Regulations on the wage system for defense workers and seniority allowances for defense officials
Pursuant to the Law on Competition and Rewards dated December 26,, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP ficer Ch"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."36/2016/NĐ-CP dated May 15, 2016 of the Government on medical equipment management.

Article 1. Scope of Regulation
This Decree stipulates the wage system for defense workers and seniority allowances for defense officials.
Article 2. Applicability
1. Defense workers as prescribed in Clause 2, Article 3 of the Law on Professional Military Personnel, Defense Workers, and Defense Officials.
2. Defense officials as prescribed in Clause 3, Article 3 of the Law on Professional Military Personnel, Defense Workers, and Defense Officials.
3. Relevant agencies, units, organizations, and individuals.
Article 3. Wage System for Defense Workers
1. The pay scale for defense workers is prescribed in the Appendix attached hereto.
2. Defense workers shall enjoy various types of allowances and subsidies including:
a) Seniority allowance exceeding the ceiling;
b) Area allowance;
c) Special allowance;
d) Hazardous and dangerous work allowance;
đ) Responsibility work allowance;
The conditions, duration, and levels of allowances at Points a, b, c, d, đ of this Clause shall be implemented as prescribed in Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the wage system for cadres, civil servants, officials, and armed forces personnel.
e) Duty allowance:
- Applicable to defense workers receiving wages from the state budget;
- The conditions, time period, and level of duty allowance shall be implemented as prescribed in Decree No. 34/2012/NĐ-CP dated April 15, 2012 of the Government on duty allowance regulations.
g) Allowance and subsidies for working in areas with particularly difficult socio-economic conditions:
The conditions, duration, and levels of allowances shall be implemented as prescribed in Decree No. 116/2010/NĐ-CP dated December 24, 2010 of the Government on policies for cadres, civil servants, officials, and personnel receiving wages working in areas with particularly difficult socio-economic conditions.
3. Promotion of pay grade and type for defense workers
a) Promotion of pay grade:
After two years (full 24 months) holding the current pay grade for those with a salary coefficient of 3.95 or less, and after three years (full 36 months) holding the current pay grade for those with a salary coefficient above 3.95, consistently completing assigned tasks, not violating discipline at or above the level of reprimand, and meeting the technical rank standards set forth, they will be considered for promotion to the next higher pay grade.
During the period of considering promotion to a higher pay grade, if they are disciplined with a reprimand, the promotion period will be extended by six months; if they are disciplined with a warning or higher, the promotion period will be extended by twelve months.
In cases of outstanding achievements in performing tasks, they may be promoted ahead of schedule by up to twelve months or skip a pay grade.
b) Promotion of type:
Defense workers who perform their duties well or exceptionally, have good political qualities and morals, possess the ability to take on higher positions within the same technical profession, and hold appropriate qualifications shall be considered for or tested for promotion to a higher type.
Article 4. Transfer of Pay Grade
1. Principles of transfer of pay grade
When transferring pay grades, it shall not be combined with promotion of pay grade or type, or salary grade.
2. Transfer of pay grade
The transfer of pay grade from the current salary coefficient to the salary coefficient prescribed in the Defense Worker Pay Scale issued in the Appendix attached hereto shall be based on the time of work with social insurance contributions (if there are intermittent periods of social insurance contributions without receiving a one-time social insurance allowance, these periods shall be accumulated), consistent with the position and as prescribed in Point a, Clause 3, Article 3 of this Decree.
In cases where the new salary coefficient plus any excess seniority allowance (if applicable) is lower than the current salary coefficient plus any excess seniority allowance (if applicable) and the national defense and security service allowance, they shall continue to enjoy the difference in the salary coefficient, excess seniority allowance (if applicable), and national defense and security service allowance currently received. The retained salary coefficient difference will decrease gradually when the pay grade is promoted.
Article 5. Seniority Allowance System for Workers and Defense Civil Servants
1. Level of Allowance
Workers and defense civil servants who have served in the regular forces of the military for five years (sixty months) shall be entitled to a seniority allowance equal to 5% of their current salary plus leadership position allowance and seniority allowance exceeding the ceiling (if applicable); from the sixth year onwards, each year (twelve months) shall add an additional 1%.
The seniority allowance shall be paid together with monthly salary and used to calculate contributions and benefits for social insurance, health insurance, unemployment insurance, and occupational accident and occupational disease insurance.
2. Time for Receiving Allowance
a) Time served in the regular forces of the military;
b) Time receiving seniority allowance in other professions shall be accumulated with the time specified in point a of this clause to calculate the seniority allowance.
3. Time Not Counted for Receiving Allowance
a) Time off without pay for personal reasons for one month or more continuously;
b) Sick leave and maternity leave exceeding the period prescribed by the Law on Social Insurance;
c) Time being temporarily suspended from work or detained for investigation, prosecution, or trial purposes.
Article 6. Financial Resources
1. For budget units funded by the state budget in accordance with the State Budget Law and current guiding documents.
2. For enterprises that are included in deductible expenses when determining corporate taxable income.
Article 7. Effective Date
1. This Decree takes effect from April 15, 2017.
2. The systems stipulated in this Decree shall be applied starting July 1, 2016.
3. Defense workers applying the salary scale prescribed in this Decree shall not be entitled to the defense and security service allowance as stipulated in point d, Clause 8, Article 6 of Government Decree No. 204/2004/NĐ-CP dated December 14, 2004 on the wage system for officials, civil servants, employees, and armed forces.
Article 8. Responsibility for Implementation
The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial and centrally governed city People's Committees are responsible for implementing this Decree.
