GUIDELINES FOR IMPLEMENTING THE AMENDMENTS AND SUPPLEMENTS TO CERTAIN REGIMES FOR SOCIAL POLICY BENEFICIARIES PURSUANT TO DECISION NO. 19-TT/LB OF THE MINISTRY OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS - FINANCE ON SEPTEMBER 21, 1992

Pursuant to Article 1 and Article 2 of Decision No. 303-HĐBT dated August 20, 1992 of the Council of Ministers on subsidies for civil servants, employees, armed forces personnel, and social policy beneficiaries; the Ministry of Labor, War Invalids and Social Affairs - Finance hereby provides guidelines for implementation as follows:

1. Relatives of martyrs, elderly and lonely persons who have contributed to the revolution, and families without the conditions to provide care, including children of martyrs who are orphans, shall be entitled to a subsistence allowance equivalent to the value of 45 kilograms of rice based on local market prices each month.

2. War invalids and those receiving benefits equivalent to war invalids while working in enterprises, administrative and public service agencies, armed forces, or retired, who currently receive monthly disability allowances equal to 30% of the disability allowance when returning home (for war invalids with the same level of disability and salary or subsistence allowance), shall now receive the full 100% specific amount as detailed in the attached annex.

In cases where war invalids are newly confirmed and classified, the arrears of monthly disability allowances (if any) from August 30, 1992 and earlier shall be calculated according to the rates specified for each period; from September 1, 1992, they will be calculated according to the provisions of Decision No. 303-HĐBT and the annex in this guidance.

3. War invalids of Class 1 and Class 1 veterans suffering from particularly severe disabilities as listed below shall receive an additional monthly allowance equivalent to the value of 20 kilograms of rice based on local market prices to help alleviate some of the difficulties in their daily lives:

- Amputation of two limbs or more, including amputation of both hands, both feet, or one hand and one foot (on the same side or different sides).

- Total blindness in both eyes (both eyes have zero visual acuity).

- Spinal cord injury or brain injury sequelae resulting in complete paralysis of two limbs or more, unable to walk, requiring constant use of a wheelchair or walker for movement.

- Severe mental illness that does not allow self-management in daily life (loss of memory, requiring constant supervision).

Provincial Departments of Labor, War Invalids and Social Affairs shall base on the provisions of this Circular and the condition of war invalids and veterans to compile lists (according to the attached model) and send them to the Ministry of Labor, War Invalids and Social Affairs (Department of War Invalids and Martyrs) and the Ministry of Finance (Department of Administrative and Social Services) for verification and allocation of subsidy funds.

4. The price of rice used as the basis for calculating the subsistence allowance mentioned in Point 1 and the supplementary allowance mentioned in Point 3 above shall be consistent with the price of rice used to calculate the additional food allowance for Class 1 war invalids and Class 1 veterans, the monthly pension allowance for relatives of martyrs, and shall be determined by the People's Committee of the province or city based on the retail price of common white rice in the local market at the time of payment, to determine a unified monetary value for the subsistence allowance and supplementary allowance.

5. This Circular takes effect from September 1, 1992.

Any local regulations that conflict with the provisions of this Circular shall be abolished. During the implementation process, if there are any difficulties, localities are requested to promptly report to the Ministry for resolution.
