CIRCULAR

REGULATIONS ON PATROL, SUPERVISION, AND HANDLING OF VIOLATIONS OF LAWS ON ROAD TRAFFIC ORDER AND SAFETY BY TRAFFIC POLICE

 

Circular No. 73/2024/TT-BCA dated November 15, 2024, issued by the Minister of Public Security on patrol, supervision, and handling of violations of laws on road traffic order and safety by Traffic Police, effective from January 1, 2025, amended and supplemented by:

Circular No. 13/2025/TT-BCA dated February 28, 2025, issued by the Minister of Public Security to amend and supplement certain articles of circulars regulating road traffic order and safety, railway, and inland waterway traffic, effective from March 1, 2025.

Pursuant to the Law on Road Traffic Order and Safety dated June 27, 2024;

Pursuant to the Law on People's Public Security dated November 20, 2018 and The Law Amending and Supplementing Certain Provisions of the Law on People's Public Security dated June 22, 2023;

Pursuant to the Law XDecree No. 6 of 2012 andintention vinternational Handling Law dated June 20, 2012"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."; the Law Amending and Supplementing Certain Provisions of the Law on Handling Administrative Violations dated November 13, 2020;June 2024;The Law Amending and Supplementing Certain Provisions of the Law on Administrative Violation Handling dated November 13, 2020;Pursuant to Decree No. 118/2021/NĐ-CP dated December 23, 2021, issued by the Government detailing certain provisions and measures for implementing the Law on Administrative Violation Handling;

Pursuant to Decree No. 135/2021/NĐ-CP dated December 31, 2021, issued by the Government on the list, management, and use of technical equipment and procedures for collecting and using data obtained fromg technical equipment provided by individuals and organizations to detect administrative violations;

The Minister of Public Security issues this Circular on patrol, supervision, and handling of violations of laws on road traffic order and safety by Traffic Police Article 1. Scope of Regulation This Circular regulates the form; content; uniforms;

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Traffic Police Corps;

equipment, use of technical equipment, weapons, and support tools and procedures for patrol, supervision, and handling of violations of laws.[1]

Chapter I. GENERAL PROVISIONS

on road traffic order and safety by Traffic Police; mobilizing other forces

within the People's Public Security to participate in coordination with Traffic Police in patrol and supervision when necessary. Article 2. Applicability 4. If the above measures are still insufficient to offset losses, the remaining losses shall be covered by the reserve fund according to the decision of the General Assembly of Members, the Charter, or the Financial Management Regulations of the cooperative. 1. Officers and non-commissioned officers of the Traffic Police (hereinafter collectively referred to as Traffic Police officers) performing tasks of patrol, supervision, and handling of violations of laws on road traffic order and safety (hereinafter abbreviated as patrol, supervision, and handling of violations). 2. Officers and non-commissioned officers of other forces within the People's Public Security mobilized to participate in coordination with Traffic Police in performing patrol and supervision. 4. Agencies, organizations, and individuals related to activities of patrol, supervision, and handling of violations of laws on road traffic order and safety on the territory of the Socialist Republic of Vietnam. Article 3. Requirements for Traffic Police officers performing patrol, supervision, and handling of violations 1. Comply with the provisions of laws on road traffic order and safety; laws on administrative violation handling; this Circular and other relevant legal regulations. currently 2. Perform their assigned tasks and patrol and supervision plans fully and responsibly as issued by competent authorities; ensure democracy in traffic order and safety assurance work, conduct rules, and the Regulations of the People's Public Security.

3. When interacting with the public and those who violate the law, they must have proper etiquette, demeanor, attitude, and appropriate cultural conduct.

This Circular applies to:

2. Officers and non-commissioned officers from other forces within the People's Public Security Force shall be mobilized to cooperate with Traffic Police to conduct patrols and inspections.

Clause 3. Units and local public security agencies.

4. Agencies, organizations, and individuals related to patrol, inspection, and handling violations of laws on traffic order and safety on the territory of the Socialist Republic of Vietnam.

Article 3. Requirements for Traffic Police officers performing patrol, inspection, and violation handling duties.

