Provisions on civil aviation meteorology

Pursuant to the Civil Aviation Law of Vietnam 2006;
Pursuant to Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
The Minister of Transport shall stipulate provisions on civil aviation meteorology as follows:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. These Circulars specify the content of meteorological services for civil aviation; provision and use of meteorological services for civil aviation; technical systems, equipment, meteorological instruments, communication means; bases providing meteorological services for civil aviation, civil aviation meteorological staff; responsibilities of organizations and individuals involved in the field of civil aviation meteorology.
2. These Circulars apply to airlines, aircraft operators, enterprises participating in the provision of meteorological services for civil aviation, bases providing meteorological services for civil aviation, civil aviation meteorological staff, and other organizations and individuals related to the field of civil aviation meteorology.
Article 2. Abbreviations
In this Circular, the following abbreviations shall be understood as follows:
1. ACC (Area Control Center): Long-range control center.
2. ADS (Automatic Dependent Surveillance): Automatic dependent surveillance.
3. AD WRNG (Aerodrome Warning): Weather warning telegram for airports.
4. AFTN (Aeronautical Fixed Telecommunication Network): Fixed aeronautical information network.
5. AIC (Aeronautical Information Circular): Aeronautical information circular.
6. AIP (Aeronautical Information Publication): Aeronautical information publication.
7. AIREP (Air Report): Report from aircraft.
8. APP (Approach Control Unit): Approach control unit.
9. ATIS (Automatic Terminal Information Service): Automatic terminal information service (broadcast by voice).
10. AUTO (Automatic): Automatic mode.

Article 3. Explanation of Terms
Strategic multi-purpose hydropower plant
1. Air report (Airep): A report from an aircraft in flight complying with requirements for position reporting, operational status, or weather conditions.
2. High-level weather map - Isobaric surface chart (AT): A weather map at standard isobaric surfaces showing observed meteorological data at those surfaces.
3. Weather forecast map (Prognostic weather chart): A map showing meteorological elements forecasted to occur within a specified period of time by meteorological forecasters.
4. Surface weather map (Surface Wx chart): A weather map showing observed meteorological data from the surface.
5. Meteorological report (Met. Report): A report on observed meteorological conditions at a specific time and location.
6. Alternate airport: An airport where an aircraft may land if it cannot land at the intended destination airport.
7. Airport category (Category): Classification of airports based on approach and landing aids. Category I (CAT I) corresponds to an airport equipped with precision approach systems ensuring operations with a decision height of 60 meters and runway visual range of 550 meters (or horizontal visibility of 800 meters). Category II (CAT II) corresponds to a decision height of 30 meters and runway visual range of 350 meters (or horizontal visibility of 400 meters). Category III (CAT III) corresponds to a decision height below 30 meters and runway visual range below 200 meters.
8. Controlled flight: A flight provided air traffic control service.
9. Height: The vertical distance between a defined reference point and another point, a level, or an object considered as a point.
10. Forecast: Meteorological conditions expected to occur at a specific time or during a defined period for a specified area or portion of airspace.
11. : Reporting point (ATS/MET): Geographic location designated for aircraft to report their position.
12. : Aeronautical NOTAM (Notice to Airmen): Telegram related to the establishment, status, or change of any navigational aid, service, method, or degree of hazard associated with air operations.
13. : Altitude: Vertical distance from mean sea level to a point, a level, or an object considered as a point.
14. : ATS Route (Air Traffic Services Route): Established route designed to direct air traffic flows to ensure air traffic services.
15. : General Aviation: Operations using aircraft to conduct flights in industrial, agricultural, forestry, fishing, construction, and other economic sectors, serving search and rescue, emergency medical services, disaster relief, health services, scientific research, cultural, sports, training, calibration flights, surveying, photography, filming, personal flights, and other non-commercial civil aviation activities not aimed at public passenger, baggage, cargo, mail, parcel, or letter transportation.
16. : Flight Documentation: Written or printed material containing meteorological information for a flight.
17. : World Area Forecast System: Global centers WAFC provide uniform aerodrome weather forecasts along routes.
18. : Flight Plan: Information provided to the Air Traffic Service Unit regarding a planned flight.
19. : Operational Planning: Plan for flight operations prepared by the aircraft operator.
20. : Operational Flight Plan: Plan prepared by the aircraft operator based on consideration and evaluation of airport conditions, operational limits, and expected weather conditions along the route and at relevant airports.
21. : Vicinity: Area outside the airport boundary, extending up to 8 kilometers from the airport boundary.
22. : Fixed Aviation Telecommunication Network (AFTN): Global telecommunications system providing a part of fixed aeronautical information services including the exchange of telegrams or data between ground stations.
23. : Flight Level: Pressure altitude referenced to a standard pressure surface of 1013.2 hPa and adjusted for variations in atmospheric pressure.
24. : Cruising Level: Flight level maintained throughout the duration of a flight.
25. : MET Personnel: Individual employed by an enterprise providing civil aviation meteorological services.
26. : VOLMET Broadcast: Radio broadcast regularly transmitting meteorological information for long-distance aircraft.
27. : ATS Reporting Office: Air Traffic Service Unit receiving reports related to air traffic services and flight plans. The ATS Reporting Office may be established separately or combined with the Air Traffic Service Unit or the Aeronautical Information Service Unit.
28. : Briefing Met. Office: Place where the Meteorological Service Unit displays meteorological documents for pilots to study and listen to weather briefings.
29. : MET Observation: Evaluation of one or more meteorological elements by equipment or visually by meteorological observers.
30. : Aircraft Observation: Evaluation of one or more meteorological elements from an aircraft in flight by the pilot-in-command or a navigator.
31. : Runway Visual Range: Distance that a pilot on the runway centerline can see runway markings, edge lights, or centerline lights.
32. : Visibility: Horizontal meteorological visibility is defined as follows:
a) The greatest distance at which a black object of recognizable size against a bright sky background can be seen and identified;
b) The greatest distance at which a light source of 1000 candelas within the vicinity can be seen and identified against a dark sky background.
33. : Prevailing Visibility: Value representing the majority of the horizontal circle or half the surface of the airport, which may consist of continuous or discontinuous areas.
34. : Aeronautical Information Publication (AIP): Document issued by the national civil aviation authority or authorized Air Navigation Service Provider; it includes necessary information for flight operations.
35. : SIGMET Notice: Warning issued by the Meteorological Watch Office concerning the occurrence or expected occurrence of significant weather phenomena along routes potentially threatening flight safety.
36. : MET Information: Includes observed data, analysis, and forecasts relating to current or expected weather conditions.
37. : Briefing: Oral explanation of current or expected weather conditions.
38. : Aeronautical Met. Station: Air Navigation Service Provider responsible for conducting meteorological observations and reporting weather conditions at airports and in the vicinity.
39. : Aeronautical Telecommunication Station: Station serving aeronautical information services.
40. : World Area Forecast Centre: Designated meteorological center preparing and providing high-level forecasts in numerical form for regional forecast centers.
41. : Consultation: Exchange of views between meteorological forecasters and aircraft operators or flight crews regarding current or expected weather conditions affecting flight operations.
42. : Regional Air Navigation AgreementThe agreement document is approved by the ICAO Council based on the recommendations of the group establishing and implementing the Asia-Pacific Regional Plan for Air Navigation (APANPIRG).
43. Flight Information Region (FIR): A defined airspace area wherein flight information service and alerting service are provided.
44. Law: refers to Vietnamese law and international treaties to which the Socialist Republic of Vietnam is a member.
Chapter II
CONTENTS OF AIRPORT WEATHER SERVICES
Section 1
OBSERVATION AND REPORTING OF WEATHER
Article 4. General Provisions
1. Weather observation stations established at airports have the responsibility to observe and measure meteorological elements and weather phenomena in the airport area; prepare weather reports serving aircraft takeoffs and landings and other aviation operations.
