CIRCULAR

Regulations on frequencies for emergency rescue, safety, search and rescue

at sea and civil aviation

Pursuant to the Radio Frequency Law dated November 23, 2009; the Civil Aviation Law dated July 12, 2006;

Based on Decree No. 132/2013/ND-CP dated October 16, 2013 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

Pursuant to Decree No. 95/2010/NĐ-CP dated September 16, 2010 of the Government on licensing and coordinating activities with foreign search and rescue forces in Vietnam.

Pursuant to Decision No. 125/2009/QĐ-TTg dated October 23, 2009 of the Prime Minister on promulgating the national radio frequency spectrum planning;

Pursuant to Decision No. 137/2007/QĐ-TTg dated August 21, 2007 of the Prime Minister approving the project to organize maritime safety information;

Pursuant to Decision No. 103/2007/QĐ-TTg dated July 12, 2007 of the Prime Minister on promulgating the regulations on coordination for maritime search and rescue;

Pursuant to Decision No. 33/2012/QĐ-TTg dated August 6, 2012 of the Prime Minister on promulgating the regulations on coordination for civil aviation search and rescue;

At the proposal of the Director of the Radio Frequency Management Department,

The Minister of Information and Communications issues this Circular on frequencies for emergency rescue, safety, search and rescue at sea and in civil aviation.

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates frequencies for emergency rescue, safety, search and rescue at sea and in civil aviation along with specific conditions for their use.

2. This Circular applies to:

a) Organizations and individuals participating in managing and using frequencies for emergency rescue, safety, search and rescue at sea and in civil aviation in Vietnam.

b) Foreign search and rescue forces permitted to use the frequencies specified in this Circular after obtaining permission to operate search and rescue activities in Vietnam according to Decree No. 95/2010/NĐ-CP dated September 16, 2010 of the Government on licensing and coordinating activities with foreign search and rescue forces in Vietnam.

Article 2. Provisions on frequencies for emergency rescue, safety, search and rescue

1. Frequencies for emergency rescue, safety, search and rescue and the provisions on their use are specifically stipulated in the Appendix attached to this Circular.

2. Frequencies for emergency rescue as stipulated in the Appendix of this Circular must be continuously monitored according to international regulations and regulations in specialized legal documents.

3. It is prohibited to cause harmful interference to the frequencies specified in the Appendix attached to this Circular.

Article 3. Provisions on test transmissions on frequencies for emergency rescue to check radio equipment

1. Test transmissions on frequencies for emergency rescue may only be conducted when it is necessary to check the operational capability of radio equipment on these frequencies. When conducting test transmissions, a notice must be broadcast to indicate that the transmission is for testing equipment.

2. In the maritime field, test transmissions on the 156.525 MHz frequency by selective calling method are not allowed; test transmissions may only be conducted on the 7903 kHz and 156.800 MHz frequencies by voice method, and on the 2187.5 kHz frequency by selective calling method according to the guidance of the Vietnam Coast Guard Radio Station.

3. In the civil aviation field, test transmissions may only be conducted on the 121.500 MHz and 123.100 MHz frequencies by voice method according to the guidance of the Vietnam Civil Aviation Administration.

Article 4. Effective date

This Circular takes effect from January 20, 2014.

Article 5. Transitional Provisions

Organizations and individuals who have been licensed to operate before this Circular takes effect but are not in compliance with this Circular shall be responsible for changing frequencies and radio equipment within a maximum period of five years from the date this Circular takes effect.

Article 6. Implementation Organization

1. The Radio Frequency Management Department shall be responsible for implementing and guiding relevant organizations and individuals to implement this Circular.

2. During implementation, if there are unreasonable aspects, they should be reported to the Ministry of Information and Communications for consideration and resolution./
