Regarding the establishment of Mong Cai Border Economic Zone, Quang Ninh Province
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Based on the Investment Law dated November 29, 2005;
Pursuant to Decree No. 29/2008/NĐ-CP dated March 14, 2008 of the Government on industrial zones, export processing zones, and economic zones;
At the request of the Minister of Planning and Investment and the People's Committee of Quang Ninh Province;
The Prime Minister issues this Decision on the establishment of Mong Cai Border Economic Zone, Quang Ninh Province,
Article 1. Establish Mong Cai Border Economic Zone, Quang Ninh Province.
1. Mong Cai Border Economic Zone, Quang Ninh Province is a defined geographic area within the national territory and sovereignty, having a separate economic space.
Mong Cai Border Economic Zone includes the entire city of Mong Cai (comprising 17 administrative units which are wards: Tra Co, Tran Phu, Ka Long, Ninh Duong, Hai Yen, Hai Hoa, Binh Ngoc, Hoa Lac and communes: Hai Tien, Van Ninh, Hai Dong, Quang Nghia, Vinh Thuc, Vinh Trung, Hai Son, Hai Xuan, Bac Son); Ha Ha Industrial Park - Seaport (including three administrative units which are communes: Quang Duyen, Quang Phong, and Phu Hai); Quang Ha Town and communes Quang Thang, Quang Thanh, Quang Minh, Quang Trung, Cai Chien (Ha Ha District). The total natural area of the economic zone is approximately 121,197 hectares, of which the land area is 66,197 hectares and the sea area is 55,000 hectares. The geographic boundaries are determined as follows:
a) North: Adjacent to Dong Hung City (China).
b) West: Adjacent to some communes of Dam Ha and Van Don districts.
c) East and South: Adjacent to the East Sea (North Vietnam Bay).
2. Mong Cai Border Economic Zone shall be organized into a duty-free zone and functional areas such as: International border gate area, industrial zones, financial center, urban area, administrative center, residential area, and other functional areas. The scale and location of each area shall be determined in the general and detailed planning of Mong Cai Border Economic Zone.
12/2025/TT-BNNMT dated June 19, 2025 issued by the Minister of Agriculture and EnvironmentActivities and mechanisms, policies for Mong Cai Border Economic Zone, Quang Ninh Province shall be implemented in accordance with the Investment Law and guiding documents for the Implementation of the Investment Law, Decree No. 29/2008/ND-CP dated March 14, 2008 of the Government on industrial parks, export processing zones, and economic zones, Decision No. 33/2009/QĐ-TTg dated March 2, 2009 of the Prime Minister promulgating financial mechanisms and policies for border economic zones, and other relevant laws.
Article 3. Implementation Provisions
1. This Decision takes effect from June 1, 2012.
Repeal Decision No. 675/TTg dated September 18, 1996 of the Prime Minister on the pilot application of certain policies in the Mong Cai border area.
2. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, and the Chairman of the People's Committee of Quang Ninh Province are responsible for implementing this Decision./.