Regular weather observation and reporting to serve aircraft takeoffs and landings, broadcast ATIS or D-ATIS; METAR for exchange, flight planning, broadcast VOLMET or D-VOLMET;
2. At international airports, weather observation and reporting are conducted regularly every 30 minutes continuously 24 hours a day.
3. At domestic airports, weather observation and reporting are conducted continuously from 2200 UTC to 1100 UTC daily as follows:
a) At domestic airports, weather observation and reporting are conducted regularly every 30 minutes continuously from 2200 UTC to 1100 UTC;
b) For airports equipped with night lighting systems or conducting night flights, weather observation and reporting are organized according to flight schedules.
Weather observation stations are responsible for promptly providing complete METAR weather bulletins to airport control towers (TWR) and related airports.
Article 5. Contents of Observation and Reporting
1. Surface wind observation:
a) The direction and speed recorded in the bulletin represent the actual value at a height of 10 meters above the runway surface;
b) Wind values measured along the runway used for takeoff; wind values measured in the landing area used for landing; wind values measured along the runway used for the METAR bulletin;
c) Wind direction and speed are the average values observed over two minutes for takeoff bulletins and over ten minutes for METAR bulletins;
d) Wind direction is rounded to the nearest ten degrees and wind speed is recorded in knots (kt).0 2. Meteorological horizontal visibility (MOR), runway visual range (RVR) observation:
a) MOR values measured along the runway used for takeoff; MOR values measured in the landing area used for landing; MOR values measured in the airport area used for the METAR bulletin;
b) RVR values measured in the landing area are used at airports implementing precision approach procedures with Category I runway lighting systems; RVR values measured in the landing area and midpoint of the runway are used at airports implementing precision approach procedures with Category II standards; RVR values measured in the landing area, midpoint, and end of the runway are used at airports implementing precision approach procedures with Category III standards;
c) RVR is determined using measuring instruments and practical observation methods;
d) At airports without RVR measuring instruments, visibility determination is carried out visually based on established horizontal visibility reference points.
3. Weather phenomenon observation: weather phenomena characteristic of the airport area used for aircraft takeoffs and landings; weather phenomena characteristic of the airport and surrounding areas used for the METAR bulletin.
4. Cloud observation:
a) Cloud observation in the approach area used for aircraft takeoffs and landings; cloud characteristics for the airport and surrounding areas used for the METAR bulletin;
b) At airports without cloud measuring instruments, cloud quantity, type, and base height are determined visually by observers.
5. Air temperature and dew point temperature observations are rounded to the nearest whole number.
6. Atmospheric pressure: Altimeter setting (QNH) and field elevation pressure (QFE) are rounded down to the nearest whole hPa. 0- Desiccator.
7. Supplementary observation: Observation of hazardous weather phenomena in the approach area and altitude acquisition zone.
a) The content of regular weather bulletins and special weather bulletins is presented in common language using abbreviations and aviation meteorology METAR code formats;
8. Reporting:
b) At airports with automatic weather observation and reporting systems but not operating at night, the term AUTO may be used in METAR bulletins.
b) At airports with an automatic weather observation and reporting system but not operational at night, the term "AUTO" may be used in METAR reports.
Article 6. Weather Observation and Reporting from Aircraft
1. Aircraft conducting takeoff and landing at airports and aircraft flying within the airspace under the responsibility of Air Traffic Control Services (ATC) have the responsibility to perform regular and special weather observations and reports as follows:
a) Regular weather observations and reports from aircraft are conducted at designated reporting points for air traffic services/meteorology (ATS/MET) along the flight path and during the initial climb phase.
b) Special weather observations and reports from aircraft are conducted at any time when encountering dangerous weather phenomena during the flight, including atmospheric turbulence, icing, strong mountain waves, thunderstorms with or without hail, strong dust storms or sandstorms, volcanic ash clouds, active volcanoes; in the case of supersonic or subsonic aircraft, the report must include observations on moderate turbulence, hail, and convective clouds.
2. Regular weather reports from aircraft in flight are transmitted through data link communications between aircraft and ground or voice communication.
3. The methods of reporting from aircraft are as follows:
a) When using data link communications and applying Automatic Dependent Surveillance (ADS), weather observations from aircraft are automatically performed every 15 minutes along the flight path and every 30 seconds during the first 10 minutes of the climb phase of the flight;
b) When using voice communication, regular weather observations and reports from aircraft are conducted at designated ATS/MET reporting points specified by the Civil Aviation Administration.
4. In cases where dangerous weather phenomena that may threaten flight safety or reduce the operational efficiency of other aircraft are detected, the flight crew will promptly conduct observations and notify the ATC Service controlling the flight.
5. In the event of volcanic activity, the flight crew is responsible for conducting special observations and completing the VAR form after the flight to be included in the meteorological records.
6. After receiving reports from aircraft, ATC Services have the responsibility to immediately transfer them to the ATC Services providing weather warnings in Vietnamese airspace and international flight information regions managed by Vietnam.
Section 2
WEATHER FORECASTS AND WARNINGS
Article 7. General Provisions
Meteorological ATC Services at international airports and ATC Services providing weather warnings in Vietnamese airspace and international flight information regions managed by Vietnam provide weather forecasting and warning services for civil aviation activities; the scope of airspace responsibility for issuing weather forecasts and warnings includes airspace covering airports, airfields, and Vietnamese airspace and international flight information regions managed by Vietnam.
Article 8. Weather Forecast and Warning Bulletins
Weather forecast and warning bulletins include:
1. Airport and airfield weather forecasts (TAF, TAF AMD).
2. Landing forecasts.
3. Takeoff forecasts.
4. En route and area weather forecasts.
5. Significant Meteorological Information (SIGMET).
6. Airport and airfield weather warnings (AD WRNG).
7. Low-level wind shear warnings (WS WRNG).
Article 9. Airport and Airfield Weather Forecasts (TAF, TAF AMD)
1. Meteorological ATC Services at international airports are responsible for preparing and issuing TAF and TAF AMD forecast bulletins.
2. The issuance time and validity period of TAF forecast bulletins for international airports are as follows:
a) TAF forecasts with a 24-hour or 30-hour validity period (long TAF) are prepared four times a day starting at 0000, 0600, 1200, and 1800 UTC;
b) The preparation and issuance of TAF forecasts should be completed one hour before the start of their validity period.
3. The issuance time and validity period of TAF forecast bulletins for domestic airports and airfields are as follows:
a) TAF forecasts with a nine-hour validity period (short TAF) are prepared three times a day starting at 0000, 0300, and 0600 UTC; the preparation and issuance should be completed one hour before the start of their validity period; for airports and airfields with night operations, TAF forecasts are prepared according to the flight schedule;
b) The validity period of TAF forecasts covers the time from the departure of the first flight until three hours after takeoff.
4. Meteorological ATC Services at international airports must prepare supplementary forecast bulletins (TAF AMD) immediately upon detecting or determining that the weather will change significantly and reach threshold criteria different from the newly issued TAF bulletin.
5. The content, format, and criteria for forecasting changes in weather elements in TAF and TAF AMD forecast bulletins are based on airport and airfield weather forecasting regulations, aviation meteorological skills, and coordination among air traffic services, aeronautical information services, and aviation meteorological services.
Article 10. Landing Forecast
1. The meteorological service at international airports and domestic airport terminals shall be responsible for preparing the TREND forecast bulletin to serve aircraft landings.
2. The content, format, and criteria for forecasting weather factors changes in the TREND forecast bulletin shall comply with the regulations on reporting regular, special weather bulletins, and aviation meteorology skills.
Article 11. Takeoff Forecast
The meteorological service at international airports shall be responsible for preparing the takeoff forecast bulletin according to the requirements of the flight crew and air traffic control personnel of airlines to serve aircraft takeoffs. The meteorological service at domestic airports and terminal airports shall coordinate with the meteorological service at related international airports to prepare the takeoff forecast bulletin when requested.
