Regulations on the establishment, review, allocation, adjustment, monitoring, and evaluation of investment plans, programs, tasks, and projects under the National Information System and Database on Public Investment

Pursuant to Decree No.Decision No. 27/2022/NĐ-CP dated April 19, 2022 of the Government on mechanisms for managing and implementing national target programs and Decision No.Public Investment Law;

Pursuant to Decree No.38/2023/NĐ-CP dated June 24, 2023 amending and supplementing certain provisions of Decision No.27/2022/NĐ-CP dated April 19, 2022;Decision No. 89/2022/NĐ-CP dated October 28, 2022 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;

Pursuant to Decree No.At the proposal of the Director of the Department of National Economic Synthesis;

The Minister of Planning and Investment issues this Circular to regulate the establishment, review, allocation, adjustment, monitoring, and evaluation of public investment plans, programs, tasks, and projects on the National Information System and Database on Public Investment.

This Circular details the implementation of certain provisions of the Public Investment Law and the Decree detailing certain provisions of the Public Investment Law on the National Information System and Database on Public Investment (hereinafter referred to as the System), including:

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

1. Establishing, reviewing, allocating, adjusting, monitoring, and evaluating medium-term and annual public investment plans using central government budget funds, local government budget funds, and lawful revenues of state agencies and public service units designated for investment.

2. Monitoring and evaluating public investment plans utilizing contingency reserves, increased revenues, savings, surplus funds, and other budgetary resources for development investment.

3. Managing information and data, monitoring, and evaluating programs, tasks, projects, and other public investment objects using public investment funds on the System.

1. Agencies, units, organizations, and individuals participating in or related to the establishment, review, allocation, adjustment, monitoring, and evaluation of public investment plans, programs, tasks, projects, and other public investment objects on the System within the scope regulated by Article 1 of this Circular.

Article 2. Applicability

2. This Circular does not apply to programs, tasks, projects, and other public investment objects that require state secrets according to laws on protecting state secrets.

In addition to terms defined in the Public Investment Law and the Decree detailing certain provisions of the Public Investment Law, some terms in this Circular are understood as follows:

Article 3. Explanation of Terms

Code of Programs, Tasks, Projects, and Other Public Investment Objects on the System

1. is the unique identification code of programs, tasks, projects, and other public investment objects on the System.Digital signature used in the System

2. is a specialized digital signature for official duties or a public digital signature (for agencies, units, organizations, and individuals not eligible for new specialized digital signature certificates for official duties).Entering and updating information and data on the System

3. is the act of providing and transmitting information and figures of plans, programs, tasks, projects, and other public investment objects according to fields established by the System. Information and data in the System are original information and data of programs, tasks, projects, and other public investment objects and public investment plans.Public Investment Plan Report on the System

4. is a report directly extracted from existing information and data on the System, each report will be assigned one management code according to the System's specific format.Project status

5. is the project status corresponding to the planning period (medium-term and annual public investment plans) including: preparation for investment, commencement of new construction, continuation of completion within the planning period, continuation of completion after the planning period, completed and handed over for use. the status of the corresponding project for the relevant period (medium-term and annual public investment plans) includes: investment preparation, new commencement, continuation to completion within the period, continuation to completion after the period, completed and handed over for use.

Article 4. Account issuance, authorization allocation, and information/data verification

Based on the account registration proposals from Ministries, central agencies, and localities, the Ministry of Planning and Investment will issue accounts and allocate authorizations according to the registered requirements. The proposal, submission, approval, and reporting of information/data on the System shall be based on the allocated authorizations of the registered accounts and must be verified with the digital signature of the account management staff in accordance with the System's procedures.

Article 5. Information and data of programs, tasks, projects

1. Information and data of programs, tasks, projects, and other public investment objects on the System: Program, task, project, and other public investment object codes issued by the System; budget-related unit code of programs, tasks, projects, and other public investment objects issued by the Ministry of Finance’s system; approval information for investment policies of programs and projects, decision information approving the budget estimate for preparatory tasks of projects, planning tasks, investment decisions for projects, and adjustment decisions (if any); project status according to the System's requirements.

