in southern provinces and cities

- Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government stipulating the tasks, powers, and responsibilities of ministries and ministerial-level agencies in state management;

GOVERNOR OF THE STATE BANK OF VIETNAM

- Pursuant to Decree No. 100/1998/NĐ-CP dated December 10, 1998 of the Government on the financial regime of the State Bank;

- Pursuant to Decree No. 88/1998/NĐ-CP dated November 2, 1998 of the Government stipulating the functions, powers, and organizational structure of the State Bank of Vietnam;

- Based on the proposal of the Director of the Organization and Training Department and the Director of the Foreign Exchange Management Department.

Now, we authorize the Director of the State Bank of Vietnam Branch in Ho Chi Minh City to implement certain foreign exchange management tasks in southern provinces and cities, specifically as follows:

Pursuant to …;

Article 1. 1. Issuing permits for individuals to purchase and transfer foreign currency abroad from Quang Tri Province inward.

2. Issuing permits for credit institutions engaged in foreign exchange operations with headquarters located from Quang Tri Province inward to export and import foreign currency cash.

3. Inspecting, reviewing, and signing confirmation of registration for foreign loans of export processing enterprises within the territory of Ho Chi Minh City in cases that comply with Circular No. 03/1999/TT-NHNN7 dated August 12, 1999 of the Governor of the State Bank of Vietnam guiding the implementation of Decree No. 90/1998/NĐ-CP dated November 7, 1998 of the Government promulgating the Regulation on foreign borrowing and repayment, consistent with current regulations of the Governor of the State Bank of Vietnam regarding loan terms, grace periods, and loan costs in each period. In addition to the aforementioned provisions, the Branch must transfer the files to the Head Office of the State Bank (Department of Foreign Exchange Management) for submission to the Governor of the State Bank for consideration and decision.

This Decision takes effect from February 1, 2001 and replaces Decision No. 26/1999/QĐ-NHNN7 dated January 13, 1999 of the Governor of the State Bank of Vietnam.

Article 2. The Directors of the Organization and Training Department, the Foreign Exchange Management Department, the Representative Office of the State Bank of Vietnam in Ho Chi Minh City, and the Director of the State Bank of Vietnam Branch in Ho Chi Minh City are responsible for implementing this Decision.

Article 3. The Director of the Cadre Organization and Training Department, the Director of the Foreign Exchange Management Department, the Director of the State Bank of Vietnam Representative Office in Ho Chi Minh City, and the Director of the Ho Chi Minh City Branch of the State Bank of Vietnam are responsible for implementing this Decision.
