CIRCULAR

Providing detailed guidance on Article 4 of Government Decree No. 35/2015/NĐ-CP dated April 13, 2015 regarding management and use of rice-growing land.

Pursuant to the Land Law promulgated on December 9, 2013;

Pursuant to Government Decree No. 199/2013/NĐ-CP dated November 26, 2013 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Government Decree No. 35/2015/NĐ-CP dated April 13, 2015 regarding management and use of rice-growing land;

At the proposal of the Director of the Crop Production Department;

The Minister of Agriculture and Rural Development issues this Circular providing detailed guidance on Article 4 of Government Decree No. 35/2015/NĐ-CP dated April 13, 2015 regarding management and use of rice-growing land.

Article 1. Scope of Application

This Circular provides guidance on the procedures for registering changes in crop structure from growing rice to annual crops or combined rice farming with aquaculture on rice-growing land.

Article 2. Applicability

This Circular applies to agencies, organizations, households, individuals within Vietnam and foreign organizations and individuals related to changing from growing rice to annual crops or combined rice farming with aquaculture on rice-growing land.

Article 3. Procedures for Registering Changes in Crop Structure on Rice-Growing Land

Clause 1. Organizations, households, and individuals legally using rice-growing land (land users) who wish to change the crop structure on such land shall submit directly to the People's Committee of the commune one Application Form for Changing Crop Structure on Rice-Growing Land in accordance with Model I attached hereto.

Clause 2. In cases where the application form is valid and consistent with the commune’s plan for changing crop structures, within five (5) working days, the People's Committee of the commune shall issue an opinion “Agree to Change,” stamp on the application form, record it in the monitoring book, and return the form to the land user.

Clause 3. In cases where the application form is invalid, the People's Committee of the commune must guide the land user to correct or supplement the application form.

Clause 4. In cases where the change is not agreed upon, the People's Committee of the commune shall respond in writing to the land user, stating the reasons, according to Model II attached hereto.

Article 4. Responsibilities of State Management Agencies

1. The Crop Production Department

a) Inspect the implementation of crop structure adjustment on rice-growing land in localities;

b) Annually compile and report to the Ministry of Agriculture and Rural Development the results of crop structure adjustment on rice-growing land nationwide.

2. Departments of Agriculture and Rural Development

Annually compile and report to provincial People's Committees and the Ministry of Agriculture and Rural Development (through the Crop Production Department) the results of crop structure adjustment on rice-growing land in their respective localities.

Article 5. Implementation Provisions

1. This Circular takes effect from August 10, 2016.

2. This Circular replaces Circular No. 47/2013/TT-BNNPTNT dated November 8, 2013 of the Minister of Agriculture and Rural Development on

guiding the conversion from rice-growing land to annual crop cultivation and integrated rice-fish farming.

3. During implementation, any difficulties encountered should be reported to the Ministry of Agriculture and Rural Development for consideration and resolution./.
