Pursuant to Decree No. 77/2003/ND-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decree No. 131/2006/ND-CP dated November 9, 2006 of the Government promulgating the regulations on management and use of official development assistance funds;

Pursuant to Decision No. 181/2007/QD-TTg dated November 26, 2007 of the Prime Minister promulgating the regulations on lending from official development assistance funds provided by the government;

Article 1. Abolish Circular No. 40/2005/TT-BTC dated May 25, 2005 of the Ministry of Finance guiding the financial mechanism applicable to clean water supply projects using official development assistance funds (ODA).

Article 2. All clean water supply projects using ODA funds approved by the Prime Minister in the Official Development Assistance Request List (as stipulated in Article 9 of Decree No. 131/2006/ND-CP dated November 9, 2006 of the Government promulgating the regulations on management and use of official development assistance funds) from December 18, 2007 (the date Decision No. 181/2007/QD-TTg dated November 26, 2007 took effect): shall apply the mechanism of relending from the state budget according to the conditions for relending prescribed in Decision No. 181/2007/QD-TTg dated November 26, 2007.

Article 3. Clean water supply projects using ODA funds that continue to apply the conditions for relending prescribed in Circular No. 40/2005/TT-BTC dated May 25, 2005 include:

a) Clean water supply projects that have been approved to apply the conditions for relending prescribed in Circular No. 40/2005/TT-BTC dated May 25, 2005;

b) Clean water supply projects that have been approved by the Prime Minister in the Official Development Assistance Request List before December 18, 2007.

Article 4. This Decision takes effect 15 days after its publication in the Official Gazette.

Article 5. Ministries, ministerial-level agencies, agencies under the Government, People's Committees of provinces and centrally governed cities, and units under the Ministry of Finance are responsible for implementing this Decision./.