Article 12. Weather Forecast Along Flight Routes and Airspace Areas
Weather forecasts along flight routes and airspace areas include high-altitude wind forecasts, high-altitude temperature forecasts, hazardous weather phenomena along flight routes, and convective clouds. Based on the forecast data received from the WAFC center, the meteorological service at international airports will establish and provide flight route and airspace area weather forecast bulletins to the flight crew, air traffic control services, and other users. The meteorological service shall be responsible for preparing supplementary weather forecast bulletins for flight routes and airspace areas when it determines that there are differences with newly issued forecast bulletins.
Article 13. Airport Weather Warning (AD WRNG)
1. An airport weather warning is a brief notification about dangerous meteorological conditions affecting aircraft, technical systems, equipment, and facilities on the ground, and airport services.
2. The meteorological service at international airports shall be responsible for issuing weather warnings (AD WRNG) for that international airport and related domestic airports and terminal airports when tropical cyclone vortices, thunderstorms, hail, strong winds, gusts, tornadoes, or other dangerous weather phenomena are observed or forecasted to occur.
Article 14. Low-Level Wind Shear Warning (WS WRNG)
1. A low-level wind shear warning is a brief notification about the occurrence or expected occurrence of wind shear between the surface of the runway and a height of 500 meters; this phenomenon can adversely affect aircraft during the initial climb phase or while circling to approach landing.
2. Methods for preparing low-level wind shear warning bulletins:
a) The low-level wind shear warning is provided to the airport control tower and approach control service through the "additional information" section at the end of the METAR weather bulletin or established as a separate bulletin when wind shear is detected by radar, wind measuring instruments, or reports from aircraft in flight;
b) The content and methods for preparing low-level wind shear warning bulletins at international airports and related domestic airports and terminal airports shall be carried out according to agreements between the meteorological service and air traffic control services in accordance with meteorological laws and regulations.
3. The airport control tower and approach control service shall be responsible for:
a) Immediately transmitting low-level wind shear warning bulletins received from the meteorological service at international airports and domestic airports and terminal airports to aircraft performing approach landings or initial climb takeoffs;
b) Immediately transmitting wind shear reports received from aircraft performing approach landings or initial climb takeoffs to the relevant meteorological service.
Article 15. SIGMET Notification
The Civil Aviation Meteorological Service Center (CSCCDV) responsible for weather warnings in the airspace of Vietnam and the international flight information region managed by Vietnam must continuously monitor and supervise weather conditions in their respective areas 24/24 hours, promptly detect and issue SIGMET notifications about hazardous weather conditions to pilots through the following addresses:
1. Area Control Center (ACC);
2. Meteorological Service Center at international airports and domestic airfields;
3. Aircraft operators and other users;
4. International meteorological data exchange according to regional air navigation plans.
Section 3
EXPLOITATION AND EXCHANGE OF AIRPORT METEOROLOGICAL DATA
Article 16. Exploitation and Exchange of Airport Meteorological Data
1. The Meteorological Service Centers at international airports, and the Civil Aviation Meteorological Service Center responsible for weather warnings in the airspace of Vietnam and the international flight information region managed by Vietnam must have adequate technical systems, equipment, meteorological instruments, and communication means to exploit and exchange airport meteorological data.
2. Meteorological data for weather forecasting and warning include:
a) GTS data;
b) Weather radar data;
c) Satellite cloud imagery data;
d) OPMET data;
e) Global weather forecast data (WAFS).
3. Meteorological observation stations at international airports and domestic airfields must have sufficient communication means and terminal equipment for the networked database system (DBMS) to exploit and exchange the meteorological data specified in points b, c, and d of Clause 2 of this Article.
Article 17. Exploitation and Use of Global Weather Forecast Data (WAFS)
1. The Meteorological Service Centers at international airports, and the Civil Aviation Meteorological Service Center responsible for weather warnings in the airspace of Vietnam and the international flight information region managed by Vietnam are responsible for receiving global weather forecast products WAFS from the SADIS or ISCS system, including:
a) High-altitude wind and temperature forecasts at flight levels FL050, 100, 140, 180, 240, 300, 340, 390, 450, and 530 as required; wind direction, speed, maximum wind height, and convective layer top height four times daily at 0000, 0600, 1200, and 1800 UTC with validity periods of 6, 12, 18, 24, 30, and 36 hours;
b) Humidity forecasts at flight levels FL050, 100, 140, and 180;
c) Hazardous weather SIGWX forecasts from FL250 to FL630 and from FL100 to FL450 four times daily at 0000, 0600, 1200, and 1800 UTC;
d) OPMET telegrams.
2. The Meteorological Service Centers exploit and use the data and forecast products specified in points a, b, and c of Clause 1 of this Article to create meteorological files; forecast and warn of hazardous weather conditions along flight routes and areas.
3. The Meteorological Service Centers provide global weather forecast products WAFS from available databases to the Air Traffic Control Service Centers according to agreements.
Article 18. Exchange of OPMET Data
1. The Meteorological Service Centers at international airports, and the Civil Aviation Meteorological Service Center responsible for weather warnings in the airspace of Vietnam and the international flight information region managed by Vietnam must conduct OPMET data exchanges 24/24 hours. Meteorological observation stations at international airports and domestic airfields must exchange OPMET data with relevant Meteorological Service Centers.
2. The Meteorological Service Centers at international airports, and the Civil Aviation Meteorological Service Center responsible for weather warnings in the airspace of Vietnam and the international flight information region managed by Vietnam must conduct OPMET data exchanges with regional OPMET data exchange centers in Asia-Pacific.
SECTION 4
COLLECTION, STORAGE, STATISTICAL ANALYSIS, AND DISTRIBUTION OF METEOROLOGICAL DATA AND ATMOSPHERIC DATA FOR AIRPORTS
Article 19. Collection and Storage of Aviation Meteorological Data
1. Aviation meteorological service providers shall be responsible for collecting and storing meteorological data in accordance with regulations.
2. Meteorological observation stations at airports shall store the following:
a) Long-term retention of observation records and METAR weather reports.
b) A twenty-four-month retention period for telegrams sent and received.
3. International airport meteorological service providers shall store the following:
a) Long-term retention for: observation data and METAR weather reports; OPMET data from domestic and international airports; radar weather observation data; satellite cloud imagery data; TAF and TAF AMD original record books; monthly, quarterly, and annual weather summary reports.
b) A twenty-four-month retention period for: weather report record books at related airports; daily weather forecast bulletin and forecast score record books; telegram sent and received record books; flight safety threat or accident statistics record books; daily shift handover record books; various weather maps and diagrams.
4. Weather warning service providers within Vietnamese airspace and international flight information regions managed by Vietnam shall store the following:
a) Long-term retention for: OPMET data from domestic and international airports; radar weather observation data; satellite cloud imagery data; monthly, quarterly, and annual weather summary reports.
b) A twenty-four-month retention period for: telegram sent and received record books; weather map and diagram record books; statistics on aircraft safety threats or accidents related to weather; meteorological data provided to air traffic control service providers; daily shift handover record books.
Article 20. Statistics of Aviation Climate Data
1. Aviation climate data include tables of climate data and summaries of climate conditions at Vietnamese airports and air routes, within Vietnamese airspace, and in international flight information regions managed by Vietnam. These data are compiled based on continuous observation series at a location for a minimum of five years.
2. The aviation climate data table includes:
a) Average, maximum, and minimum values of meteorological factors.
b) Frequency of hazardous weather phenomena affecting aviation activities at airports.
c) Frequency of specific values of one or combined two or more meteorological factors; the aviation climate table for airports includes information on ground and sea surface winds, horizontal visibility, runway visibility, precipitation amount and type, cloud base height, air temperature, dew point temperature, atmospheric pressure, weather phenomena, their locations and times of occurrence; the aviation climate data table includes necessary information for convenient climate summarization.