1. Strictly comply with the regulations of the law on road traffic order and safety; administrative violation handling laws; this Circular and other relevant legal provisions.

2. Fully and responsibly perform assigned tasks and patrol plans issued by competent authorities; implement democracy in traffic order assurance work, code of conduct, and People's Public Security Regulations.

3. When interacting with the public and those who violate the law, they must maintain proper etiquette, demeanor, attitude, and appropriate cultural behavior.

4. Timely detect, prevent, and handle violations of laws on road traffic order and safety and other violations according to prescribed procedures, formalities, and authority.

Article 4. Forms to be used in patrol, control, and handling of administrative violations

This Circular annexes the following forms:

1. Administrative Violation Notification on Traffic Order and Safety road (Form No. 01/73).

2. Points Deduction Notification for Driver's License (Form No. 02/73).

3. Record of Results Collected Using Technical Means and Equipment Regarding Administrative Violations on Traffic Order and Safety road (Form No. 03/73).

4. Forwarding Notice Administrative Violation Notification on Traffic Order and Safety road or Data Notification (information, images) Reflecting Administrative Violations on Traffic Order and Safety road (Form number 04).

5. Logbook for Receiving Data (information, images) Reflecting Administrative Violations on Traffic Order and Safety of Road Traffic (Form No. 05/73).

6. Data Notification (information, images) Reflecting Administrative Violations on Traffic Order and Safety road (Form No. 06).

Chapter II. FORMS AND CONTENT OF PATROL AND CONTROL; EQUIPMENT FOR TRAFFIC POLICE WHEN PATROLLING AND CONTROLLING

Section 1. FORMS OF PATROL AND CONTROL

Article 5. Control through systems, means, equipment, and databases on traffic order and safety of road traffic

1. Control through the Road Traffic Safety Surveillance System; surveillance cameras along roads and in urban areas

a) The Road Traffic Safety Surveillance System (hereinafter referred to as the Surveillance System), and surveillance cameras along roads and in urban areas shall be equipped, installed, managed, operated, and used in accordance with the Law on Traffic Order and Safety; Decree No. 135/2021/NĐ-CP of the Government on the list, management, and use of technical means and equipment and procedures for collecting and using data obtained from technical means and equipment provided by individuals and organizations to detect administrative violations (hereinafter referred to as Decree No. 135/2021/NĐ-CP) and regulations of the Ministry of Public Security on standards, norms, management, operation, use, and protection of the Surveillance System; The Government's Decree No. 135/2021/NĐ-CP dated December 31, 2021, stipulating the list, management, and use of technical equipment, and data collection and usage procedures from equipment provided by individuals and organizations for detecting administrative violations (hereinafter referred to as Decree No. 135/2021/NĐ-CP)and the Ministry of Public Security's regulations on standards, norms, management, operation, use, and protection of the Surveillance System;

b) Traffic police units responsible for managing the Surveillance System, surveillance cameras along roads and in urban areas must arrange staff to operate at the Command Center 24/24 hours to ensure continuous and smooth system operation, monitor traffic order and safety, social order along the route, detect violations of laws on traffic order and safety of road traffic, and other violations;

c) Procedures for detecting and handling results collected from the Surveillance System, surveillance cameras along roads and in urban areas shall be carried out in accordance with the provisions of Articles 15 and 24 of this Circular.

2. Control through the use of technical means and equipment, smart devices supporting command and control of road traffic; exploitation of data from vehicle tracking devices, driver image recording devices, and databases on traffic order and safety of road traffic

a) Traffic police units use technical means and equipment (including the system of technical equipment for checking the load capacity of motor vehicles), smart devices supporting command and control of road traffic; exploit data from vehicle tracking devices, driver image recording devices, and databases on traffic order and safety of road traffic to control, detect, and handle violations of laws on traffic order and safety of road traffic, and other violations according to the regulations;

b) Results and data collected from the means, equipment, and databases specified in point a of this clause for detecting and handling violations must comply with the provisions of the law on handling administrative violations, Decree No. 135/2021/NĐ-CP, regulations on standards, management, operation, and use of the vehicle tracking device management system, driver image recording devices, and other relevant laws;

c) Procedures for detecting and handling results collected from the means, equipment, and databases specified in point a of this clause shall be carried out in accordance with the provisions of Articles 15 and 24 of this Circular.

