CIRCULAR
Regulations on criteria and indicators for evaluating the quality of public service provision
regarding the establishment and adjustment of inter-reservoir operation procedures in cross-provincial river basins
Pursuant to Decree No. 16/2015/NĐ-CP dated February 14, 2015 of the Government on the mechanism of autonomy for public institutions;
On the basis of Decision No. 36/2017/NĐ-CP dated April 4, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
Pursuant to Decision No. 1990/QĐ-TTg dated December 11, 2017 of the Prime Minister promulgating the list of public services funded by the State budget under the management of the Ministry of Natural Resources and Environment;
At the proposal of the Director of the Science and Technology Department and the Director of the Legal Department;
The Minister of Natural Resources and Environment issues this Circular stipulating criteria and indicators for evaluating the quality of public service provision regarding the establishment and adjustment of inter-reservoir operation procedures in cross-provincial river basins.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
Article 1. This Circular stipulates criteria and indicators for evaluating the quality of public service provision funded by the State budget regarding the establishment and adjustment of inter-reservoir operation procedures in cross-provincial river basins issued by competent authorities (hereinafter referred to as establishing procedures).
Article 2. This Circular does not regulate the evaluation of the quality of service in operating inter-reservoir operation procedures in cross-provincial river basins.
Article 2. Applicability
This Circular applies to state administrative agencies, public institutions, and organizations and individuals providing services for establishing procedures.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
Point 1. The quality of public service provision regarding the establishment of procedures is the aggregate result of indices reflecting the level of satisfaction of users with the service.
Point 2. Criteria for evaluating the establishment of procedures are the contents and requirements that the service provider must meet to achieve the set objectives.
Point 3. Indicators for evaluating the establishment of procedures are the degree of requirement and conditions concerning a specific aspect of the evaluation criteria.
Chapter II
CRITERIA AND INDICATORS FOR EVALUATING THE QUALITY OF PUBLIC SERVICE PROVISION REGARDING THE ESTABLISHMENT OF PROCEDURES
SERVICES OF PUBLIC ADMINISTRATIVE PROCEDURES
1. Criterion 1: Functions, tasks, material and technical foundations of organizations providing services to prepare national environmental status reports.
Clause 1. Criterion 1: Functions, tasks, or business registration of the organization providing services for establishing procedures.
Clause 2. Infrastructure and technical facilities serving the establishment of procedures.
Clause 3. Human resources serving the establishment of procedures.
Clause 4. Information and data serving the establishment of procedures.
Clause 5. Attitude during the process of establishing procedures.
Clause 6. Products of the service for establishing procedures.
1. Evaluation Indicators:
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
Subpoint a. Established in accordance with the law, having functions and tasks related to establishing procedures;
Subpoint b. Experience in providing services for establishing procedures: Number of years of experience in establishing procedures (as the main organizer, collaborator); number of procedures already issued.
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
b) Decisions approving completion by competent authorities regarding the task of drafting national environmental status reports or specialized environmental status reports;
Subpoint b. Decision approving the content and budget estimate of the Project and any subsequent adjustment decisions;
Subpoint c. Decision establishing the drafting team for establishing procedures.
Article 6. Indicators and Basis for Evaluating Criterion 2
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
Subpoint a. Models, calculation software, machinery, equipment, tools serving the establishment of procedures;
Subpoint b. Compliance with technical regulations and economic-technical norms during the establishment of procedures.
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
Subpoint a. Annual statistical data on assets of the service-providing organization;
Subpoint b. Compliance with technical regulations and economic-technical norms during the establishment of procedures: Application of technical regulations and economic-technical norms that have been issued and are still valid during the establishment of procedures.
Article 7. Indicators and Basis for Evaluating Criterion 3
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
Subpoint a. Number of personnel directly involved in establishing procedures;
Subpoint b. Quality of personnel directly involved in establishing procedures.
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
Subpoint a. Statistical data, human resource files, and labor contracts, expert hiring contracts of the service-providing organization;
Subpoint b. Economic-technical norms for establishing procedures.