3. The aviation climate summary table includes the following information:
a) Frequency of horizontal meteorological visibility/runway visibility and/or the lowest cloud layer height with BKN or OVC cloud cover below the specified value at the designated time.
b) Frequency of visibility below the specified value at the designated time.
c) Frequency of the lowest cloud layer height with BKN or OVC cloud cover below the specified value at the designated time.
d) Frequency of simultaneous wind direction and speed within the specified range at the designated time.
e) Frequency of surface temperature within the specified range of 5°C at the designated time.04. At domestic airports, the climate table must have hourly data; and after a specified period, it must be submitted to international airport meteorological service providers for consolidation, statistical analysis, and storage.
5. Airport climate data statistics shall be carried out in accordance with the Appendix attached to this Circular.
5. Meteorological data for international airports shall be compiled in accordance with the Appendix attached to this Circular.
Article 21. Issuance of Aviation Meteorological Data
The International Civil Aviation Weather Service Center (CSCCDV), the weather warning service in Vietnam's airspace and the international flight information region managed by Vietnam, are permitted to issue various types of aviation meteorological data.
Chapter III
AVAILABILITY AND USE OF AIRPORT METEOROLOGICAL SERVICES
Section 1
AVAILABILITY AND USE OF METEOROLOGICAL SERVICES AT AIRPORTS
Article 22. General Provisions
1. Businesses utilizing meteorological services must enter into a "Meteorological Service Supply Contract" with businesses providing such services in accordance with this Circular and specific requirements of each party.
2. All flights departing from airports in Vietnam must complete procedures for receiving necessary meteorological information prior to departure.
3. Procedures for supplying and receiving meteorological information for each flight shall be conducted between aviation meteorological staff and flight crew members or airline traffic control personnel.
4. Aviation meteorological staff and airline traffic control personnel involved in the supply and receipt of meteorological information must hold valid licenses as prescribed by law.
5. The results of the supply and receipt of meteorological services for each flight must be jointly signed off by the provider and recipient; copies of provided documents and information must be stored at the airport meteorological service center for at least thirty days from the date of issuance in either copy form or PDF file format.
Article 23. Necessary Information Before Flight Planning
1. To prepare necessary meteorological data for each flight, the flight procedure office or flight planning department at the airport shall notify the meteorological service center of detailed information about the flight plan:
a) For regular flights: Notifications shall be sent to the meteorological service center at the international airport whenever the seasonal flight schedule is determined; if there are changes to the plan, they must be notified at least 24 hours before the scheduled departure time.
b) For non-regular flights: Notifications shall be sent to the meteorological service center at the international airport at least 24 hours before the scheduled departure time; in case of emergencies, notification must be made at least three hours in advance.
2. Detailed information about the flight plan includes:
a) Departure airport and the planned departure time;
b) Arrival airport and the planned arrival time;
c) Route, estimated times of arrival and departure from intermediate airports;
d) Alternative airports;
đ) Long-term flight altitude;
e) For supersonic flights: Backup long-term flight altitudes below the speed of sound, areas of acceleration and deceleration through the sound barrier, and areas of height increase and decrease;
g) Type of flight: Visual Flight Rules (VFR) or Instrument Flight Rules (IFR);
h) Detailed requirements for the type of meteorological information to be supplied;
i) Time requirements for receiving the meteorological file, presentation, and consultation.
Article 24. Provision of Meteorological Information at International Airports
1. Meteorological information provided at international airports for flight planning includes:
a) High-altitude wind and air temperature forecasts;
b) Hazardous weather phenomenon forecasts along the route, convective limit height (CLH) and jet stream;
c) Terminal Aerodrome Forecast (TAF), TAF Amendment (TAF AMD) at the airport;
d) Meteorological Observation Report (METAR), landing forecast (TREND) at the airport;
đ) Takeoff forecast;
e) Significant Meteorological Information (SIGMET), tropical cyclone, volcanic ash cloud warnings;
g) Airport alerts;
h) Special reports from aircraft.
2. Meteorological information provided at international airports for new route research and operational planning includes:
a) International airport and domestic airport climate data tables;
b) Summary of international airport and domestic airport climate conditions.
Article 25. Methods for Providing Meteorological Services at International Airports
1. Presentation and Consultation:
a) Presentation and consultation of weather information shall be conducted through direct dialogue or other communication means between meteorological staff and flight crew members or air traffic controllers; meteorological staff are responsible for presenting, explaining, and answering questions about the latest weather information; when necessary, meteorological staff may provide recommendations regarding the trends or impacts of hazardous weather phenomena on flights;
b) For low-level flights (below FL100 or FL150 in mountainous areas) and flights to domestic airports, presentations must cover dangerous weather conditions affecting the flight such as cloud layer location and thickness; areas with turbulence and precipitation; regions with widespread weather phenomena reducing visibility below 5000 meters; areas with cloud ceilings lower than terrain obstacles;
c) The language used for presenting and consulting weather information to the flight crew shall be English or Vietnamese.
2. Provision of Meteorological Reports:
a) Meteorological reports consist of weather information presented in map, chart, and bulletin form for use by the flight crew throughout the flight journey; various forms and types of meteorological bulletins;
b) The provision of meteorological reports for each flight includes the presentation and explanation of the information contained therein upon request.
3. Time for Providing Meteorological Services for Each Flight Shall Be As Follows:
a) For flights departing from international airports, meteorological reports shall be prepared and provided to the flight crew or airline's air traffic controllers at least three hours before the scheduled departure time;
b) For flights departing from domestic airports, meteorological reports shall be prepared and provided to the flight crew at least one hour before the scheduled departure time;
c) In cases where the flight crew or airline's air traffic controllers need to receive weather information for specific flights earlier than the times mentioned above, they must notify the meteorological service center at least 24 hours before the scheduled departure time.
Article 26. Establishment and Updating of Meteorological Reports
1. Information Used to Establish Meteorological Reports Includes:
a) The latest weather information;
b) High-altitude wind forecast, high-altitude temperature forecast, SIGWX weather phenomenon forecast along the route, convective level height (CLH), and jet stream data obtained from global weather forecasting products (WAFS). The analysis basis of actual data, the meteorological service center will forecast hazardous weather phenomena affecting the flight, describing the position and thickness of convective cloud layers, areas with turbulence and precipitation, regions with widespread weather phenomena reducing visibility below 5000 meters, areas with cloud ceilings lower than terrain obstacles;
c) METAR weather reports; TAF, TAF AMD weather forecasts; takeoff and landing weather forecasts issued by originating airports;
d) SIGMET notifications, special AIREP reports within a two-hour period; volcanic ash cloud, typhoon, or tropical depression notifications.
2. Updating Meteorological Reports:
a) In cases where meteorological staff do not receive the TAF forecast bulletin from the destination airport or the meteorological forecaster notices the appearance or potential appearance of hazardous weather factors at the destination airport that are not mentioned in the original forecast bulletin, a hypothetical forecast bulletin must be established and communicated to the flight crew; the supplementary forecast bulletin remains effective one hour before and after the scheduled landing time;
b) In cases where the flight crew has received the meteorological report but the flight is delayed more than three hours beyond the initial plan, the flight crew must reapply for meteorological services to update to the latest information;
c) In cases where the flight crew has completed the application for meteorological services but the aircraft has not yet departed, if new information differing from previously provided information is received, the on-duty meteorological staff will supplementally inform the flight crew through the airport control tower (TWR) or the airline's air traffic controller.
Article 27. Supplementary Meteorological Information at Civil Airports
1. Prior to departure for continuation of flight from domestic civil airports, the aircraft crew or air traffic control personnel of the airline must proceed to the airport's flight service department to receive supplementary meteorological information.
