This Circular guides the establishment of plans and the organization of implementation of working hours and rest time for workers engaged in seasonal production work and piecework manufacturing.on1. Workers who enter into fixed-term employment contracts with durations from twelve to thirty-six months and indefinite-term employment contracts performing the following work:iPursuant to the request of the Director General of the Department of Vocational Education;

The Minister of Science and Technology and the Minister of Labor, Invalids, and Social Affairs issue this Joint Circular to regulate the encouragement of scientific research, technology transfer, and application for the production of assistive products for persons with disabilities.iThis Joint Circular regulates the encouragement of scientific research aimed at persons with disabilities, assistive products for persons with disabilities; technology transfer and application for the production of assistive products for persons with disabilities.

Article 1. Scope of Regulation

This Joint Circular applies to organizations and individuals implementing science and technology tasks aimed at persons with disabilities, assistive products for persons with disabilities; organizations and individuals implementing technology transfer and application for the production of assistive products for persons with disabilities; state management agencies for science and technology; other organizations and individuals related to these matters.

Article 2. Applicability

This Circular applies to organizations and individuals implementing science and technology tasks aimed at persons with disabilities and assistive products; organizations and individuals implementing technology transfer and application for the production of assistive products for persons with disabilities; state agencies performing state management functions in science and technology; other related organizations and individuals.

Article 3. Explanation of Terms

Article 4. Sources of funding for implementing science and technology tasks aimed at persons with disabilities and assistive products for persons with disabilities

Assistive products for persons with disabilities are orthotic devices, means, and equipment for functional rehabilitation for persons with disabilities; means, equipment, and products supporting persons with disabilities in daily life, study, and work.

Article 4. Sources of Funding for Implementing Science and Technology Tasks Aimed at Persons with Disabilities and Assistive Products for Persons with Disabilities

1. State budget for science and technology of ministries, agencies equivalent to ministries, government agencies, central-level state agencies, and provincial People's Committees.

4. Other legitimate sources of funding.

2. National science and technology funds.

3. Investment funding for science and technology from organizations, individuals, and businesses.

Article 5. Principles for Compiling the State Budget Estimate for Science and Technology Tasks Aimed at Persons with Disabilities and Assistive Products for Persons with Disabilities

Article 6. Proposals and approval of scientific and technological tasks aimed at persons with disabilities and assistive products for persons with disabilities

1. Scientific and technological tasks aimed at persons with disabilities and assistive products for persons with disabilities proposed by organizations and individuals shall be submitted to the competent science and technology management agency according to the authority prescribed in Articles 26 and 27 of the Law on Science and Technology dated June 18, 2013 (hereinafter referred to as the Law on Science and Technology), specifically as follows:

a) The People's Committee of a province shall receive proposals for provincial-level scientific and technological tasks aimed at persons with disabilities and assistive products for persons with disabilities for consolidation and processing within its authority;

b) Ministries, ministerial-level agencies, government agencies, and other central state agencies shall receive proposals for ministry-level scientific and technological tasks aimed at persons with disabilities and assistive products for persons with disabilities for consolidation and processing within their authority;

c) The Ministry of Labor, Invalids, and Social Affairs shall receive proposals for national-level scientific and technological tasks aimed at persons with disabilities and assistive products for persons with disabilities for consolidation and processing within its authority; and propose to order the Ministry of Science and Technology to implement national-level scientific and technological tasks aimed at persons with disabilities and assistive products for persons with disabilities;

d) Basic-level scientific and technological organizations and competent authorities not covered under points a, b, and c of this Clause shall receive proposals, approve, and sign contracts to implement basic-level scientific and technological tasks aimed at persons with disabilities and assistive products for persons with disabilities in accordance with Article 28 of Decree No. 08/2014/ND-CP dated January 27, 2014 of the Government detailing and guiding the implementation of certain provisions of the Law on Science and Technology.

2. State management agencies for science and technology at all levels shall approve scientific and technological tasks using state budget funds aimed at persons with disabilities and assistive products for persons with disabilities; recognize the results of implementing scientific and technological tasks aimed at persons with disabilities and assistive products for persons with disabilities.

