CIRCULAR

Amending and supplementing certain Articles of Circular No. 16/2010/TT-BGTVT dated June 30, 2010 on detailed regulations regarding management and operation of civil airports. Detailed regulations on management and operation of civil airports.

Pursuant to Decree No. 51/2008/NĐ-CP dated April 28, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 83/2007/NĐ-CP dated May 25, 2007 of the Government on management and operation of civil airports;

The Minister of Transport hereby promulgates the following:

Article 1. Amending and supplementing certain Articles of Circular No. 16/2010/TT-BGTVT dated June 30, 2010 on detailed regulations regarding management and operation of civil airports.

1. Amend Article 13 as follows:

"Article 13. Procedures for issuing Civil Airport Operation Certificates and procedures for opening and reopening civil airports."

2. Supplement Clause 4 and Clause 5 to Article 13 as follows:

"4. The procedures for opening and reopening civil airports shall be carried out in accordance with Clause 2 of Article 9 and Clause 2 of Article 10 of Decree No. 83/2007/NĐ-CP dated May 25, 2007 and the specific guidelines below:
a) The entity granted a Civil Airport Operation Certificate wishing to open or reopen a civil airport must submit three sets of application documents directly or through postal services to the Vietnam Civil Aviation Authority;
b) A certified copy of the Civil Airport Operation Certificate as stipulated at point b of Clause 2 of Article 9 and Article 10 of Decree No. 83/2007/NĐ-CP dated May 25, 2007 must be provided.
5. Procedure and time limit for processing the procedures for opening and reopening civil airports:
a) Within five working days from the date of receipt of complete documents as prescribed, the Vietnam Civil Aviation Authority shall be responsible for reviewing and reporting the results of the review to the Minister of Transport;
b) Within five working days from the date of receipt of the report on the results of the review, relevant agencies under the Ministry of Transport shall be responsible for drafting documents for the Minister to sign and submit.

Article 2. Effective Date

This Circular takes effect 45 days from the date of signature.

Article 3. Responsibility for Implementation

The Director of the Ministry's Office, the Inspector General, Heads of Departments, the Director of the Vietnam Civil Aviation Authority, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