2. Information and data on public investment plans, implementation status, and disbursement of projects: The information and data stipulated in this clause will be compiled by the System from the content of reports on the implementation progress as prescribed in Article 13 of this Circular.

3. Documents and materials of programs, tasks, and projects that must be uploaded to the System:

a) Project investors and component project managers must upload the following documents to the System within seven working days from the date of issuance, including:

- Decision approving the task and budget estimate for preparatory investment;

- Resolution, Decision approving or adjusting the investment policy (if any);

- Investment Decision, Adjusted Investment Decision (if any);

- Resolution, Decision allocating or adjusting the medium-term and annual public investment plan of the competent authority;

- Decision approving the final settlement of the project investment capital;

b) Program managers must upload the following documents to the System within seven working days from the date of issuance, including:

- Resolution of the competent authority approving the investment policy for the public investment program;

- Prime Minister's Decision approving the public investment program;

c) Documents uploaded to the System must be scanned copies of the original documents or electronic documents with digital signatures;

d) In addition to the above information and documents, it is encouraged for project investors, component project managers, and program managers to update all relevant documents according to the functions of the System.

Chapter II
ESTABLISHMENT, REVIEW, ALLOCATION, AND ADJUSTMENT OF THE PUBLIC INVESTMENT PLAN

FOR THE MEDIUM TERM AND ANNUAL ON THE SYSTEM

Article 6. Establishment, review, allocation, and adjustment of the medium-term public investment plan funded by the central budget

1. Establishment, review, and allocation of the medium-term public investment plan funded by the central budget

a) Based on the notification from the Prime Minister regarding the total investment capital for public works from the central budget expected for each Ministry, central agency, and locality in the subsequent phase, the Ministry of Planning and Investment will enter the expected total investment capital for public works from the central budget for each Ministry, central agency, and locality in the subsequent phase, notify on the System for each Ministry, central agency, and locality to forecast the distribution plan and establish, review, and submit to the competent authority for approval of the investment policy for programs and projects in the subsequent phase;

b) Each Ministry, central agency, and locality will enter the forecasted medium-term public investment plan funded by the central budget for the subsequent phase, including the list, the expected capital allocation for each program, task, project, and other public investment objects with complete information as required by the System, and upload along with the report of each Ministry, central agency, and provincial People's Committee to the Ministry of Planning and Investment on the System;

c) By the end of January 31 of the fifth year of the previous medium-term public investment plan phase, based on the forecasted medium-term public investment plan funded by the central budget for the subsequent phase entered and sent by each Ministry, central agency, and locality on the System, the Ministry of Planning and Investment will close the System to review the distribution plan of the medium-term public investment plan funded by the central budget for each Ministry, central agency, and locality according to regulations. During the review process, the data will be returned to each Ministry, central agency, and locality for completion according to the review comments;

d) Based on the review comments from the Ministry of Planning and Investment, each Ministry, central agency, and locality will update the completed medium-term public investment plan funded by the central budget for the subsequent phase and upload along with the report of each Ministry, central agency, and provincial People's Committee to the Ministry of Planning and Investment on the System before June 30 of the fifth year of the previous medium-term public investment plan phase;

đ) Based on the Decision allocating the medium-term public investment plan funded by the central budget of the Prime Minister, the Ministry of Planning and Investment will enter the medium-term public investment plan funded by the central budget already allocated by the Prime Minister into the national database on public investment, including the total amount and structure of capital for each Ministry, central agency, and locality, the list, and the amount of capital allocated for each program, task, project, and other public investment objects, and notify each Ministry, central agency, and locality on the System;

e) For the medium-term public investment plan funded by the central budget that has not been allocated or the common reserve fund of the medium-term public investment plan funded by the central budget (if any), in cases where permission is granted by the competent authority to use, the Ministry of Planning and Investment and each Ministry, central agency, and locality will follow the procedures for entering, notifying, establishing, reviewing, and allocating the public investment plan on the System as stipulated in points b, c, d, đ of this Clause.