Article 8. Indicators and Basis for Evaluating Criterion 4
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
Subpoint a. Collection and compilation of information and data relevant to the establishment of procedures (field surveys, measurements, supplementary information and data on meteorology, hydrology, topography, river cross-sections);
Subpoint b. Compilation, analysis, and processing of collected and surveyed information and data related to the establishment of procedures;
c) The source of input information and data;
Subpoint d. Timeliness of information and data up to the time of establishing procedures.
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
Subpoint a. List of input information and data (indicating sources) serving as the basis for establishing procedures by the service-providing organization;
Subpoint b. Updating of data, information, and survey results by the service-providing organization based on feedback from organizations and individuals.
Article 9. Indicators and Basis for Evaluating Criterion 5
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
Subpoint a. Transparency during the establishment of procedures;
Subpoint b. Soliciting opinions from relevant agencies on monitoring stations;
Subpoint c. Adequate explanation of all feedback, including social feedback;
Subpoint d. Self-inspection and supervision of the procedure establishment process by the service-providing organization.
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
Subpoint a. Transparency in the development and implementation progress of the procedure establishment process by the main organizing organization, including: timing, duration, and content of draft publication and solicitation of opinions from organizations and individuals through mass media as prescribed; solicitation of opinions from organizations and individuals through other forms;
Subpoint b. Request for comments letters, meeting minutes, summary tables, explanations, and improvements according to comments;
Subpoint c. Adequate explanation of all feedback, including social feedback: Content of the report explaining, extent of adoption of explanations compared to comments;
Subpoint d. Self-inspection and supervision of the procedure establishment process by the service-providing organization: Compliance of the service-providing organization with inspection and supervision during the procedure establishment process.
Article 10. Indicators and Basis for Evaluating Criterion 6
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
Subpoint a. Draft Procedure;
Subpoint b. Special reports, comprehensive reports, and summaries of the results of the procedure establishment;
Subpoint c. Maps (topographic, river network, meteorological and hydrological observation stations, water resources and water utilization facilities), related diagrams during the procedure establishment process (calculation diagrams, rainfall frequency curves, annual flow standards);
Subpoint d. Data generated during the procedure establishment process (collected data; measurement, survey, river and stream cross-sections, model calculations, meteorological and hydrological data, and other relevant information and data);
Subpoint f. CD recording all products of the procedure establishment process;
Subpoint e. Approved and issued operation procedure.
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
Subpoint a. Completed draft procedure;
Subpoint b. Statistical report and submission of products by the procedure establishment organization;
Subpoint c. Inspection and acceptance evaluation record of the procedure establishment service by the ordering agency or the competent state management agency;
Subpoint d. Decision of the Prime Minister on issuing the procedure.
Article 11. Evaluation of the quality of public service provision regarding process establishment
1. The evaluation of the quality of public service provision regarding process establishment shall be conducted through scoring. The evaluation scale is 100 points. The specific evaluation scale is determined for each individual indicator as prescribed in Articles 5, 6, 7, 8, 9, and 10, and detailed in the Appendix attached to this Circular.
2. Service quality is evaluated at four levels:
a) Excellent: When the total score reaches 80 points or more, with the total score of the indicators specified in Article 10 of this Circular reaching 20 points or more;
b) Good: When the total score ranges from 70 to less than 80 points, with the total score of the indicators specified in Article 10 of this Circular reaching 18 points or more;
c) Satisfactory: When the total score ranges from 50 to less than 70 points, with the total score of the indicators specified in Article 10 of this Circular reaching 13 points or more;
d) Unsatisfactory: When the total score is less than 50 points, or the total score of the indicators specified in Article 10 of this Circular is less than 12 points.
Chapter III
IMPLEMENTING PROVISIONS
Article 12. Effective Date
This Circular takes effect from December 20, 2018.
Article 13. Implementation Organization
1. The Department of Science and Technology, Ministry of Natural Resources and Environment shall be responsible for organizing guidance on the implementation and monitoring the execution of this Circular;
2. Units under the Ministry of Natural Resources and Environment and relevant organizations and individuals are responsible for implementing this Circular.
During the implementation, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to promptly reflect them to the Ministry of Natural Resources and Environment for research, consideration, and appropriate amendment;