3. Control through receiving data collected from weigh-in-motion facilities

a) Traffic police units assigned to patrol and control along routes and areas must cooperate to receive data collected from weigh-in-motion facilities installed along routes and areas in accordance with the Law on Roads, Law on Traffic Order and Safety of Road Traffic to control, detect, and handle violations of laws on traffic order and safety of road traffic, load capacity of vehicles, and other violations;

b) Results and data collected from weigh-in-motion facilities for detecting and handling violations must comply with the provisions of the law on handling administrative violations, Decree No. 135/2021/NĐ-CP, and other relevant laws;

c) Procedures for detecting and handling results collected from weigh-in-motion facilities shall be carried out in accordance with the provisions of Articles 15 and 26 of this Circular.

Article 6. Organization of forces directly patrolling and controlling openly on road traffic routes

1. Mobile Patrol and Control

Traffic police move along assigned routes and areas by means of transportation or on foot to carry out patrols and controls according to plans issued by competent authorities, directly observe or use technical means and equipment to supervise, prevent, detect, stop, and handle violations of laws on traffic order and safety of road traffic and other violations within their authority.

2. Control at a single point on a road, at a Traffic Police Station

a) Traffic police organize forces at a single point on a road, at a Traffic Police Station according to plans issued by competent authorities to implement stopping of vehicles, control, detection, and handling of violations of laws on traffic order and safety of road traffic and other violations within their authority;

b) At a single point on a road, select locations with wide and unobstructed roads, not obstructing visibility, and complying with the law on traffic order and safety of road traffic, the law on roads, and related laws.

c) When organizing traffic control forces at a point on the road, at the Traffic Police Station, cameras must be used to record the activities of the Traffic Police Team. Control operations at night must have lighting and ensure sufficient light.

3. Mobile patrol and control combined with fixed-point control on the road, at the Traffic Police Station

 When mobile patrol and control involve fixed-point control at a point on the road, at the Traffic Police Station, or when fixed-point control at a point on the road, at the Traffic Police Station involves mobile patrol and control, it must be clearly recorded in the patrol and control plan that has been issued by the competent authority.

4. When conducting public patrol and control as stipulated in Clause 1, Clause 2, Clause 3 of this Article, there must be a plan for Secretary of the Party Central Committee, Prime Minister; pguiding road traffic patrol and control, railway traffic patrol and control under the Traffic Police Department (hereinafter referred to as the Head pof Road Traffic Patrol and Control Guidance, Railway Traffic Patrol and Control), the Head of the Traffic Police Department[2] or higher level must issue and ensure the following provisions:

a) Using police uniforms as prescribed in Clause 1, Article 9 of this Circular;

b) Using vehicles as prescribed in Clause 2, Article 9 of this Circular or walking to patrol and control within the assigned route and area;

c) Using technical equipment and devices weapons, auxiliary tools, and other technical means as prescribed in this Circular.; Article 7. Organizing traffic control forces for public patrol and control combined with disguise on the road

3. Requirements for public patrol and control combined with disguise

a) There must be a patrol and control plan issued by the competent authority as prescribed in Clause 1, Clause 2, Clause 3 of Article 10 of this Circular. The Director of the Traffic Police Department; the Provincial Public Security Chief, the Chief of the Public Security Department of a centrally-administered city (hereinafter referred to as the Provincial Public Security Chief); the Head of Road Traffic Patrol and Control Guidance, Railway Traffic Patrol and Control; the Head of the Traffic Police Department

as prescribed in Clause 1, Clause 2, Clause 3 of Article 10 of this Circular decide on wearing police uniforms, civilian clothes, disguising vehicles during public patrol and control combined with disguise;[3] b) The disguised officer group and the public patrol and control officer group in the Traffic Police Team must maintain an appropriate distance to ensure timely and lawful violation handling.