2. Adjustment of the medium-term public investment plan funded by the central budget

a) Each Ministry, central agency, and locality will enter the proposal to adjust the medium-term public investment plan funded by the central budget and upload along with the report of each Ministry, central agency, and provincial People's Committee to the Ministry of Planning and Investment on the System;

b) The Ministry of Planning and Investment shall review the adjustment plan for the central budget medium-term public investment plan of ministries, central agencies, and localities on the System, report to the competent authority for consideration and decision;

c) Based on the Decision adjusting the central budget medium-term public investment plan of the Prime Minister, the Ministry of Planning and Investment shall implement the entry of the adjusted central budget medium-term public investment plan of the Prime Minister into the national database on public investment, including the total amount and structure of funds for ministries, central agencies, and localities (if applicable), the list, the level of funding allocated to programs, tasks, projects, other public investment objects, and notify ministries, central agencies, and localities on the System.

Article 7. Establishment, allocation, adjustment of annual public investment plans, extension, advance disbursement of central budget funds

1. Establishment, allocation of annual public investment plans with central budget funds

a) Before July 31 each year, based on the regulations of the Prime Minister regarding the establishment of the socio-economic development plan and the state budget estimate for the following year and the guidance of the Ministry of Planning and Investment, ministries, central agencies, and localities shall enter the proposed annual central budget public investment plan for the following year and post it along with the report from ministries, central agencies, and provincial People's Committees sent to the Ministry of Planning and Investment on the System;

b) Before August 15 each year, the Ministry of Planning and Investment shall enter the proposed development investment capital from the central budget for the following year's plan for ministries, central agencies, and localities, announce on the System for ministries, central agencies, and localities to establish the annual central budget public investment plan for the following year;

c) Before August 25 each year, based on the proposed development investment capital from the central budget for the following year announced by the Ministry of Planning and Investment, ministries, central agencies, and localities shall enter the completed proposed annual central budget public investment plan for the following year and post it along with the report from ministries, central agencies, and provincial People's Committees, sent to the Ministry of Planning and Investment on the System;

d) Based on the Decision allocating the annual central budget public investment plan for the following year of the Prime Minister, the Ministry of Planning and Investment shall enter the annual central budget public investment plan for the following year assigned by the Prime Minister into the national database on public investment, including the total amount, structure of central budget funds, and notify ministries, central agencies, and localities on the System;

đ) Based on the Decision detailing the allocation of the annual central budget public investment plan for the following year of the competent authority, ministries, central agencies, and localities shall enter the annual central budget public investment plan for the following year assigned by the competent authority into the national database on public investment within seven days from the date of issuance of the Decision, including the list, the level of funding allocated to each program, task, project, other public investment object.

2. Adjustment of annual public investment plans with central budget funds

a) In cases where the adjustment of the annual central budget public investment plan falls under the authority of the head of ministries, central agencies, and provincial People's Committees:

Based on the Decision adjusting the annual central budget public investment plan of the competent authority, ministries, central agencies, and localities shall enter the adjusted annual central budget public investment plan into the national database on public investment within seven days from the date of issuance of the Decision, including the list, the level of funding allocated to each program, task, project, other public investment object.

b) In cases where the adjustment of the annual central budget public investment plan falls under the authority of the National Assembly, the Standing Committee of the National Assembly:

- Ministries, central agencies, and localities shall enter the proposal to adjust the annual central budget public investment plan and post it along with the proposal report from ministries, central agencies, and provincial People's Committees, sent to the Ministry of Planning and Investment on the System;

- The Ministry of Planning and Investment shall review and consolidate the adjustment plan for the annual central budget public investment plan of ministries, central agencies, and localities on the System to report to the competent authority for consideration and decision;

- Based on the Decision adjusting the annual public investment plan of the Prime Minister, the Ministry of Planning and Investment shall enter the adjusted annual central budget public investment plan into the national database on public investment, including the total amount, structure of central budget funds (if applicable) and notify ministries, central agencies, and localities on the System;

- Based on the Decision adjusting the annual central budget public investment plan of the competent authority, ministries, central agencies, and localities shall enter the adjusted annual central budget public investment plan into the national database on public investment within seven days from the date of issuance of the Decision, including the list, the level of funding allocated to each program, task, project, other public investment object.

