Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the High Technology Law dated November 13, 2008;
On the basis of the Investment Law dated November 26, 2014;
At the proposal of the Minister of Science and Technology,
The Prime Minister issues the Decision to specify criteria for determining high-tech enterprises.
Article 1. Criteria for determining high-tech enterprises
A high-tech enterprise is an enterprise that meets the criteria stipulated in Point a and b of Article 75 of the Investment Law, and at the same time meets the following specific criteria:
1. Revenue from high-tech products of the enterprise must account for at least 70% of the annual net revenue.
2. Total expenditure on research and development activities conducted in Vietnam must account for at least 1% of the annual net revenue for small and medium-sized enterprises. For enterprises with total capital exceeding 100 billion VND and a workforce exceeding 300 employees, this ratio must be at least 0.5%.
3. The number of employees with a bachelor's degree or higher directly engaged in research and development must account for at least 5% of the total workforce for small and medium-sized enterprises. For enterprises with total capital exceeding 100 billion VND and a workforce exceeding 300 employees, this ratio must be at least 2.5%, but not less than 15 people.
Article 2. Enterprises that have submitted applications for certification as high-tech enterprises before the effective date of this Decision, but have not yet been granted such certification, shall comply with the criteria specified in this Decision.
Article 3. This Decision takes effect from August 1, 2015.
Article 4. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decision./.