Section 2. CONTENT OF CONTROL; EQUIPMENT AND WEAPONS, ASSISTANT TOOLS

Article 8. Content of Control

Implement the control contents as prescribed in point b Clause 1, point a Clause 5 Article 65 of the Road Traffic Safety Law and the following provisions:

1. Control related documents concerning persons and traffic vehicles, including:

a) Driver's license; certificate of traffic law knowledge training; certificate of motorcycle operation qualification; send a text message registration certificate or certified copy of the vehicle registration certificate received with notarization accompanied by the original document confirming from financial organizations , foreign bank branches; inspection certification, safety and environmental protection technical inspection label (for types of vehicles required to be inspected); compulsory civil liability insurance certificate for motor vehicle owners and other necessary documents as prescribed (hereinafter referred to collectively as documents);b) When information on the documents has been integrated and updated in the electronic identity account on the National Identity Application, in the database operated then the verification and control can be carried out through the information in the electronic identity account on the National Identity Application, database; checking the information of the documents in

the electronic identity account on the National Identity Application, database shall have the same value as directly checking the documents. d) The delivery of the administrative violation record to the violator shall be carried out in accordance with the provisions of Article 58 of the Law on Handling Administrative Violations (amended and supplemented in 2020) and Article 12 of Decree No. 118/2021/ND-CP dated December 23, 2021 of the Government detailing certain articles and implementing mechanisms of the Law on Handling Administrative Violations (hereinafter referred to as Decree No. 118/2021/ND-CP).

Article 17. Application of preventive measures and assurance for administrative violation handling

1. In cases where it is necessary to immediately prevent the violation act or to ensure the handling of administrative violations, the Head of the Traffic Police Team shall apply such measures within their authority or report to the Head of the unit who has the authority to decide on the application of preventive measures in accordance with stipulateswhenthe Law on Handling Administrative Violations (amended and supplemented in 2020).

2. Temporary detention of contraband items, means of transportation involved in administrative violations, licenses, and certificates of practice

b) Within twenty-four hours from the time of establishing the record, the traffic police officer responsible for establishing the record must report to the authorized person on the temporary detention of contraband items, means of transportation involved in administrative violations, licenses, and certificates of practice already detained for consideration and issuance of a decision on temporary detention. For contraband items that are easily perishable goods, the traffic police officer must immediately report to the direct superior for handling; if they become damaged or lost, compensation must be provided according to the law.

In cases where a decision on temporary detention is not issued, the contraband items, means of transportation involved in administrative violations, licenses, and certificates of practice (in cases where the violator presents the original license or certificate of practice) must be returned immediately.

c) In cases where, during the temporary detention of contraband items, means of transportation involved in administrative violations, the driver of the vehicle is not present at the scene of the violation or deliberately avoids, obstructs, and does not comply, the traffic police officer shall establish a work record, a temporary detention record, with the signature confirmation of a representative of the local government authority or at least one witness; use technical equipment (cameras, video cameras) to record the incident; use measures to bring the contraband items, means of transportation to the place of temporary detention (directly implemented or hired organizations or individuals to implement); verify and send a notification to the owner of the means of transportation, requesting the violator to come to resolve (according to Model No. 01/73 issued together with this Circular);

4. Units and localities equipped with the VNeCSGT App shall implement patrol and control log recording through the VNeCSGT App.

Article 21. Conclusion of Patrol and Control

When concluding the patrol and control period, the Traffic Police Team must perform the following tasks:

The handover must be recorded according to regulations, signed by both the giver and receiver, clearly stating their full names, and they must bear responsibility before the unit head regarding the handover.

Section 3. RESOLUTION AND HANDLING OF VIOLATIONS AT THE UNIT HEADQUARTERS

Article 22. Allocation of Staff and Resolution Location for Violations

1. Units and local public security agencies allocate personnel and locations for resolving and handling violations in accordance with the law and regulations of the Ministry of Public Security.

2. The violation resolution location should be set up in a convenient position, with appropriate space, solemnity, seating for those coming to resolve matters; posting diagrams indicating work locations, citizen reception schedules; identification signs of staff performing duties; phone numbers; citizen reception rules; suggestion boxes; and relevant content from documents related to patrol, control, and handling of violations concerning traffic order and safety on roads.

