with the regulations of the Ministry of National Defense and the Government.
4. The Military Regions, ministries, sectors, and localities issue a set of leadership and directive documents, organize the implementation of national defense work within their respective jurisdictions and functions; simultaneously proactively determine plans and organize inspections of the implementation of national defense and military work of subordinate agencies and units within their functional scope, duties, and authorities; promptly compile results and report to the Ministry of National Defense through the Office of National Defense Work of the Ministry of National Defense (Department of Militia Self-Defense/General Staff Department).
Article 8. Ensuring the budget for national defense and military affairs
1. Ministries, sectors, and localities effectively carry out budget planning, implementation, and settlement to ensure funding for national defense work, militia self-defense work, and national defense and security education in accordance with the provisions of the State Budget Law; ensure timely budgeting according to the plan approved by the competent authority; inspect the implementation of standards, systems, and policies for forces participating in national defense and military work in accordance with legal provisions.
2. Functional agencies of the Ministry of National Defense, Commanders of Military Regions, Commander of the Hanoi Capital Military District, Military Committees of central ministries and sectors, and military agencies at all levels need to be proactive and actively provide advice to party committees, governments, and commanders at the same level to guide, supervise, and inspect budget planning, compliance, and settlement for the implementation of national defense and military tasks in ministries, sectors, and localities, ensuring principles, practical effectiveness, and economy.
Article 9. Effective Date
This Circular takes effect from January 1, 2012.
Article 10. Responsibility for Implementation
Heads of central ministries and sectors; Chairpersons of People's Committees at all levels; Heads of agencies and units under the Ministry of National Defense as stipulated in Article 2 of this Circular are responsible for directing and organizing the implementation thereof.