3. Extension of implementation and disbursement time for annual central budget public investment plans

a) Ministries, central agencies, and localities shall enter the proposal to extend the implementation and disbursement time for the annual central budget public investment plan and post it along with the report from ministries, central agencies, and provincial People's Committees, sent to the Ministry of Planning and Investment on the System;

b) The Ministry of Planning and Investment shall consolidate proposals to extend the implementation and disbursement time for the annual central budget public investment plan on the System to report and recommend to the competent authority for consideration and decision;

c) Based on the Decision, documents permitting the extension of the implementation and disbursement time for the annual central budget state investment plan issued by the Prime Minister (if any), the Ministry of Planning and Investment shall incorporate the list and amount of funds approved by the Prime Minister to extend the implementation and disbursement time for each program, task, project, and other public investment objects into the national database on public investment and notify relevant ministries, central agencies, and localities through the System.

4. Advance allocation of the annual central budget state investment plan

a) Ministries, central agencies, and localities shall incorporate proposals for advancing the allocation of the annual central budget state investment plan for the following year and post them along with reports from ministries, central agencies, and provincial People's Committees to the Ministry of Planning and Investment through the System;

b) The Ministry of Planning and Investment shall compile proposals for advancing the allocation of the annual central budget state investment plan for the following year submitted by ministries, central agencies, and localities through the System to report to the competent authority for consideration and decision;

c) Based on the Decision approving the advance allocation of the annual central budget state investment plan for the following year by the competent authority, the Ministry of Planning and Investment shall incorporate the advanced annual central budget state investment plan already approved by the competent authority into the national database on public investment, including the total amount of funds, the structure of the central budget funds, and notify relevant ministries, central agencies, and localities through the System;

d) Based on the Decision detailing the allocation of the annual central budget state investment plan for the advance allocation of the following year's capital, ministries, central agencies, and localities shall incorporate the annual central budget state investment plan for the advance allocation of the following year's capital into the national database on public investment within seven days from the date of issuance of the Decision, including the list and amount of funds allocated to each program, task, project, and other public investment objects.

Article 8. Allocation and adjustment of the public investment plan using reserve funds, increased revenue, savings, surplus, and other central budget funds for development expenditure

1. Based on the Decision allocating and adjusting the annual central budget state investment plan from reserve funds, increased revenue, savings, surplus, and other sources issued by the competent authority, ministries, central agencies, and localities shall incorporate the annual central budget state investment plan from reserve funds, increased revenue, savings, surplus, and other sources already allocated and adjusted by the competent authority into the national database on public investment within seven days from the date of issuance of the Decision, including the list and amount of funds allocated to each program, task, project, and other public investment objects.

2. For the process of establishing, reviewing, allocating, adjusting, monitoring, and evaluating the annual central budget state investment plan using reserve funds, increased revenue, savings, surplus, and other sources for development expenditure on the System, ministries, central agencies, and localities shall follow the guidelines provided in writing by the Ministry of Planning and Investment.

Article 9. Allocation and adjustment of the medium-term and annual public investment plans for National Target Programs

1. Based on the Resolution, Decision allocating and adjusting the medium-term and annual public investment plans for National Target Programs, ministries, central agencies, and localities shall incorporate the medium-term and annual public investment plans already allocated and adjusted by the competent authority into the national database on public investment, including the total amount and structure of funds, the list and amount of funds allocated to programs, tasks, projects, and other public investment objects of the National Target Program.

2. The establishment, construction, review, compilation, supervision, and evaluation of National Target Programs shall be carried out in accordance with the regulations of the National Target Program Monitoring and Evaluation System or other related information systems.

