Regulations on types of relics and antiques not allowed to be taken out of the country

Pursuant to the Cultural Heritage Law dated June 29, 2001 and the Law Amending and Supplementing Certain Provisions of the Cultural Heritage Law dated June 18, 2009;
Pursuant to Decree No. 98/2010/NĐ-CP dated September 21, 2010 of the Government detailing the implementation of certain provisions of the Cultural Heritage Law and the Law Amending and Supplementing Certain Provisions of the Cultural Heritage Law;
Article 1. Other types of artistic performances
At the proposal of the Director of the Department of Cultural Heritage;
The Minister of Culture, Sports and Tourism issues this Circular regulating types of relics and antiques not allowed to be taken out of the country.
Article 1. Scope of Regulation
Article 1. This Circular regulates types of relics and antiques not allowed to be taken from Vietnam to other countries.
Article 2. Types of relics and antiques specified in this Circular shall not apply to cases where relics and antiques are taken out of the country for exhibition, display, research, or preservation purposes.
Article 2. Applicability
This Circular applies to Vietnamese organizations and individuals, and foreign organizations and individuals related to the act of taking relics and antiques from Vietnam to other countries.
Article 3. Types of relics and antiques not allowed to be taken out of the country
Point 1. Individual or parts of fossilized humans, animals, plants belonging to the Prehistoric period of Vietnam;
Point 2. Antiquities made of materials with significant historical, cultural, and scientific value belonging to the Prehistoric and Early Historic periods of Vietnam;
Point 3. Documents made of materials valuable for researching the history, culture, national sovereignty, and heroic national figures, influential personalities who have positively impacted the development of the nation of Vietnam;
Point 4. Relics and antiquities made of materials with significant historical, cultural, and scientific value belonging to the historical stages of Vietnam before September 1945;
Point 5. Manuscripts of literary works, original works of visual arts (painting, graphics, sculpture), high-value photographic works in terms of ideological content and artistic form, which have had a significant impact on society created from September 1945 to the present;
Point 6. Relics and antiquities made of materials with historical, cultural, and scientific value belonging to historical and cultural sites and scenic spots that have been ranked and inventoried;
Point 7. Relics and antiquities made of materials with significant historical, cultural, and scientific value of ethnic minorities within the territory of the Socialist Republic of Vietnam produced and created before 1975;
Point 8. Relics and antiquities made of materials with significant value related to important events and careers of prominent revolutionary activists, outstanding political and military figures during the establishment of the Party, the Democratic Republic of Vietnam, and the wars for national independence and reunification from September 1945 to the present;
Point 9. Antiquities made of materials with significant historical, cultural, and scientific value originating from abroad (except in cases of temporary import for re-export). A specific list of types of relics and antiques not allowed to be taken out of the country is attached to this Circular.
Article 4. Implementation provisions
Article 4. This Circular takes effect from February 15, 2013.
Article 5. The Heritage Department is responsible for implementing this Circular.
Article 6. In the course of implementation, if any difficulties arise, organizations and individuals are required to promptly report to the Ministry of Culture, Sports and Tourism for study and amendment./.