2. Supplementary meteorological information for the flight includes:
a) METAR weather report for the intended destination airport;
b) TAF, TAF AMD, or TREND forecast for the arrival airport;
c) SIGMET notifications, tropical cyclone information, volcanic ash advisories;
d) Warnings about the possibility of encountering hazardous weather conditions in the takeoff climb area such as mountain wave turbulence, convective clouds, thunderstorms, showers, hail, strong winds, gusts, and tornadoes;
đ) Information on hazardous weather phenomena along the route of flight.
Article 28. Meteorological Services for General Aviation Operations
The content and method of providing meteorological services for general aviation flights are regulated in the relevant air traffic control service provision methods.
Section 2
PROVISION OF METEOROLOGICAL SERVICES FOR AIR NAVIGATION SERVICE PROVIDERS (ANSP), AIR TRAFFIC INFORMATION NOTIFICATION, AND SEARCH AND RESCUE OPERATIONS
Article 29. Meteorological Services Provided to ANSP
1. The meteorological service provider has the responsibility to provide meteorological services to the ANSP according to the "Meteorological Service Provision Contract" signed between both parties.
2. The contents of the "Meteorological Service Provision Contract" stipulated in Clause 1 of this Article shall be implemented in accordance with the laws on meteorology.
Article 30. Meteorological Services Provided to Air Traffic Information Notification Providers
Meteorological services provided to air traffic information notification providers include:
1. Providing written notifications to air traffic information notification providers regarding meteorological information that needs to be published or supplemented in the Vietnam Aeronautical Information Publication (AIP); the content of the notification is specified in the Circular on Air Traffic Information Notification.
2. Timely provision of special meteorological information to air traffic information notification providers for issuance of NOTAM or ASHTAM in accordance with the provisions in the Circular on Air Traffic Information Notification.
3. Timely provision of changes in technical infrastructure, procedures, and services for air traffic information notification providers to incorporate into their air traffic information publication appropriately.
Article 31. Meteorological Services Provided to Search and Rescue Providers
1. The meteorological service provider has the responsibility to closely coordinate with search and rescue providers when requested to participate in aircraft search and rescue operations according to the "Meteorological Service Provision Contract" signed between both parties.
2. The meteorological service provision contract stipulated in Clause 1 of this Article includes the following information:
a) Meteorological conditions along the flight path, alternate airports, and the last known position of the aircraft before the incident;
b) Current weather conditions and weather trend forecasts in the search and rescue operation area and search and rescue base airports;
c) Other meteorological information as required by the search and rescue providers.
3. Meteorological conditions provided to search and rescue providers include information on:
a) Hazardous weather phenomena along the route of flight;
b) Types and amounts of clouds, cloud base heights;
c) Visibility and weather phenomena reducing visibility;
d) Surface wind and upper-level wind;
đ) Ground surface condition;
e) Temperature and sea surface state;
g) Sea level pressure data.
4. The meteorological service provider establishes regulations on providing meteorological services for search and rescue operations; clearly defining the sequence, content, and time frame for implementation; types of meteorological information and responsibilities for each phase of search and rescue operations.
5. After the aircraft accident investigation concludes, the meteorological service provider participates in the weather debriefing meeting; evaluates and draws lessons learned from participation in search and rescue operations.
Section 3
INSPECTION, SUPERVISION, AND EVALUATION OF AIR TRAFFIC METEOROLOGICAL SERVICES
Article 32. Inspection and Supervision of Air Meteorological Services
1. The Civil Aviation Authority of Vietnam shall inspect, supervise, and correct the provision of air meteorological services by enterprises participating in the provision and use of such services; the use of air meteorological services by flight crews and air traffic controllers of airlines.
2. The Air Meteorological Service Control Center at international airports shall be responsible for guiding, inspecting, and correcting the provision of air meteorological services to units and staff under its jurisdiction and the weather observation stations at domestic airports and airfields.
3. The Weather Warning Service in the airspace of Vietnam and the portion of the international flight information region over international waters managed by Vietnam shall be responsible for guiding, inspecting, and correcting the provision of air meteorological services to units and staff under its jurisdiction.
Article 33. Evaluation of Air Meteorological Services
1. Enterprises participating in the provision and use of air meteorological services, Air Meteorological Service Control Centers, Air Traffic Service Control Centers, airlines, flight crews, and other entities using air meteorological services have the right to evaluate and comment on the quality of air meteorological service provision.
2. The content of the evaluation of air meteorological services includes:
a) Weather characteristics affecting the implementation of flight plans;
b) Quality, accuracy, and timeliness of provided meteorological information; related meteorological documents; attitude and sense of responsibility of meteorological staff when performing their duties;
c) Situations where aircraft cannot land at airports due to weather conditions worse than those reported; cases where reports are received about poor quality of provided meteorological information; situations where flights avoid weather conditions worse than those forecasted in the weather warning service in the airspace of Vietnam and the portion of the international flight information region over international waters managed by Vietnam;
d) Quality of technical systems, equipment, meteorological devices, and communication means ensuring the provision of air meteorological services;
e) Coordination work in providing and using air meteorological services.
3. Organizing meetings to evaluate, draw lessons, and propose measures to improve the quality of air meteorological service provision and use shall be carried out as follows:
a) The Air Meteorological Service Control Center shall organize regular meetings at least once a year with airline air traffic controllers, Air Traffic Service Control Centers, and other entities using air meteorological services; organize emergency meetings when incidents occur related to the provision of air meteorological services;
b) The results of the air meteorological service evaluation shall be reported to the Civil Aviation Authority of Vietnam.
Chapter IV
TECHNICAL INFRASTRUCTURE AND PERSONNEL OF AIR METEOROLOGICAL SERVICES
Section 1
TECHNICAL SYSTEMS, EQUIPMENT, DEVICES, AND COMMUNICATION MEANS
Article 34. General Provisions
1. The technical system, equipment, and devices for air meteorological services are specialized technical systems, equipment, and devices designed, manufactured, and installed in accordance with laws on meteorology.
2. Ensuring meteorological equipment and communication means for air meteorological services shall be implemented as follows:
a) The Air Meteorological Service Control Center must invest in specialized equipment and communication means with high technical safety factors, ensuring continuous operation 24/24 hours; meteorological equipment serving aircraft takeoff and landing must have appropriate backup plans to ensure continuous data;
b) The Air Meteorological Service Control Center must be organized into main data centers (DCs) and establish a two-way information exchange network system;
c) The Air Meteorological Service Control Center must maintain logs and records regarding: technical systems, equipment, and devices for meteorology, communication means; technical documentation of: technical systems, equipment, and devices for meteorology, communication means must be updated regularly.
Article 35. Meteorological Observation Technical System, Equipment, and Devices
1. The basic technical configuration of an automatic meteorological observation system includes:
a) Equipment or sensors to measure and determine aviation weather factors at airports;
b) Data transmission and processing systems;
c) Digital display devices for exploitation such as digital clocks or screens;
d) Equipment for storing and printing changing data, updates.
2. At international airports, types of equipment or sensors must be sufficient to continuously automatically measure all necessary meteorological factors, including:
a) Direction and speed of instantaneous wind, average over 2 minutes, 10 minutes, gusts;
b) Certain dangerous weather phenomena such as thunderstorms, heavy rain, fog, and haze;
c) Horizontal surface visibility;
d) Runway Visual Range (RVR);
đ) Low cloud ceiling (BKN, OVC) at 1500 meters; £ e) Air temperature;
g) Dew point;
h) Altimeter settings QFE, QNH;
i) Precipitation amount.
3. At domestic airports, types of equipment or sensors must be sufficient to continuously automatically measure at least the following meteorological factors:
a) Direction and speed of instantaneous wind, average over 2 minutes, 10 minutes, gusts;
b) Air temperature;
c) Dew point;
d) Altimeter settings QFE, QNH.