Article 10. Establishing, reviewing, allocating, adjusting medium-term and annual public investment plans, extending implementation periods, and advancing budget funds for local public investment

1. Establishing, reviewing, allocating, and adjusting medium-term public investment plans

a) Based on the Prime Minister's notification regarding the anticipated total capital for local government budget investment during the subsequent phase, the Ministry of Planning and Investment shall incorporate the anticipated total capital for local government budget investment, notify it on the System, and allow localities to propose allocation schemes and establish, review, and submit investment policies and projects for approval by competent authorities during the subsequent phase;

b) Localities shall enter their medium-term public investment plans funded by the local government budget into the System along with reports from provincial People's Councils and send them to the Ministry of Planning and Investment via the System;

c) Based on the Prime Minister's Decision allocating and adjusting medium-term public investment plans funded by the local government budget, the Ministry of Planning and Investment shall incorporate the medium-term public investment plans funded by the local government budget that have been allocated and adjusted by the Prime Minister into the national database on public investment, including the total capital, local government budget structure (if applicable), and notify localities through the System;

d) Based on the Resolution and Decision detailing allocations and adjustments to medium-term public investment plans funded by the local government budget made by competent authorities, localities shall incorporate these plans into the national database on public investment within 14 days of the Decision being issued, including the list, capital allocation for each program, task, project, and other public investment objects;

2. Establishing, reviewing, allocating, and adjusting annual public investment plans

a) Localities shall enter their annual public investment plans funded by the local government budget into the System along with reports from provincial People's Councils and send them to the Ministry of Planning and Investment via the System;

b) Based on the state budget revenue and expenditure capacity and development investment spending from the state budget for the following year, the Ministry of Planning and Investment shall incorporate the anticipated total capital for local government budget development investment for the following year and notify localities through the System;

c) Localities shall enter their annual public investment plans funded by the local government budget into the System along with reports from provincial People's Councils and send them to the Ministry of Planning and Investment via the System;

d) Based on the Prime Minister's Decision allocating and adjusting annual public investment plans funded by the local government budget, the Ministry of Planning and Investment shall incorporate the annual public investment plans funded by the local government budget that have been allocated and adjusted by the Prime Minister into the national database on public investment, including the total capital, local government budget structure (if applicable), and notify localities through the System;

đ) Based on the Resolution and Decision detailing allocations and adjustments to annual public investment plans funded by the local government budget made by competent authorities, localities shall incorporate these plans into the national database on public investment within 14 days of the Decision being issued, including the list, capital allocation for each program, task, project, and other public investment objects;

3. Extending the implementation period and disbursement of annual public investment plans funded by the local government budget

Based on the Resolution, Decision, and documents permitting the extension of the implementation period and disbursement of annual public investment plans funded by the local government budget made by competent authorities, localities shall incorporate the list and capital amount permitted by competent authorities to extend the implementation period and disbursement of each program, task, project, and other public investment objects into the national database on public investment;

4. Advancing the annual public investment plan funded by the local government budget

Based on the Decision detailing the allocation of the annual public investment plan funded by the local government budget for advancing the capital plan for the following year made by competent authorities, localities shall incorporate the annual public investment plan funded by the local government budget for advancing the capital plan for the following year into the national database on public investment within seven days of the Decision being issued, including the list, capital allocation for each program, task, project, and other public investment objects.

Article 11. Transfer and adjust the public investment plan using reserve funds, increased revenue, cost savings, surplus, and other sources of local budget for development investment expenditure.

Based on the Decision transferring and adjusting the public investment plan from reserve funds, increased revenue, cost savings, surplus, and other sources of the local budget by the competent authority, the locality shall incorporate the public investment plan from reserve funds, increased revenue, cost savings, surplus, and other sources that have been assigned and adjusted by the competent authority into the national database on public investment within seven days from the date the Decision is issued, including the list and the amount allocated to each program, task, project, and other public investment objects.

Article 12. Report on the medium-term and annual public investment plans from lawful revenues of state agencies and public service units designated for investment.

1. Report on the medium-term public investment plan from lawful revenues of state agencies and public service units designated for investment:

Based on the Prime Minister's regulations and the guidance of the Ministry of Planning and Investment, ministries, central agencies, and localities shall incorporate the medium-term public investment plan from lawful revenues of state agencies and public service units designated for investment and attach it to the report submitted by ministries, central agencies, and provincial People's Committees to the Ministry of Planning and Investment through the System.

