DECREE NO. 19/2003/ND-CP ON THE RESPONSIBILITIES OF STATE ADMINISTRATIVE AUTHORITIES AT ALL LEVELS IN ENSURING THE PARTICIPATION OF THE ASSOCIATION FOR VIETNAMESE WOMEN IN STATE MANAGEMENT

DECREE OF THE GOVERNMENT

Article 1 provides for the responsibilities of administrative agencies at all levels

in ensuring that all levels of the Vietnam Women's Union participate in state management

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on the Front for Unity and Fatherland of Vietnam dated June 26, 1999;

Pursuant to Resolution No. 04 NQ/TW dated July 12, 1993 of the Politburo on reforming and strengthening women's mobilization work under new circumstances;

At the request of the Minister of Home Affairs,

DECREE:

Article 1.This Decree stipulates the responsibilities of the Ministries, ministerial-level agencies, agencies under the Government, People's Committees at all levels (hereinafter referred to collectively as administrative agencies at all levels) in coordinating and creating favorable conditions for all levels of the Vietnam Women's Union (hereinafter referred to collectively as the Women's Union) to participate in state management activities according to the law regarding issues related to women's rights and interests.

Article 2. Administrative agencies at all levels shall be responsible for coordinating and creating favorable conditions for the same level Women's Union to participate in state management activities related to women and children as follows:

1.Inviting representatives of the same level Women's Union to participate in discussions or sending draft documents for the Women's Union to provide comments when drafting, revising, or supplementing legal regulatory documents; when drafting or supplementing economic and social development programs, plans, maintaining political security, social order and safety, and policies related to women and children.

2.Inviting representatives of the same level Women's Union to participate as formal members in advisory organizations for the same level administrative agencies (Councils, Committees, Steering Boards, Management Boards) on issues related to women and children such as: labor resolution, employment, living conditions, health, land, housing, rewards and punishments, training, development, utilization, and appointment, dismissal of officials and civil servants holding leadership and management positions.

3.Regularly organizing meetings with the same level Women's Union to collect opinions on the implementation of policies, laws, and the discovery of violations infringing upon the legitimate and just rights and interests of women and children to address them promptly.

4.Inviting representatives of the same level Women's Union to participate in inspection teams for issues related to the rights and interests of women and children. The inspected agencies and units shall be responsible for providing necessary data and materials related to the inspection work.

Article 3. Administrative agencies at all levels shall be responsible for creating favorable conditions for the activities of all levels of the Women's Union such as financial support, working conditions and means, fundraising activities, production and service organization, supporting women in resolving social issues related to women's advancement and equality in accordance with state laws and policies.

Article 4Regular working time between administrative agencies at all levels and all levels of the Women's Union each year is as follows:

1.Once every six months, leaders of Ministries, ministerial-level agencies, and agencies under the Government meet with the Women's Affairs Committee of the agency trade union and industry trade union to discuss the implementation of regulations and policies and proposals from the Women's Affairs Committee on issues related to women's rights within their jurisdiction.

2.Once every six months, leaders of provincial and centrally-administered city People's Committees; once every three months, leaders of district and commune People's Committees meet with the Standing Committee of the same level Women's Union to discuss the activities of the Women's Union, the implementation of laws and policies, and proposals from the Women's Union on issues related to women and children; reviewing the implementation of this Decree, while discussing and developing cooperation plans for subsequent activities.

Article 5. The inspection and evaluation of the implementation of this Decree is conducted regularly as follows:

1.Once a year at the district and commune level. District reports are sent to the provincial People's Committee, commune reports are sent to the district People's Committee.

2.Every two years at the Ministry and provincial level, and reports are sent to the Ministry of Home Affairs.

3.Every five years, the Ministry of Home Affairs will cooperate with the Vietnam Women's Union to conduct a comprehensive review and assessment of the implementation of this Decree nationwide.

Article 6.This Decree takes effect fifteen days after its publication in the Official Gazette and replaces Decision No. 163/HĐBT dated October 19, 1988 of the Council of Ministers on the responsibilities of all levels of government in ensuring the participation of all levels of the Vietnam Women's Union in state management.

The Ministry of Home Affairs shall be responsible for guiding, inspecting, compiling, and reporting to the Government on the implementation of this Decree.
