Guidelines for Establishing Economic and Technical Standards for Medical Examination and Treatment Services under the Management of the Ministry of Health
THE MINISTER OF HEALTH
Pursuant to the Law on Medical Examination and Treatment No. 40/2009/QH12;
Pursuant to the Law on Prices No. 11/2012/QH13 amended and supplemented by Law No. 61/2014/QH13 and Law No. 64/2020/QH14;
Pursuant to the Government Decree No. 60/2021/NĐ-CP dated June 21, 2021 on the mechanism of self-management of public service units;
Pursuant to Decree No. 95/2022/NĐ-CP dated November 15, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
At the proposal of the Director of the Department of Medical Examination and Treatment Management;The Minister of Health issues this Circular guiding the establishment of economic and technical standards for medical examination and treatment services under the management of the Ministry of Health.
This Circular stipulates the contents, principles, and methods for calculating economic and technical standards for day-bed and technical medical examination and treatment services (hereinafter referred to as medical examination and treatment services).
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
Article 1. Economic and technical standards for medicines, implant materials, tools, materials, test reagents, in vitro calibration substances, and other supplies (hereinafter referred to as medicines and medical supplies) are the quantities of medicines and medical supplies consumed directly to provide one medical examination and treatment service.
Article 2. Interpretation of Terms
In this Circular, the following terms shall be understood as follows:
Article 2. Equipment standards are the necessary usage time for each type of equipment used directly to provide one or more medical examination and treatment services at the same time.
Article 3. Direct labor standards are the consumption levels of the number of workers and working hours required to provide one medical examination and treatment service.
Article 4. Contents and Application of Economic and Technical Standards for Medical Examination and Treatment Services
Clause 1. Economic and technical standards for medical examination and treatment services include:
a) Direct labor standards;
b) Medicine and medical supply standards;
c) Equipment standards (excluding medical supplies).
Clause 2. Economic and technical standards are used as the basis for calculating the price of medical examination and treatment services, including:
a) Direct labor standards serve as the basis for calculating wage costs;
b) Medicine and medical supply standards serve as the basis for calculating direct costs;
c) Equipment standards (excluding medical supplies) serve as the basis for calculating depreciation costs.
Clause 3. Factors forming prices that are not specified in Clause 1 of this Article (such as infrastructure depreciation; maintenance and repair of infrastructure and equipment; energy and fuel; infection control; management and operation) shall be determined according to the price construction methods prescribed by laws on prices.
Article 5. Principles for Establishing and Applying Economic and Technical Standards
Clause 1. Economic and technical standards are established based on science, in line with reality, following the principle of average advanced calculation.
Clause 2. Economic and technical standards shall not be used as the basis for assessing the costs of medical examination and treatment services already provided.
CALCULATION OF ECONOMIC AND TECHNICAL STANDARDS
Chapter II
Article 6. Calculation of Direct Labor Standards
Direct labor standards are calculated based on the quantity of people, hours, and professional qualifications of workers needed to provide one medical examination and treatment service.
Article 7. Calculation of Medicine and Medical Supply Standards
Clause 1. Determine the list and types of medicines and medical supplies needed when providing each medical examination and treatment service to calculate the economic and technical standards. Medicines and medical supplies used but not included in the economic and technical standards will be calculated according to Clause 3 of Article 3 of this Circular.
Clause 2. Determine medicine and medical supply standards according to the guidance or regulations of the manufacturer or other relevant regulations.
Clause 3. For medicines and medical supplies where one unit can be used for more than one medical examination and treatment service (for example, probes, ultrasound gel, uniforms of staff), the standard is calculated using the following formula:

Article 7. Calculation of Equipment Standards
1. Identify the location where the medical examination and treatment service is performed (for example, operating room, minor surgery room, laboratory).
2. Inventory the equipment used to complete one medical examination and treatment service, including equipment used directly in the technique and shared equipment of the technical room (such as air conditioning, lighting).
3. Determine the equipment standard by determining the necessary usage time for each type of equipment to perform one or multiple instances of medical examination and treatment services at the same time.
Chapter III
IMPLEMENTATION AND RESPONSIBILITY FOR ENFORCEMENT
Article 8. Implementation organization
1. The Department of Medical Examination and Treatment shall be responsible for:
a) Advising the Minister of Health on assigning tasks to agencies and units to establish economic and technical standards for medical examination and treatment services in accordance with this Circular;
b) Leading the review of economic and technical standards for medical examination and treatment services established in accordance with point a of this Clause and submitting them to the Minister of Health for consideration and approval of the economic and technical standards for medical examination and treatment services;
c) Directing, guiding, summarizing, and inspecting the implementation of this Circular.
2. The Department of Traditional Medicine Management, the Department of HIV/AIDS Prevention and Control shall lead the establishment and review of economic and technical standards for medical examination and treatment services in their respective fields as stipulated in Clause 1, Article 3 of this Circular and submit them to the Minister of Health for consideration and approval of the economic and technical standards for medical examination and treatment services.
3. The Department of Planning and Finance shall be responsible for:
a) Advising the Minister of Health on allocating funds to implement the task of establishing economic and technical standards;
b) Cooperating with the Department of Medical Examination and Treatment, the Department of Traditional Medicine Management, and the Department of HIV/AIDS Prevention and Control in the establishment and review of economic and technical standards before submitting them to the Minister of Health for consideration and approval.
Article 9. Effective Date
This Circular takes effect from February 15, 2023.
Article 10. Responsibility for Implementation
The Director of the Department of Medical Examination and Treatment, the Head of the Department of Planning and Finance, the Director of the Ministry's Office, the Chief Inspector of the Ministry, Heads of Departments and Bureaus under the Ministry of Health, Heads of subordinate units of the Ministry of Health, relevant organizations, and individuals are responsible for enforcing this Circular. In the course of implementation, if there are difficulties or obstacles, organizations and individuals should report to the Ministry of Health (Department of Medical Examination and Treatment) for guidance or research to amend and supplement accordingly.