2. Report on the annual public investment plan from lawful revenues of state agencies and public service units designated for investment.

a) Based on the Prime Minister's regulations on developing the socio-economic development plan and the state budget estimate for the following year and the guidance of the Ministry of Planning and Investment, ministries, central agencies, and localities shall incorporate the proposed list and the proposed amount allocated to each program, task, project, and other public investment objects in the annual public investment plan from lawful revenues of state agencies and public service units designated for investment for the following year and attach it to the report submitted by ministries, central agencies, and provincial People's Committees to the Ministry of Planning and Investment through the System;

b) Based on the Decision transferring and adjusting the annual public investment plan from lawful revenues of state agencies and public service units designated for investment by the competent authority, ministries, central agencies, and localities shall incorporate the annual public investment plan from lawful revenues designated for investment that has been assigned and adjusted by the competent authority into the national database on public investment within seven days from the date the Decision is issued, including the list and the amount allocated to each program, task, project, and other public investment objects.

Chapter III
REPORT ON THE IMPLEMENTATION OF PLANS, PROGRAMS, AND PUBLIC INVESTMENT PROJECTS ON THE SYSTEM

PROGRAM, PUBLIC INVESTMENT PROJECT ON THE INFORMATION SYSTEM

Article 13. Content of the report on the implementation of programs, tasks, projects.

1. Report on the implementation and disbursement of programs, tasks, projects, and other public investment objects.

a) Report on the disbursement of public investment capital.

Based on information and figures about the transferred and adjusted public investment plan on the national database on public investment and disbursement information and figures of programs, tasks, projects, and other public investment objects on the State Budget Management Information System (hereinafter referred to as the TABMIS System) or other applications of the Ministry of Finance, the project investor, the component project investor shall enter and send the actual implementation and disbursement figures to the specialized agencies managing public investment of ministries, central agencies, and localities to report on the implementation and disbursement of public investment funds (including the capital of projects permitted to extend the implementation and disbursement period into the following year) according to the requirements of the System.

In case there is a discrepancy between the disbursement figures (including the extended plan approved by the competent authority and other state budget funds) provided by the project investor, the component project investor and the disbursement figures on the TABMIS System, the project investor, the component project investor shall report to the project supervising agency to reconcile the figures with the Ministry of Finance.

b) Report on the information and volume of work completed of programs, tasks, projects, and other public investment objects.

Monthly, the project investor, the component project investor responsible for managing the project shall enter and send to the System the volume of work completed during the period of programs, tasks, projects, and other public investment objects.

2. Deadline for submitting reports.

a) Before the 15th day of each month, submit an estimated report on the implementation and disbursement for the entire month and the disbursement results of the previous month;

b) Before the 10th day of the first month of each quarter, submit a report on the implementation and disbursement results of the previous quarter;

c) Before July 10 of the planning year, submit a detailed cumulative report on the implementation and disbursement status of projects in the first six months of the year;

d) Before February 28 of the year following the planning year, submit a detailed report on the implementation and disbursement status of projects in the planning year.

Article 14. Report on the medium-term state budget public investment plan

1. Content of the report

Based on information and data about the medium-term public investment plan, annual plans assigned and adjusted based on the national database on public investment, as well as disbursement information for programs, tasks, projects, and other public investment objects, ministries, central agencies, and localities shall report on the implementation and disbursement of the medium-term public investment plan through the System and attach it to their reports submitted to ministries, central agencies, and provincial People's Committees.

2. Deadline for submitting reports.

a) Before July 31 of the third year of the medium-term public investment plan, report on the implementation, disbursement, and mid-term evaluation of the medium-term public investment plan up to the end of the second quarter of the third year of the medium-term public investment plan;

b) Before July 31 of the fifth year of the medium-term public investment plan, report on the estimated implementation, disbursement, and evaluation of the medium-term public investment plan up to the end of the final year of the medium-term public investment plan.

