Pursuant to Decree No. 43/2003/NĐ-CP dated May 2, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Fisheries;

Pursuant to Decision No. 844/QĐ-TTg dated August 5, 2004 of the Prime Minister on the establishment of the North Central Sea Fisheries Resource Exploitation and Protection Agency;

Upon consideration of the proposal of the Director of the Organization and Cadres Department and the Director of the Fisheries Resource Exploitation and Protection Department,

DECISION:

Article 1. Functions

The North Central Sea Fisheries Resource Exploitation and Protection Agency (hereinafter referred to as the Agency) under the Fisheries Resource Exploitation and Protection Department, Ministry of Fisheries is the specialized agency for state management in the field of fisheries resource exploitation and protection within the jurisdiction of the Fisheries Resource Exploitation and Protection Department in the coastal areas from Quang Ninh to Thua Thien Hue according to the law.

The Agency has legal personality, its own seal, and is entitled to open accounts at banks and State Treasury.

The headquarters of the Agency is located in Haiphong City.

Article 2. Tasks and Authorities

1. Implement regulatory legal documents according to assigned functions and tasks.

2. Manage, inspect, and supervise activities related to fisheries resource exploitation and protection in the sea area within the assigned scope.

3. Manage marine conservation zones with boundaries spanning two provinces or more, and inspect and monitor the natural living environment protection of aquatic species within the assigned management scope.

4. Carry out issuance and revocation of fishing permits; vessel inspection and registration, and crew registration according to the assignment of the Fisheries Resource Exploitation and Protection Department and relevant laws.

5. Inspect compliance with legal provisions regarding fish ports, fish landing sites, and anchorage areas for fishing vessels according to the assignment of the Fisheries Resource Exploitation and Protection Department.

6. Serve as the focal point for specialized information work; conduct specialized statistics, apply information technology in management, implement regular and ad hoc reporting systems as directed by the Fisheries Resource Exploitation and Protection Department;

Coordinate with relevant agencies to carry out disaster prevention and rescue operations in the sea area under the assigned management scope.

7. Manage, inspect, and supervise activities related to fisheries resource exploitation and protection in the buffer zone for small fishing boats at the Northern Luân River estuary, transitional waters, and shared fishing grounds in the Gulf of Tonkin according to the Vietnam-China Fisheries Cooperation Agreement and other international treaties to which Vietnam is a party.

8. Coordinate with competent authorities to resolve disputes and handle violations of laws concerning fisheries resource exploitation and protection within the assigned management scope according to the law.

9. Perform other tasks assigned by the Director of the Fisheries Resource Exploitation and Protection Department.

Article 3. Organizational Structure

The Agency shall have an Agency Director and not more than two Deputy Directors. The Agency Director is responsible for all activities of the Agency; Deputy Directors are responsible for the fields of work assigned by the Agency Director. Officials, staff, and inspectors perform their professional duties according to the assignments of the Agency Director.

- The organizational structure of the Agency includes:

- General Affairs Office (implementing organizational, administrative, financial, information dissemination, and publicity tasks);

- Technical Operations Office;

- Fisheries Resource Protection Inspectorate;

- Fisheries Surveillance Vessel Team.

The staffing of the Agency is assigned by the Director of the Fisheries Resource Exploitation and Protection Department based on the staffing of the Department. Additionally, the Agency may recruit contractual laborers to serve as crew members on surveillance vessels as required by the mission.

Article 4. Effective date

This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

Article 5. Responsibilities for Implementation

The Director of the Fisheries Resource Exploitation and Protection Department is responsible for coordinating with relevant agencies and units to develop and promulgate the operational regulations of the Agency.

The Head of the Ministry's Office, the Director of the Fisheries Resource Exploitation and Protection Department, Heads of Departments, Inspectors General, Heads of subordinate units of the Ministry, Directors of Fisheries Departments, and Directors of Agriculture and Rural Development Departments managing fisheries, and the Director of the North Central Sea Fisheries Resource Exploitation and Protection Agency are responsible for implementing this Decision.