4. Airports with only minimal measurement equipment or sensors must establish accurate reference points to determine horizontal visibility and other necessary charts as a basis for observing remaining meteorological factors; observational results by eye must be incorporated into the general system to ensure that data is collected and displayed fully for relevant parties using their aviation meteorological services.
5. The technical system, equipment, and devices installed must meet the following requirements:
a) At international airports, the number and types of technical systems, equipment, devices, or sensors, and installation locations must comply with legal regulations on meteorology;
b) At domestic airports, measurement equipment or sensors may be centrally located in suitable areas to measure characteristic meteorological factors for the airport without violating airspace restrictions.
6. The meteorological observation technical system, equipment, and devices must be inspected daily by meteorological staff; inspection contents include the operational status of the system, the accuracy of displayed data, and the synchronization of displayed time with standard clock time.
7. Meteorological observation equipment must be calibrated once a year by competent and capable agencies.
Article 36. Meteorological Technical Systems, Equipment, and Communication Means for Weather Forecasting and Warning
1. International Airport Meteorological Service Centers (CSCCDV) must be equipped with low-level wind shear detection systems; these systems measure wind direction and speed vertically in the airport area; measured wind direction and speed data are analyzed to warn about vertical wind shear in the airport area.
2. International Airport Meteorological Service Centers (CSCCDV) must be equipped with weather radar surveillance and detection systems to monitor and detect dangerous weather conditions in the responsibility area; weather radar data is a crucial basis for tracking, detecting, forecasting, and warning of dangerous weather phenomena.
3. International Airport Meteorological Service Centers (CSCCDV), weather warning centers in Vietnam's airspace and parts of international maritime air traffic control areas managed by Vietnam, and meteorological observation stations at domestic airports with daily flight operations must be equipped with direct or indirect reception systems to receive satellite weather images; satellite weather images are a crucial basis for weather monitoring to prepare forecast and warning bulletins serving flight operations, especially supporting places where surface meteorological station data is unavailable.
4. International Airport Meteorological Service Centers (CSCCDV), weather warning centers in Vietnam's airspace and parts of international maritime air traffic control areas managed by Vietnam must be equipped with receiving systems or network information systems to receive and process GTS data; GTS data serves as a basis for creating maps and diagrams for weather forecasting.
5. International Airport Meteorological Service Centers (CSCCDV), weather warning centers in Vietnam's airspace and parts of international maritime air traffic control areas managed by Vietnam must be equipped with devices to receive global weather forecast products from WAFC as a basis for establishing meteorological records and for weather forecasting and warning.
The Civil Aviation Meteorological Service Center (CSCCDV) at international airports, the CSCCDV for weather warnings in the airspace of Vietnam and the portion of the flight information region over international waters managed by Vietnam must be equipped with systems to receive global weather forecast products from the World Area Forecast Center (WAFC) as a basis for establishing meteorological records and for weather forecasting and warning.
Article 37. Meteorological Monitoring System for Emergency Preparedness
The Civil Aviation Meteorological Service at international airports shall be responsible for equipping mobile meteorological monitoring systems for airports within their jurisdiction, capable of measuring basic meteorological factors (wind, visibility, cloud ceiling height, air temperature, dew point, atmospheric pressure) with the purpose of:
1. Replacing airport weather stations when unforeseen emergencies occur;
2. Serving disaster prevention and mitigation; search and rescue operations; search and rescue drills.
Article 38. Communication Means Providing Meteorological Data to Air Traffic Control Services
1. Communication means providing meteorological data to airport control towers and approach control services must ensure the following requirements:
a) The main communication equipment used for providing various types of information such as airport meteorological observation data, airport weather forecasts for aircraft landing (TREND format), low-level wind shear warnings, thunderstorm areas, convective clouds is a transmission system and display equipment; a system ensuring continuous updates of all changes in airport meteorological factors; updated data must be automatically recorded;
b) Radio or telephone communication devices must be equipped for use in situations where air traffic controllers need detailed explanations about the content and meaning of provided meteorological information or when the main communication equipment fails;
c) The time to establish dialogue communication between air traffic controllers and the meteorological service at international airports or airport meteorological stations shall not exceed 15 seconds;
d) At international airports, a networked information system must be established between the approach control service and the meteorological service to access visual meteorological information such as radar images, satellite cloud images, regional weather reports, and related airport weather reports.
2. Communication means providing meteorological data to the Area Control Center (ACC) must ensure the following requirements:
a) AFTN is the primary communication means for providing and exchanging OPMET data related to flight activities in Vietnamese airspace and the international flight information region managed by Vietnam;
b) Telephone communication devices must be equipped for use in situations where air traffic controllers need detailed explanations about the content and meaning of provided meteorological information or when the main communication equipment fails;
c) The ACC, the meteorological service at international airports, and the weather warning service in Vietnamese airspace and the international flight information region managed by Vietnam must establish a networked information system to access visual meteorological information such as radar images, satellite cloud images, high-altitude wind and temperature maps, regional weather reports, and related weather reports from other areas.
Article 39. Ensuring Communication Means for Presenting, Advising, and Providing Meteorological Reports
1. Locations where weather information exhibitions, presentations, and consultations take place must be equipped with means to ensure timely, complete, and accurate provision of necessary meteorological information as prescribed; there should be visual meteorological information for presentations such as SYNOP weather maps, diagrams, satellite cloud images, and weather radar images.
2. The meteorological service at international airports must be equipped with printing and distribution means for meteorological reports such as printers and photocopiers.
Article 40. Means of Communication for Exchanging OPMET Data
1. The means of communication for exchanging international OPMET data is the AFTN network. Technical maintenance responsibilities are defined as follows:
a) The AFTN station under the Air Navigation Service Provider (ANSP) responsible for information, navigation, and surveillance services shall be responsible for technical maintenance of the international connection port, transmission lines, and exploitation equipment.
b) The Meteorological Service Center at international airports, the Meteorological Warning Service Center within Vietnam's airspace, and the part of the flight information region over international waters managed by Vietnam shall have independent AFTN terminal addresses and shall be responsible for technical maintenance of terminal exploitation equipment.
2. The means of communication for exchanging meteorological data between the Meteorological Service Center at international airports and weather observation stations at domestic airports must meet the following requirements:
a) The main means of communication is the AFTN network or other direct communication means; the time to establish communication shall not exceed five minutes;
b) Radio communication (SSB), telephone, and fax must be equipped for use in cases where meteorological data exchange occurs between domestic airports with flight operations when the main system fails or when dialogue is needed between meteorological forecasters at international airport meteorological service centers and meteorological staff at domestic airports to discuss and explain hazardous weather conditions affecting flights;
c) For domestic airports with daily flight operations, a network connection system with the Meteorological Service Center at international airports must be established to allow access to radar images, satellite cloud images, and weather reports from related airports.
Article 41. Issuance of Exploitation Licenses for Aviation Meteorological Systems and Equipment
1. The following aviation meteorological systems and equipment can only be put into official operation upon obtaining an exploitation license issued by the Civil Aviation Authority of Vietnam:
a) Weather observation systems;
b) Wind shear measurement and warning systems;
c) Weather radar systems;
d) Satellite cloud image receiving systems;
đ) Basic meteorological data collection and processing systems (GTS);
e) Global Weather Forecast Product Reception System (WAFS);
g) Aviation Meteorological Database (DB);
h) Common equipment at weather observation stations.
2. The aviation meteorological systems and equipment specified in Clause 1 of this Article shall be granted an exploitation license if they meet the following conditions:
a) They comply with the technical standards stipulated in Articles 34, 35, and 36 of this Circular;
b) They have operational, maintenance, and repair manuals;
c) They have technical handover and acceptance records;
d) They have backup equipment;
đ) For weather radar systems, low-level wind shear measurement and warning systems, satellite cloud image receiving systems, and WAFS product reception systems, frequency usage permits are required;
e) Operational, maintenance, and repair personnel for the systems and equipment must hold training certificates from the corresponding equipment repair factories.