Article 15. Report on the annual state budget public investment plan

1. Detailed allocation report on the annual state budget public investment plan

a) Content of the report: Based on the annual state budget public investment plan for each program, task, project, and other public investment object according to the national database on public investment, ministries, central agencies, and localities shall submit detailed allocation reports on the annual state budget public investment plan, including the list and amount of funds allocated to each program, task, project, and other public investment object through the System and attach it to their reports submitted to ministries, central agencies, and provincial People's Committees;

b) Deadline for submitting the report: before January 10 of the planning year;

c) Based on the review results of the Ministry of Planning and Investment, if the allocation plan of ministries, central agencies, and localities does not comply with regulations, within five working days from the date of receiving the review results of the Ministry of Planning and Investment through the System, ministries, central agencies, and localities shall conduct a review, adjustment, or explanation and attach it to their supplementary reports and explanations submitted to the Ministry of Planning and Investment through the System.

2. Report on the implementation and disbursement of the annual public investment plan

a) Content of the report: Based on information and data about the annual capital plan assigned and adjusted according to the national database on public investment, as well as disbursement information for programs, tasks, projects, and other public investment objects, ministries, central agencies, and localities shall report on the implementation and disbursement of the annual public investment plan through the System, and attach it to their reports submitted to ministries, central agencies, and provincial People's Committees in accordance with the Public Investment Law and Government Decree No. 40/2020/NĐ-CP;

b) Deadline for submitting the report:

- Before the 15th day of each month, report on the estimated monthly disbursement and the previous month's disbursement results.

- Before the first ten days of each quarter, report on the previous quarter's disbursement results and attach it to the report evaluating the implementation of the public investment plan according to the provisions of Article 70 of the Public Investment Law by ministries, central agencies, and provincial People's Committees.

- Before July 10 of the planning year, report on the cumulative disbursement details of projects in the first six months of the year.

- Before February 28 of the year following the planning year, report on the actual disbursement details of projects in the planning year and attach it to the report evaluating the implementation of the public investment plan according to the provisions of Article 70 of the Public Investment Law.

Article 16. Reports on the investment plan for other budget sources for development expenditure and special reports

1. Based on information and data about the public investment plan assigned and adjusted based on the national database on public investment, disbursement information of programs, tasks, projects, and other public investment objects, ministries, central agencies, and localities report on the implementation and disbursement of programs, tasks, projects, and other public investment objects allocated from reserve funds, increased revenue, savings, surplus budgets, and other budget sources for development expenditure according to requirements on the System.

2. Based on management requirements of the competent authority in directing and managing the public investment plan, the Ministry of Planning and Investment sends documents to ministries, central agencies, and localities requesting them to report on special topics or emergencies.

Based on the request of the Ministry of Planning and Investment, ministries, central agencies, and localities implement reporting on the System for consolidation and reporting to the competent authority.

Chapter IV
SHARING AND SYNCHRONIZATION OF DATA AND PUBLIC DISCLOSURE OF INFORMATION ON THE IMPLEMENTATION OF PUBLIC INVESTMENT PLAN DISBURSEMENT FUNDED BY THE STATE BUDGET

FORM OF FUNDS ALLOCATION FOR PUBLIC INVESTMENT PLANS FROM THE STATE BUDGET

RESPONSIBLE PERSONNEL, INDIVIDUAL

Article 17. Sharing and synchronization of data with the TABMIS System or other applications of the Ministry of Finance

1. Units under the Ministry of Planning and Investment coordinate with the Ministry of Finance to share and synchronize data in accordance with Clause 13, Article 51 of Decree No. 40/2020/NĐ-CP dated April 6, 2020 of the Government.

2. The Ministry of Planning and Investment reviews on the System the allocation plans for public investment capital from the state budget of ministries, central agencies, and localities in accordance with Decree No. 40/2020/NĐ-CP dated April 6, 2020 of the Government. In cases where the allocation does not comply with the total amount and detailed breakdown by each field and task of the public investment capital plan already assigned, does not meet the requirements stipulated by public investment laws, programs, tasks, projects, and other public investment objects without annual allocation lists and data based on the national database on public investment, the Ministry of Planning and Investment issues opinions in writing and on the System to ministries, central agencies, and localities, and simultaneously sends to the Ministry of Finance to request the State Treasury to temporarily suspend disbursement in accordance with Clause 2, Article 44 and Point b, Clause 1, Article 51 of Decree No. 40/2020/NĐ-CP dated April 6, 2020 of the Government.

