NUMBER: 189 DATE: MAY 28, 1948

OF THE CHAIRMAN OF THE GOVERNMENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM

 

CHAIRMAN OF THE VIETNAMESE DEMOCRATIC REPUBLIC GOVERNMENT

Pursuant to Decree No. 13-SL dated February 3, 1947 prohibiting entry and exit throughout the territory of Vietnam;

Pursuant to Decree No. 29B/SL dated March 16, 1947 establishing the Foreign Trade Bureau;

Pursuant to Decree No. 53-SL dated June 1, 1947 restructuring the Foreign Trade Bureau;

Pursuant to Decree No. 82-SL dated September 17, 1947 amending penalties and procedures for prosecuting violations of foreign trade regulations;

At the proposal of the Minister of Economy;

After the Government Council and the Standing Committee of the National Assembly have agreed,

ISSUES THE DECREE:

Article 1

Now amend Article 7 of Decree No. 29-B/SL dated March 16, 1947 as follows:

"Article 7...

Clause b.- The inspection and prosecution of violations of foreign trade regulations shall be carried out according to the following procedures:

1- Customs officers and police will conduct inspections according to current procedures. In addition, whenever a violation is detected, authorized economic officials may directly inspect and prepare records according to regular procedures.

2- Violations will be prosecuted before ordinary courts if there is a complaint from authorized economic agencies.

The prosecutor will prosecute based on complaints from economic agencies.

Clause c.- Those who report and prepare records in the above cases, except for authorized economic officials who directly inspect, shall be entitled to a reward of 10% of the value of the confiscated goods, with the amount not exceeding 1,000 dong per case per person.

Article 2

All provisions in Decrees No. 29-B/SL dated March 16, 1947 and No. 82-SL dated September 17, 1947 that conflict with this decree are hereby repealed.

Article 3

Ministers of Economy, Finance, Interior, and Justice shall implement this decree accordingly.