Article 23. Procedure for Resolving and Handling Violations

1. When the violator comes to resolve the violation, proceed as follows:

a) Accepting the administrative violation record from the violator and comparing it with the violation file (in cases where the administrative violation record is lost, carefully compare the violator's personal information with the violation file); do not resolve cases involving intermediaries (except in cases authorized by law) or outside the designated location for resolving administrative violations of the unit. For cases requiring further investigation, report and propose that the competent authority organize an investigation;

b) Informing the form, level of punishment, preventive measures, demerit points deduction from driving licenses (according to Model No. 02/73 issued together with this Circular), other measures, and the results of collecting violation behaviors using technical equipment according to regulations;

In cases where permits, certificates, and driving licenses have been integrated and updated in electronic identity accounts on the National Identity Application managed and operated by the Ministry of Public Security then when applying the form of revoking the right to use permits, certificates, and driving licenses, the competent authority shall implement the revocation electronically, update information about the revocation of the right to use permits, certificates, and driving licenses on the administrative violation processing database and synchronize with the National Identity Application, Government Service Portal, Traffic Police Department’s website, databases managed and operated by the Ministry of Public Security, VNeCSGT App, Mobile traffic applications for citizens managed and operated by the Ministry of Public Security (hereinafter referred to as VNeTraffic) so that violators, vehicle owners (for vehicle owner documents) are aware and comply with laws on road traffic order and safety, serving competent forces to inspect b) Inform the person traffic control, handle violations;

d) Receive, check, and compare the payment receipt (or other payment receipt as prescribed by law) with the administrative violation file and retain the file;

d) Returning seized items, vehicles, and documents temporarily held or whose use rights were revoked according to administrative procedures to the person being penalized. If these documents contain information about temporary seizure or revocation of use rights on the National Identity Application, managed by the Ministry of Public SecurityControl the conditions of vehicles participating in traffic then the competent authority issuing the decision shall prepare a return record for the person being penalized; the administrative violation processing database shall synchronize information with the National Identity Application, databases and software specified in point b of this clause to remove the content of information about the temporary seizure or revocation of use rights of these documents;

e) In cases resolved based on administrative violation notifications regarding traffic order and safety: Checking and comparing information on the notification paper and personal identification documents; allowing the violator to view the results of collecting violation behaviors using technical equipment; preparing an administrative violation record and implementing handling according to regulations.

2. In cases where the violator pays the administrative violation fine through the Government Service Portal

a) The authorized authority sends penalty information to the Public Service Portal; Cthe Public Service Portal automatically notifies the violator to search for administrative violation penalty decision information through the phone number provided to the police at the time of issuing the administrative violation record; vehicle registration;

b) The violator accesses the Public Service Portal via the administrative violation penalty decision number that has been notified or the administrative violation record number to search for administrative violation penalty decision information; pay the administrative violation fine, register to retrieve seized documents;revoke through public postal service;

c) The authorized authority searches for the electronic receipt of the administrative violation fine collected by the Public Service Portal system to print, file the administrative violation penalty case and serve as the basis for returning seized documents, remove the information about the seizure on the National Identity Application, (excluding the driver's seat),software as prescribed in point d clause of this Article;

d) The authorized authority returns seized documents, revoked (when the revocation period expires usage right) to the person penalized through the public postal service. In case the document contains information about seizure, revocation of usage rights on the National Identity Application, based on the database managed and operated by the Ministry of Public Security then the administrative violation handling database synchronizes information with the National Identity Application, the database, software prescribed in point b clause 1 of this Article to remove the information about the seizure, revocation of usage rights of the document.

3. In case the violator pays the administrative violation fine through the public postal service, it shall be implemented according to the provisions of Article 20 of Decree No. 118/2021/NĐ-CP.

4. In case has beyond the deadline set for resolving the violation case recorded in the administrative violation record or in the notification of the authorized authority imposing penalties or beyond the deadline for enforcing the penalty decision if the vehicle owner or violator has not come to resolve and handle or has not complied with the penalty decision then the authorized authority sends a notice to the Inspection Authority (for the vehicle traffic which is required to undergo inspection), the vehicle registration authority, the driving license issuance authority to coordinate in handling according to the provisions of the Road Traffic Safety Law; Government Decrees regulating administrative penalties related to traffic safety and order in road traffic; deduction and restoration of points on driving licenses.