3. Enterprises participating in providing meteorological services must submit to the Civil Aviation Authority of Vietnam an application for an exploitation license for aviation meteorological systems and equipment, including the following documents:
a) An application for an exploitation license for aviation meteorological systems and equipment, including the following information: name and address of the enterprise applying for the license; name of the system and equipment; purpose, scope, and method of exploiting the system and equipment;
b) A technical report on the system and equipment;
c) A report on the capacity for operating, maintaining, and repairing the system and equipment;
d) Operating, maintenance, and repair documentation;
đ) Receipts or confirmation documents for payment of fees.
4. Within thirty days from the date of receipt of all documents, the Civil Aviation Authority of Vietnam will review the application, inspect the actual condition of the systems and equipment, and decide whether to issue an exploitation license for the aviation meteorological systems and equipment. In case of rejection, a written notice must be given to the applicant explaining the reasons. During the review process, the Civil Aviation Authority of Vietnam has the right to request the applicant to supplement relevant documents or provide explanations directly.
5. The validity period of the exploitation license for aviation meteorological systems and equipment is two years.
6. The exploitation license for aviation meteorological systems and equipment will be revoked in the following cases:
a) The systems and equipment no longer meet the operational conditions;
b) The data and products from the systems and equipment do not meet the prescribed standards;
c) Operational, maintenance, and repair personnel for the systems and equipment do not hold training certificates from the corresponding equipment manufacturing factories.
Section 2
AVIATION METEOROLOGICAL SERVICE PROVIDERS AND STAFF
Article 42. Issuance of Exploitation License for Meteorological Service Providers (CSCCDV)
1. The exploitation license for meteorological services in aviation shall be issued to:
a) CSCCDV weather warning services within Vietnamese airspace and parts of international flight information regions managed by Vietnam;
b) CSCCDV meteorological services at international airports;
c) Meteorological observation stations at domestic airports and airfields.
2. A CSCCDV meteorological service shall be granted an exploitation license when meeting the following conditions:
a) Having an appropriate organizational structure for providing meteorological services;
b) Possessing adequate technical systems, equipment, meteorological devices, communication means, and having an exploitation license;
c) Meteorological staff being sufficient in number and holding appropriate aviation staff licenses;
d) Having adequate operational guidance materials approved by the Civil Aviation Administration of Vietnam.
3. Enterprises participating in providing meteorological services must submit to the Civil Aviation Administration of Vietnam an application dossier for the issuance of an exploitation license for CSCCDV meteorological services, including the following documents:
a) Application form for the issuance of an exploitation license for CSCCDV meteorological services containing the following information: name and address of the enterprise applying for the service; name and address of the CSCCDV meteorological service; purpose, scope, and method of providing meteorological services;
b) Report on organizational structure, infrastructure, technical systems, equipment;
c) List of meteorological staff, technical systems, and equipment that have been licensed;
d) Operational guidance material system.
đ) Receipts or confirmation documents for payment of fees.
4. Within thirty days from the date of receipt of complete dossiers, the Civil Aviation Administration of Vietnam will review the dossiers, conduct on-site inspections, and decide on the issuance of the exploitation license for CSCCDV meteorological services. In case of rejection, a written notification with reasons must be provided to the applicant. During the review and inspection process, the Civil Aviation Administration of Vietnam has the right to request the submission of additional related documents or direct explanations from the applicant.
5. The validity period of the exploitation license for CSCCDV meteorological services is five years.
6. The exploitation license for CSCCDV meteorological services shall be revoked in the following cases:
a) The CSCCDV meteorological service no longer meets the operating conditions;
b) The CSCCDV meteorological service violates laws and regulations on aviation meteorology.
Article 43. Aviation Meteorological Staff
Aviation meteorological staff includes:
1. Weather forecasters;
2. Meteorological observers.
Article 44. Responsibilities and Tasks of Weather Forecasters
1. Analyzing meteorological observation data (surface, upper-air, radar, satellite imagery); preparing airport weather forecasts in TAF format; trend landing forecasts; preparing weather forecasts and warnings for Vietnamese airspace and parts of international flight information regions managed by Vietnam.
2. Preparing weather forecast maps and explaining wind, temperature, humidity, and hazardous weather phenomena data.
3. Presenting weather information to pilots, air traffic controllers, airline operations staff using English and Vietnamese languages.
4. Supervising the meteorological shift team; handling complex weather situations that threaten civil aviation operations.
Article 45. Duties and Tasks of Meteorological Observers at Airports
1. Conduct meteorological observations and report weather conditions at airport airfields to support aircraft takeoffs and landings.
2. Fill out meteorological maps and diagrams as required by weather forecasters.
4. Provide Automatic Terminal Information Service (ATIS) broadcasts with relevant information at airports for flight crew operations.
5. Provide aviation meteorological services to users according to signed contracts.
6. Assist in providing aviation weather forecasting services when requested.
7. Maintain meteorological measuring equipment.
8. Compile and statistically analyze aviation climatological data.
Article 46. Qualifications of Aviation Meteorologists
1. Meet the qualifications for meteorologists as stipulated by laws on meteorology.
2. Comply with World Meteorological Organization standards for education and training of aviation meteorologists.
3. Hold a degree or certificate in aviation meteorology approved by the Civil Aviation Administration of Vietnam.
Article 47. Aviation Meteorologist License
1. Individuals meeting the criteria set forth in Article 46 of this Circular shall be issued an Aviation Meteorologist License in accordance with regulations of the Minister of Transport regarding aviation personnel.
2. The validity period of the Aviation Meteorologist License is three years.
3. The Aviation Meteorologist License will be revoked in the following cases:
a) The licensed individual does not meet the licensing requirements or no longer meets such requirements.
b) The Permit is altered, tampered with, or falsified;
c) The licensed individual violates regulations concerning the use of the license.
Chapter V
RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS IN THE AVIATION METEOROLOGY FIELD
Article 48. Responsibilities of the Civil Aviation Authority of Vietnam
1. Develop legal regulatory documents on aviation meteorology to be submitted to the Minister of Transport.
2. Develop plans for the development of the aviation meteorology sector to be submitted to the Ministry of Transport for approval.
3. Organize and manage the provision of aviation meteorology services by corresponding enterprises.
4. Study, propose, and implement International Civil Aviation Organization (ICAO) and World Meteorological Organization (WMO) meteorological standards, methods, and procedures that comply with Vietnamese law.
5. Announce and guide organizations and individuals operating in the aviation meteorology field in Vietnam to comply with international meteorological organization and ICAO regulations, specifically as follows:
a) International Civil Aviation Organization guidance material on runway visual range and actual reports.
b) World Meteorological Organization (WMO-782) Aviation Meteorological Code Usage Handbook.
c) Standard and Special Weather Reports Model Forms, Annex 3 to the Convention on International Civil Aviation.
d) International Civil Aviation Organization guidance material on aviation meteorological skills practice.
đ) International Civil Aviation Organization aviation meteorology materials, Annex 3 to the Convention on International Civil Aviation.
e) Model forms for METAR code, Annex 3 to the Convention on International Civil Aviation.
g) Airport and aerodrome weather forecasts model forms, Annex 3 to the Convention on International Civil Aviation.
h) International Civil Aviation Organization guidance material on coordination between Flight Services, Aeronautical Information Services, and Aviation Meteorological Services.
i) Model forms for aviation weather warnings, Annex 3 to the Convention on International Civil Aviation.
k) Model forms for wind shear warning messages, Annex 3 to the Convention on International Civil Aviation.
l) Model forms for SIGMET issuance and special forms, Annex 3 to the Convention on International Civil Aviation.
m) International Civil Aviation Organization guidance material on the establishment and operation of SIGMET telegrams in the Asia-Pacific region.
n) International Civil Aviation Organization Regional Operations Meteorological Exchange (ROBEX) Handbook.
o) Regional Operations Meteorological Data Bank (RODB).
p) International Meteorological Organization and ICAO technical standards.
q) International Meteorological Organization educational and training materials for aviation meteorologists.
