Regarding the issuance of the Standards for Directors of Provincial Science and Technology Departments
under centrally governed cities
THE MINISTER OF SCIENCE AND TECHNOLOGY
Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/NĐ-CP;
Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
After reaching consensus with the Ministry of Home Affairs on the issuance of the standards for Directors of Provincial Science and Technology Departments;
At the proposal of the Director of the Cadre Organization Department,
DECISION:
Article 1. The attached Decision hereby promulgates the Standards for Directors of Provincial Science and Technology Departments under centrally governed cities.
Article 2. Provincial People's Committees under centrally governed cities shall base themselves on these standards to implement the use, training, development, and appointment of the position of Director of Provincial Science and Technology Departments.
Article 3. This Decision takes effect fifteen days from the date of publication in the Official Gazette, replacing Decision No. 687/QĐ dated November 29, 1993 of the Minister of Science, Technology, and Environment (now the Ministry of Science and Technology) regarding the issuance of the professional standards for Directors of Provincial Science and Technology Departments.
Article 4. Chairmen of Provincial People's Committees under centrally governed cities; Heads of the Cadre and Civil Service Organization Department shall be responsible for implementing this Decision.

STANDARDS FOR DIRECTORS OF PROVINCIAL SCIENCE AND TECHNOLOGY DEPARTMENTS
UNDER CENTRALLY GOVERNED CITIES

PART I
GENERAL PROVISIONS
Article 1. The Director of the Provincial Science and Technology Department is a civil servant heading the Provincial Science and Technology Department, responsible for leading, directing, managing, and overseeing the operations of the Department, advising and assisting the Provincial People's Committee in performing state management functions in science and technology according to the law within the province.
Article 2. The Director of the Provincial Science and Technology Department is accountable to the Chairman of the Provincial People's Committee, and simultaneously accountable to the Minister of Science and Technology and the law regarding the results of the Department's activities based on its functions and tasks, and the delegation of authority by the Provincial People's Committee and the Ministry.
Chapter II
SPECIFIC PROVISIONS
Article 3. Duties:
1. Organize the drafting and submission to the Provincial People's Committee for promulgation of provincial regulatory documents on science and technology, development of scientific and technological potential, standardization - measurement - quality, intellectual property, radiation and nuclear safety. Propose to competent authorities the amendment of regulatory documents, mechanisms, and policies within the scope of specialized management.
2. Organize the drafting and submission to the Provincial People's Committee for approval of planning and five-year plans, annual plans, and tasks related to science and technology, development of scientific and technological potential, standardization - measurement - quality, intellectual property, radiation and nuclear safety, consistent with the direction of economic and social development of the province.
3. Organize guidance and inspection of the implementation of regulatory documents, mechanisms, and policies already promulgated; planning, plans, and tasks after approval.
4. Organize research and propose to the Ministry of Science and Technology national-level science and technology tasks with inter-sectoral and regional relevance to serve the economic and social development of the province.
5. Organize the compilation, statistics, archiving, and reporting of science and technology information; implement science and technology information work, providing information on scientific research achievements and technological development innovations, production improvement initiatives both within and outside the locality to serve the needs of economic and social development of the province.
6. Organize the dissemination, popularization, and education of laws on science and technology within the province.
7. Direct and guide professional operations for local functional agencies; train management skills in science and technology for cadres engaged in science and technology management within the province.
8. Perform the duties of the permanent office of the Provincial Science and Technology Council; participate as a member in various Steering Committees, Review Boards, Examination Boards, Selection Boards, Evaluation Boards, and Acceptance Boards at the provincial level concerning tasks related to science and technology activities in the locality.
9. Organize oversight of science and technology inspections; take the lead or coordinate in resolving complaints, appeals, and accusations according to the law, promptly identifying deficiencies and violations at the grassroots level to take corrective measures, thereby enhancing the effectiveness of state management in science and technology within the province.
10. Organize reviews, summaries, and evaluations of science and technology activities' outcomes, proposing innovative solutions for management work. Coordinate with relevant levels and agencies within the province to implement measures to promote creative movements in applied research and the transfer of scientific and technological advancements into production and daily life.
11. Manage the organization, staff, civil servants, officials, and workers of the Department. Study, propose, and recommend to the Chairman of the Provincial People's Committee the establishment, merger, division, or dissolution of subordinate organizations in accordance with the Department's functions, tasks, and assigned staffing. Manage and utilize financial resources and assets effectively in accordance with regulations.
Article 4. Qualities:
1. Firm political conviction, absolute loyalty to revolutionary ideals, Marxism-Leninism, and Ho Chi Minh Thought; steadfast adherence to the reform path, national independence, and socialism of the Party, devoted service to the people.
2. Independent thinking, passionate about organizing and applying science and technology to production and daily life. Work with high responsibility, efficiency. Leadership style is thorough, specific, decisive, and willing to take responsibility.
3. Thrifty, honest, impartial; not corrupt and resolutely combat corruption and waste; truthful, straightforward, with a spirit of self-criticism and criticism. Democratic, united, sincere with colleagues and subordinates, trusted by the collective.
4. Strong sense of organizational discipline, exemplary compliance with laws and state regulations, internal rules, and institutional guidelines.
Article 5. Competencies:
1. Possess advisory capacity and organizational capability to implement the Party's, State's, and local policies on science and technology, and to develop scientific and technological potential within the province.
2. Have the ability to direct research activities, draft regulatory legal documents, propose management solutions and methods regarding science and technology, and develop scientific and technological potential within the province to serve the provincial People's Committee’s state management activities on science and technology.
3. Possess management and operational capabilities, the ability to gather officials and civil servants within the department to fulfill assigned tasks, and coordinate with relevant levels and agencies within the province to execute assigned tasks.
Article 6. Understanding:
1. Proficiently understand the economic and social development policy and the Party's viewpoints, policies, and the State's laws on science and technology development. Be knowledgeable about the economic and social situation, be well-informed about production conditions and technological levels of major industries within the province.
2. Understand the political, economic, and social situations, achievements, and trends in the development of science and technology, significant scientific and technological advancements both domestically and internationally related to production and socio-economic development orientation of the province.
3. Have knowledge of general laws, be proficient in regulatory legal documents concerning the management of science and technology activities and local regulatory legal documents. Have experience in organizing and managing science and technology activities.
Article 7. Qualifications:
1. Meet the professional standards from the level of Senior Specialist and equivalent or higher.
2. Graduated from a university in a relevant field of science and technology.
3. Graduated from advanced theoretical politics program or state administrative management program for Senior Specialist level.
4. Proficiently use a common foreign language at level C.
5. Completed training programs for state management in science and technology.
6. Proficiently use computers and office equipment for work purposes.
Article 8. Other Conditions:
1. Have at least five years of work experience in the field, including at least three years in science and technology management.
2. The initial appointment age shall not exceed fifty-five years for males and fifty years for females.
3. Be in good health to fulfill job responsibilities./.
