Pursuant to the Law on Government Organization dated June 19, 2015;
Pursuant to the Law on Public Debt Management dated June 17, 2009;
Pursuant to Decree No. 16/2016/NĐ-CP dated March 16, 2016 of the Government on the management and use of official development assistance (ODA) and concessional loans from foreign donors;
Pursuant to Decree No. 78/2010/NĐ-CP dated July 14, 2010 of the Government on relending government foreign loan sources;
Pursuant to Decree No. 16/2015/NĐ-CP dated February 14, 2015 of the Government stipulating the self-management mechanisms of public service units;
At the proposal of the Minister of Finance;
The Prime Minister issues the financial mechanism for pilot application to programs and projects using ODA funds and preferential loans in the health sector.
Article 1. Scope of Regulation and Applicability
1. Scope of Regulation:
This Decision regulates the financial mechanism for pilot application to programs and projects using ODA funds and preferential loans in the health sector.

This Decision applies to agencies, organizations, and individuals related to the management and implementation of ODA and preferential loan programs and projects in the health sector.
Article 2. Contents of Domestic Financial Mechanism
The domestic financial mechanism for programs and projects using ODA funds and preferential loans in the health sector shall be applied as follows:
1. For programs and projects investing in infrastructure, social welfare, or other areas without the ability to directly recover capital, which are part of central budget expenditure tasks: allocate 100% of ODA and preferential loan funds.
2. For programs and projects investing in infrastructure, social welfare, or other areas without the ability to directly recover capital, which are part of local budget expenditure tasks:
a) Allocate 100% of non-reimbursable ODA assistance funds;
b) The central budget will support partial allocation and relend a portion according to the legal provisions on relending government foreign loan sources to provincial and centrally-administered city people's committees.
3. For programs and projects with the ability to fully or partially recover capital:
a) For programs and projects implemented by public medical examination and treatment facilities: allocate 100% of non-reimbursable ODA assistance funds; lend at 20% interest on ODA loans and 50% on preferential loans;
b) For programs and projects implemented by non-public medical examination and treatment facilities: relend 100% of foreign funds.
4. In cases where it is necessary to apply a different financial mechanism than this one, the Ministry of Finance shall take the lead and coordinate with relevant agencies to submit to the Prime Minister for consideration and decision.
Article 3. Implementation Provisions
1. This Decision takes effect from July 20, 2017. Programs and projects using ODA and preferential loans whose financial mechanisms have been approved by competent authorities before the effective date of this Decision continue to apply the approved financial mechanisms.
2. Ministers, heads of ministerial-level agencies, heads of governmental agencies, Chairpersons of provincial and centrally-administered city people's committees are responsible for implementing this Decision./.