Sending notices to the Inspection Authority, the vehicle registration authority, and the driving license issuance authority shall be done electronically through data connection and sharing or in writing.

5. Deduction and restoration of points on driving licenses shall be carried out according to the provisions of Government Decrees regulating administrative penalties related to traffic safety and order in road traffic; deduction and restoration of points on driving licenses.

Article 24. Procedures for processing results obtained through technical equipment for cases of violations where traffic vehicles cannot be stopped for inspection and handling

1. Within ten days from the date of discovering the violation, the authorized authority to impose penalties of the police agency where the administrative violation was discovered shall perform the following actions:

a) Determine information about the traffic vehicle, vehicle owner, organizations, individuals related to administrative violations through the vehicle registration authority, the National Population Database, other relevant authorities and organizations;

b)[6] If the vehicle owner, organizations, individuals related to administrative violations do not reside or have their headquarters in the district where the police discovered the administrative violation, and if it is determined that such administrative violation falls within the penalty jurisdiction of the Chief of Police of the commune, ward, town, or Police Station in a district without a commune-level administrative unit (hereinafter referred to collectively as the Chief of Police of the commune), then transfer the results obtained through technical equipment to the Police Station of the commune, ward, town, or Police Station in a district without a commune-level administrative unit (hereinafter referred to collectively as the Police Station of the commune) where the vehicle owner, organizations, individuals related to administrative violations reside or have their headquarters according to Model No. 03/73 issued together with this Circular for resolution and handling of the violation case (if equipped with a network connection system for electronic transmission).

c)[7] Send a notice according to Model No. 01/73 issued together with this Circular requesting the vehicle owner, organizations, individuals related to the administrative violation case to come to the police station where the administrative violation was discovered or to the Traffic Police Station under the Traffic Police Department, Police Station of the commune where they reside or have their headquarters to resolve the administrative violation case if travel is difficult and there are no conditions to directly go to the police station where the administrative violation was discovered as stipulated in Clause 2 of Article 15 of Decree No. 135/2021/NĐ-CP. 2. 3. 4. 5. If, within twenty days from the date of sending the violation notification, the owner of the vehicle, organization, or individual related to the administrative violation does not come to the police agency where the violation was discovered to resolve the case, or if the police agency where the violation was discovered has not received the resolution and handling result notification from the commune police station[14], the Traffic Police Department[15] that has received the results obtained through technical equipment, then the authorized person to impose administrative penalties of the police agency where the violation was discovered shall proceed as follows:

a) Send a warning notification about the traffic violation vehicle to the inspection agency (for vehicles required to be inspected), the vehicle registration agency, and update the status of having sent a warning notification on the administrative violation processing database.

b) For traffic vehicles such as motorcycles and motorbikes, continue to send notifications to the commune police station[16] where the owner of the vehicle, organization, or individual related to the administrative violation resides or has their office (according to Form No. 04 issued together with this Circular). The commune police station[17] is responsible for transferring the notification to the owner of the vehicle, organization, or individual related to the administrative violation and requesting them to comply with the violation notification; report the results of the work and renotify the police agency that issued the violation notification (according to Form No. 04 issued together with this Circular).

6. The transfer of results obtained through technical equipment, and the notification of the resolution of the violation case shall be carried out through electronic data connection and sharing methods.

Article 25. Collection and Use of Data (Information, Images) Obtained from Technical Equipment Provided by Individuals or Organizations for Detecting Administrative Violations

The process of collecting and using data (information, images) obtained from technical equipment provided by individuals or organizations, and verifying cases to detect administrative violations shall be implemented according to the provisions of Chapter III of Decree No. 135/2021/NĐ-CP and the following provisions:

Traffic Police officers when receiving and collecting data (information, images) must review and classify, if they meet the requirements stipulated, record in the logbook (according to Form No. 05/73 issued together with this Circular) and report to the head of the unit with authority to implement as follows:

a) In cases where the data (information, images) reflect ongoing road traffic order and safety violations on the route or area under responsibility, organize forces to stop traffic vehicles, inspect, discover, and handle violations according to regulations. In cases where traffic vehicles cannot be stopped for inspection or the reflected violation has ended, take verification and handling measures according to the law;

b) In cases not within the route or area under the unit's responsibility, notify the authorized Traffic Police Unit to take verification and handling measures according to the law;

Units and localities equipped with an electronic information system to receive information and images reflecting road traffic order and safety violations through the VNeTraffic App shall carry out classification, management, storage, and data transfer on the system.