6. Direct the provision and exchange of aviation meteorology services domestically and internationally.
7. Develop a framework training program for aviation meteorologists to be submitted to the Minister of Transport; approve training programs for aviation meteorologists from training institutions; approve examination content, questions, and answers for license issuance and qualification certification.
8. Issue Operating Licenses for Aviation Meteorological Service Providers, Operating Licenses for Aviation Meteorological System and Equipment, and Aviation Meteorologist Licenses.
9. Approve operational guidelines for aviation meteorological service providers.
10. Inspect and supervise compliance with regulations on the provision of aviation meteorology services; handle violations according to the law.
11. International cooperation in the aviation meteorology field.
Article 49. Civil Aviation Meteorological Service System and Responsibilities of Enterprises Participating in Providing Meteorological Services for Aviation
1. The civil aviation meteorological service system of Vietnam includes:
a) CSCCDV weather warning services within Vietnamese airspace and parts of international flight information regions managed by Vietnam;
b) CSCCDV meteorological services at international airports;
c) Meteorological observation stations at domestic airports and airfields.
2. Enterprises participating in providing meteorological services for aviation shall be responsible for:
a) Organizing the operation of subordinate meteorological service centers in accordance with this Circular;
b) Participating in building programs and plans of the Civil Aviation Administration of Vietnam on training, instruction, inspection, and issuing licenses to meteorological staff; implementing plans on training, instruction, and inspection for meteorological staff under their management;
c) Establishing regulations on organizing operations, meteorological service procedures, and operational guidance materials for subordinate business units for approval by competent authorities and organizing implementation;
d) Managing, operating, maintaining, and inspecting technical systems, equipment, and specialized devices; developing investment plans, upgrades, and ensuring technical infrastructure for meteorological service provision;
đ) Reporting regularly every six months or at any time to the Civil Aviation Administration of Vietnam on the status of technical systems, equipment, and meteorological devices, as well as work on monitoring, forecasting, and warning dangerous weather phenomena affecting civil aviation activities;
e) Summarizing, concluding, and evaluating experiences regarding the provision of meteorological services for aviation.
Article 50. Responsibilities of Meteorological Warning Services in Vietnamese Airspace and Parts of International Flight Information Regions Managed by Vietnam
1. Continuously monitoring weather conditions affecting aviation activities in Vietnamese airspace and parts of international flight information regions managed by Vietnam.
2. Establishing and issuing SIGMET warnings on flight routes within Vietnamese airspace and parts of international flight information regions managed by Vietnam.
3. Exchanging operational meteorological data OPMET with other meteorological service centers as per the ROBEX plan.
4. Providing meteorological data and products to the Area Control Center and other users.
5. Organizing statistics and archiving dangerous weather patterns affecting flight routes and areas within Vietnamese airspace and parts of international flight information regions managed by Vietnam.
6. Summarizing, concluding, and evaluating experiences regarding services for forecasting and warning dangerous weather phenomena.
7. Cooperating and coordinating with related meteorological service centers to resolve issues within specialized business operations and assigned tasks.
8. Organizing research and application of science and technology to improve the quality and effectiveness of meteorological services for aviation.
9. Regularly or promptly reporting on the status of technical systems, equipment, and meteorological devices, as well as work on forecasting and warning dangerous weather phenomena affecting aviation activities according to enterprise regulations.
Article 51. Responsibilities of Meteorological Service Centers at International Airports
1. Organizing weather observation and reporting at airports serving aircraft takeoff and landing, exchanging METAR observation bulletins with other airports; establishing TREND landing forecast bulletins.
2. Establishing airport weather forecast bulletins in TAF code format; supplementary TAF AMD forecasts and receiving other airport weather forecast bulletins to ensure flight operations; establishing and issuing airport weather warning bulletins (AD WRNG); warning low-level wind shear (WS WRNG).
3. Displaying available meteorological information in the flight operations room.
4. Presenting, advising, and providing meteorological files to flight crews, air traffic control service centers, airline dispatchers, and airlines; providing meteorological services for related entities within the area of responsibility.
5. Exchanging operational meteorological data OPMET with other meteorological service centers as per the ROBEX plan.
6. Supervising the operation of meteorological observation stations at domestic airports within their authority.
7. Organizing the storage and statistical analysis of aviation climate data.
8. Summarizing, concluding, and evaluating experiences regarding weather observation, forecasting, and warning dangerous weather phenomena.
9. Cooperating and coordinating with related meteorological service centers to resolve issues within specialized business operations and assigned tasks.
10. Organizing research and application of science and technology to improve the quality and effectiveness of meteorological services for aviation.
11. Regularly or promptly reporting on the status of meteorological equipment, weather observation, forecasting, and warning activities according to enterprise regulations.
Article 52. Responsibilities of Meteorological Observation Stations at Domestic Airports.
1. Conduct meteorological observations and prepare regular and special METAR weather reports; provide TREND landing forecasts to the Civil Aviation Meteorological Service Control Center (CSCCDV) at international airports, airport control towers, flight crews, and airline operations personnel according to assigned tasks.
2. Exchange meteorological data with the Civil Aviation Meteorological Service Control Center at international airports and other domestic airport meteorological observation stations.
3. Send meteorological observation data and weather reports to relevant international airport Civil Aviation Meteorological Service Control Centers for storage and statistical purposes as prescribed.
4. Coordinate and cooperate with meteorological service providers and users to resolve specialized business issues and assigned tasks.
5. Regularly or promptly report to the Civil Aviation Meteorological Service Control Center at international airports on the status of technical systems, meteorological equipment, and observation activities to ensure flight safety according to assigned tasks.
Article 53. Responsibilities of Organizations and Individuals Using Air Traffic Meteorological Services.
1. Organizations and individuals operating aircraft have the responsibility to:
a) Propose to the Vietnam Civil Aviation Authority the need for domestic and international meteorological information to ensure their flight operations.
b) Timely collect and transmit meteorological information that may affect flight operations to air traffic control services and meteorological service centers.
2. Flight crew members have the responsibility to:
a) Sign and timely receive meteorological files before departure from a Vietnamese airport.
b) Conduct meteorological observations and report from aircraft during flights using AIREP.
c) Provide post-flight meteorological information as required.
3. Air Traffic Control Services (TWR, APP, ACC) have the responsibility to:
a) Fully, quickly, and accurately receive domestic and international meteorological information from corresponding meteorological service centers through available technical means, equipment, and devices to ensure flight command and control.
b) Promptly and accurately inform relevant flight crews of necessary meteorological information.
c) Supplementarily conduct meteorological observations, timely collect and forward meteorological reports from aircraft AIREP that may affect flight operations within their jurisdiction to corresponding meteorological service centers.
Article 54. Coordination in the Use of Air Traffic Meteorological Services.
Organizations and individuals using meteorological services are responsible for designating persons to maintain direct and regular contact with air traffic meteorological service centers to facilitate convenient, rapid, and accurate information exchange.
Article 55. Implementation Organization
Vietnam Civil Aviation Authority:
1. Is responsible for implementing this Circular, updating new meteorological content as needed.
2. Compile and report to the Ministry of Transport any issues or difficulties arising during implementation for timely research and resolution.
Article 56. Effectiveness and Responsibility for Implementation.
1. This Circular takes effect 45 days from the date of issuance and revokes Decision No. 12/2007/QĐ-BGTVT dated March 21, 2007, issued by the Minister of Transport on the Civil Aviation Meteorological Regulations.
2. The Director of the Ministry's Office, the Inspector General, Heads of Departments, the Director of the Vietnam Civil Aviation Authority, Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Circular./.
