REGARDING THE MANAGEMENT OF SUGAR IMPORTS IN 2006

BASED ON DECREE NO. 29/2004/NĐ-CP OF JANUARY 16, 2004, ISSUED BY THE GOVERNMENT, PROVIDING THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF TRADE;

BASED ON THE GUIDANCE OF THE PRIME MINISTER IN DOCUMENT NO. 17/TTg-KTTH OF APRIL 13, 2006, CONCERNING SUGAR IMPORTS IN 2006;

AFTER CONSULTATION WITH THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT, THE MINISTRY OF INDUSTRY AND OTHER RELEVANT MINISTRIES AND SECTORS;

AT THE PROPOSAL OF THE DIRECTOR OF THE DEPARTMENT OF FOREIGN TRADE.

Article 1. IMPORTED RAW SUGAR BELONGING TO SUBHEADING 1701 OF THE CURRENT MOST-FAVORED-NATION IMPORT TARIFF, INTENDED FOR DOMESTIC PRODUCTION AND CONSUMPTION IN 2006, SHALL BE CONDUCTED UNDER LICENSES ISSUED BY THE MINISTRY OF TRADE.

Article 2. BASED ON THE TOTAL QUANTITY OF SUGAR TO BE IMPORTED IN 2006 ANNOUNCED BY THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT, THE MINISTRY OF TRADE SHALL ISSUE IMPORT LICENSES FOR RAW SUGAR AS FOLLOWS:

1. ALLOCATE 30% OF THE QUANTITY OF SUGAR TO BE IMPORTED TO SUGAR MILLS FOR IMPORTING RAW SUGAR FOR DIRECT PRODUCTION; THE QUANTITY AND TIME PERIOD WILL BE ANNOUNCED BY THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT AFTER DISCUSSION WITH THE VIETNAM SUGARCANE AND SUGAR ASSOCIATION.

2. ALLOCATE 30% OF THE QUANTITY OF SUGAR TO BE IMPORTED TO ENTERPRISES FOR USE AS RAW MATERIALS IN PRODUCTION; THE QUANTITY AND TIME PERIOD WILL BE ANNOUNCED BY THE MINISTRY OF INDUSTRY.

3. ALLOCATE 30% OF THE QUANTITY OF SUGAR TO BE IMPORTED TO TRADING ENTERPRISES. THE MINISTRY OF TRADE SHALL ISSUE IMPORT LICENSES FOR RAW SUGAR TO SEVEN KEY ENTERPRISES BASED ON THE PROPOSALS OF THE PEOPLE'S COMMITTEES OF THE FOLLOWING CITIES AND MINISTRIES:

- HA NOI CITY: ONE ENTERPRISE

- HO CHI MINH CITY: TWO ENTERPRISES

- HAI PHONG CITY: ONE ENTERPRISE

- DA NANG CITY: ONE ENTERPRISE

- MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT: ONE ENTERPRISE

- MINISTRY OF TRADE: ONE ENTERPRISE

4. RESERVE 10% OF THE QUANTITY OF SUGAR TO BE IMPORTED FOR EMERGENCY USE TO INTERVENE IN THE MARKET WHEN NECESSARY.

Article 3. RAW SUGAR BELONGING TO SUBHEADING 1701 OF THE CURRENT MOST-FAVORED-NATION IMPORT TARIFF, IMPORTED FOR EXPORT PRODUCTION AND TO EXECUTE CONTRACTS FOR FOREIGN EXPORT PROCESSING, DOES NOT REQUIRE A LICENSE FROM THE MINISTRY OF TRADE. IMPORT PROCEDURES AND TAX CLEARANCE SHALL BE HANDLED BY CUSTOMS AUTHORITIES IN ACCORDANCE WITH CURRENT REGULATIONS.

Article 4. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER ITS PUBLICATION IN THE OFFICIAL GAZETTE./.