4. Verification of information about traffic vehicles and vehicle owners shall be conducted through the vehicle registration agency, the National Population Database, and other relevant agencies or organizations đ5. If, within twenty days from the date of sending the notification, the vehicle owner or driver does not come to the police station that issued the notification to resolve the case, the authorized person handling the case shall continue to send notifications to the commune police station

When the legal normative documents cited in this Circular are amended, supplemented, or replaced, the content cited shall also be adjusted and implemented according to the amended, supplemented, or replaced legal normative documents. 1. The Director of the Traffic Police Department shall be responsible for directing, guiding, inspecting, and urging public security units and localities to implement this Circular.

2. Heads of subordinate units under the Ministry of Public Security and Directors of provincial-level public security departments shall be responsible for implementing this Circular.

Article 33. Responsibility for Implementation

[1] 19/2018/TT-BGTVT) which has been amended and supplemented by Clause 7, Article 1 of Circular No. 08/2024/TT-BGTVT dated April 4, 2024, issued by the Minister of Transport, amending and supplementing certain articles of Circular No. 19/2018/TT-BGTVT 13/2025/DECREE-MACT on February 28 the 02 day5 of the Minister of Public Security amending and supplementing some articles of circulars regulating traffic order and safety on roads, railways, and inland waterways is based on the following:

Pursuant to the Law on Inland Waterway Transport dated June 15, 2004; the Law Amending and Supplementing Some Provisions of the Law on Inland Waterway Transport dated June 17, 2014; the Law Amending and Supplementing Some Provisions of 37 Laws Related to Planning dated November 20, 2018;

Pursuant to the Railway Law dated June 16, 2017;

BASED ON THE ROAD TRAFFIC ORDER AND SAFETY LAW dated June 27, 2024;

Pursuant to Decree No. 02/2025/ND-CP dated February 18, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Traffic Police Corps;

The Minister of Public Security hereby promulgates the Circular amending and supplementing certain provisions of circulars regulating road traffic order and safety, railway traffic, and inland waterway traffic.

[2] The phrase "Head of the Police Department of District, Town, City under Province, Central City (hereinafter referred to as Head of the Police Department at District Level)" is abolished according to the provision at point a clause 6 Article 11 of Circular No. 13/2025/TT-BCA dated February 28, 2025 of the Minister of Public Security amending and supplementing some articles of circulars regulating traffic order and safety on roads, railways, and inland waterways, effective from March 1, 2025.

[3] The phrase "Head of the Police Department at District Level" is abolished according to the provision at point b clause 6 Article 11 of Circular No. 13/2025/TT-BCA dated February 28, 2025 of the Minister of Public Security amending and supplementing some articles of circulars regulating traffic order and safety on roads, railways, and inland waterways, effective from March 1, 2025.

1. This Circular takes effect from March 1, 2025.

2. The Director of the Traffic Police Corps shall be responsible for monitoring, guiding, inspecting, and urging the implementation of this Circular.

3. Heads of units under the Ministry, Directors of Public Security Departments of provinces and centrally-administered cities, organizations, and individuals concerned shall be responsible for implementing this Circular.

4. During the process of implementing this Circular, if there are difficulties or obstacles, local public security units shall report to the Ministry of Public Security (through the Traffic Police Corps) for timely guidance..

[29] Sample No. 05 is replaced by Sample No. 05/73 as provided for in Clause 8, Article 11 of Circular No. 13/2025/TT-BCA dated February 28, 2025, issued by the Minister of Public Security to amend and supplement certain provisions of circulars governing traffic order and safety on roads, railways, and inland waterways, which shall take effect from March 1, 2025.