Article 7. Incentives for implementing scientific and technological tasks aimed at persons with disabilities and assistive products for persons with disabilities

1. The State shall consider supporting up to a maximum of 50% of the total investment capital (excluding the residual value or depreciation costs of existing equipment and factories included in the total investment capital) to implement pilot production projects aimed at persons with disabilities and assistive products for persons with disabilities.

The content of support shall be implemented in accordance with Circular Joint No. 22/2011/TTLT-BTC-BKHCN dated February 21, 2011 of the Ministry of Finance and the Ministry of Science and Technology guiding financial management for pilot production projects supported by state budget funds.

2. Incentives for implementing scientific and technological projects supporting investment in producing assistive products for persons with disabilities:

a) The State shall consider supporting up to a maximum of 50% of the labor remuneration costs for scientific staff and technical personnel directly involved in researching and perfecting technological processes, scientific and technological solutions, developing computer software; testing, analyzing, inspecting, and evaluating product quality until the completion of the first batch of products;

b) The State shall consider supporting up to a maximum of 30% of the costs for purchasing materials, raw materials, fuel, measuring and analytical equipment during the testing and production of the first batch of products from the production line;

c) The State shall consider supporting up to a maximum of 50% of the costs for implementing technology transfer activities, including: technical secrets; technical knowledge about technology transferred in the form of technological plans, technological processes, technical solutions, formulas, technical parameters, technical drawings, computer programs, data information; rationalization of production, technological innovation; procurement and import of domestically produced machinery and equipment that has not yet been developed.

The forms and methods of technology transfer activities are stipulated in Articles 12 and 18 of the Law on Technology Transfer dated November 29, 2006. The level of support shall be carried out in accordance with the financial management regime guidance document of the National Science and Technology Development Fund.

3. The results of implementing scientific and technological tasks aimed at persons with disabilities and assistive products for persons with disabilities shall be considered by the National Science and Technology Development Fund for funding to register intellectual property protection both domestically and internationally for inventions in accordance with the regulations of the Fund.

4. Individuals participating in implementing scientific and technological tasks aimed at persons with disabilities and assistive products for persons with disabilities shall be prioritized to access, exploit, search, and use scientific and technological information sources at the National Science and Technology Information Center.

5. Organizations primarily responsible for implementing scientific and technological tasks aimed at persons with disabilities and assistive products for persons with disabilities shall be granted ownership or usage rights over research results as stipulated in Clause 3, Article 41 of the Law on Science and Technology by the State.

Article 8. Incentives for enterprises engaged in technology transfer and application to produce assistive products for persons with disabilities

1. Enterprises involved in activities related to technology transfer and application from scientific and technological tasks funded by state budget as stipulated in Clause 2, Article 6 of this Joint Circular shall enjoy the following incentives:

a) Enjoy tax incentives for technology transfer activities in accordance with current tax laws, and at the same time enjoy other state tax incentives for the field of science and technology as provided for in current tax laws;

b) Be prioritized for leasing land plots, water surfaces, and infrastructure facilities for production and business operations in industrial parks, export processing zones, economic zones, and high-tech zones in accordance with the provisions of the law.

2. Enterprises involved in activities related to technology transfer and application to produce assistive products for persons with disabilities from scientific and technological tasks not funded by the state budget, confirmed by competent state management agencies on science and technology, shall be considered for and enjoy incentives similar to those for enterprises specified in Clause 1 of Article 8 of this Joint Circular.

The confirmation of results of scientific and technological tasks not funded by the state budget shall be carried out in accordance with Circular No. 02/2015/TT-BKHCN dated March 6, 2015, issued by the Minister of Science and Technology regarding the evaluation and verification of the implementation results of scientific and technological tasks not funded by the state budget.

Article 9. Implementation Provisions

1. This Joint Circular shall take effect from January 1, 2016;

If the referenced documents in this Joint Circular are amended, supplemented, or replaced, they shall be implemented according to the newly issued documents.

Article 10. Responsibility for Implementation

The Ministry of Science and Technology shall take the lead and coordinate with the Ministry of Labor, Invalids, and Social Affairs to guide and implement this Joint Circular.

During the implementation process, if there are any difficulties, organizations and individuals are requested to report to the Ministry of Science and Technology and the Ministry of Labor, Invalids, and Social Affairs for consideration and appropriate amendments and supplements.
