Article 1. Scope of Regulation
This Circular issues the List of Products and Goods with Potential to Cause Safety Hazards (hereinafter referred to as the List of Products and Goods Group 2) as specified in point d, Clause 2, Article 32 of Decree No. 132/2008/NĐ-CP of the Government under the State management responsibility of the Ministry of Industry and Trade and the principles for State management of product and good quality within the List of Products and Goods Group 2.
Article 2. Applicability
1. Organizations and individuals producing and trading in products and goods listed in the List of Products and Goods Group 2 as attached to this Circular.
2. State agencies responsible for product and good quality management and other relevant agencies and organizations.
3. Accredited conformity assessment bodies designated to inspect, test, and examine the quality of products and goods listed in the List of Products and Goods Group 2 (hereinafter referred to as designated conformity assessment bodies).
Article 3. Principles of Management
The management of product and good quality within the List of Products and Goods Group 2 under the State management responsibility of the Ministry of Industry and Trade as stipulated in this Circular shall be carried out according to the principle that products and goods must be certified as conforming to the corresponding national technical regulations issued by the Ministry of Industry and Trade before being put on the market. In cases where there are no corresponding national technical regulations, management shall be conducted in accordance with current regulations until such national technical regulations are established.
Article 4. List of Products and Goods Group 2 under the Management Responsibility of the Ministry of Industry and Trade
The List of Products and Goods Group 2 under the State management responsibility of the Ministry of Industry and Trade is specified in the Appendix to this Circular.
Article 5. Effectiveness and implementation
1. This Circular takes effect from July 1, 2010.
2. The Department of Science and Technology, Ministry of Industry and Trade shall take the lead and coordinate with relevant agencies to submit to the Minister of Industry and Trade for amendments and supplements to the List as required by management needs./.