Article 18. Content of Public Disclosure

The Ministry of Planning and Investment organizes the public disclosure of information on the disbursement of the public investment plan funded by the state budget monthly, quarterly, and annually of ministries, central agencies, and localities on the National Public Investment Information System and the Ministry of Planning and Investment's website.

Chapter V
TASKS, POWERS, AND RESPONSIBILITIES OF ORGANIZATIONS, GROUPS, AND INDIVIDUALS

OFFICIAL, INDIVIDUAL

Article 19. Responsibilities of the Ministry of Planning and Investment

1. Organize the construction, management, and implementation of the Information System and the national database on public investment.

2. Based on the provisions of public investment laws, the Ministry of Planning and Investment builds principles, criteria, information fields, data, and reporting templates on the System to aggregate, review, and evaluate information and data entered into the System.

3. Aggregate, review, and monitor programs, tasks, projects, and other public investment objects, public investment plans of ministries, central agencies, and localities on the System to report to the competent authorities as prescribed.

4. Guide and urge related agencies and organizations to update and report in accordance with this Circular.

5. Take the lead in organizing training, guiding the management, operation, and utilization of the System nationwide.

Article 20. Responsibilities of Ministries, central agencies, and local authorities

1. Implement the entry and update of information and data in accordance with the procedures and requirements stipulated in this Circular on the System.

2. The reported information and figures must ensure:

a) Accuracy, completeness, timeliness, transparency, and clarity;

b) Consistency and synchronization between reports published on the System and information entered into the System.

3. Utilize and exploit information according to the assigned authority on the System for the purpose of summarizing and monitoring the implementation of medium-term and annual public investment plans at Ministries, central agencies, and local authorities.

4. Urge project sponsors and units under Ministries, central agencies, and local authorities to comply with reporting and entry requirements on the System as prescribed in this Circular.

5. Bear responsibility before management agencies, inspection and audit bodies regarding the content and accuracy of reported information and figures.

6. Closely coordinate with related units to address issues arising during the implementation of system procedures and assigned tasks.

7. Implement registration, management, and assignment of usage rights for login accounts on the System in accordance with regulations.

8. To align with local conditions, capabilities, organizational characteristics, and decentralization levels, based on the provisions of the Public Investment Law, Decree No. 40/2020/NĐ-CP dated April 6, 2020 of the Government, and the provisions of this Circular, localities shall define and assign agencies, units, and lower-level People's Councils to implement the provisions of Chapters II and III of this Circular according to each budget level on the System, ensuring progress, deadlines, quality, System requirements, and government directives, Prime Minister's directives, and the Ministry of Planning and Investment.

Article 21. Responsibilities of Project Sponsors, Component Project Sponsors, and Program Sponsors

1. Timely and accurately update information and reports in accordance with the provisions of this Circular.

2. Bear responsibility for information and data entered into the System and be liable under the law for inaccurate reports and provision of information about the implementation of investments within their management scope.

Article 22. Handling of Violations

Implement the legal provisions on administrative penalties in the planning and investment sector.

Chapter VI
IMPLEMENTING PROVISIONS

Article 23. Effectiveness of Implementation

1. This Circular takes effect in the establishment, review, allocation, adjustment, monitoring, and evaluation of plans, programs, tasks, and public investment projects on the national public investment information and database system from the 2025 State budget investment plan for central budget funds and from the 2026-2030 medium-term public investment plan for public investment funds as stipulated in the Public Investment Law.

2. Circular No. 03/2017/TT-BKHĐT dated April 25, 2017 of the Ministry of Planning and Investment on the reporting system for the establishment, monitoring, and evaluation of public investment plans ceases to be effective from the date this Circular takes effect.

Article 24. Implementation Organization

1. Ministries, ministerial-level agencies, government agencies, other central agencies, People's Councils at all levels, and related organizations and individuals are responsible for implementing this Circular.

2. During implementation, if there are difficulties or obstacles, agencies, units, and organizations should report to the Ministry of Planning and Investment for timely guidance.
