Pursuant to the Road Traffic Law dated June 29, 2001;

Pursuant to Decision No. 2570/2003/QĐ-BGTVT dated August 29, 2003, stipulating the functions, tasks, authorities, and organizational structure of the Vietnam Motor Vehicle Inspection Authority;

Pursuant to Clause 2.5 of Decision No. 4105/2001/QĐ-BGTVT dated December 4, 2001, issued by the Minister of Transport regarding the implementation of semi-mechanical inspection methods at islands, remote areas, mountainous regions, where motor vehicles operated by organizations and individuals cannot be brought to mechanical inspection units;

Considering the proposal of the Head of the Motor Vehicle Inspection Department,.

DECISION:

Article 1Now hereby promulgates with this Decision "Regulations and Guidelines on Technical Safety Inspection and Environmental Protection for Motor Vehicles Not Meeting Conditions for Mechanical Inspection Lines".

Article 2This Decision shall take effect fifteen days from the date of signature.

Article 3The Heads of the Motor Vehicle Inspection Departments, Heads of Motor Vehicle Inspection Units, and related entities and individuals are responsible for implementing this Decision.

REGULATIONS AND GUIDELINES

ON TECHNICAL SAFETY INSPECTION AND ENVIRONMENTAL PROTECTION FOR MOTOR VEHICLES NOT MEETING CONDITIONS FOR MECHANICAL INSPECTION LINES

(Issued together with Decision No. 190/2004ĐK, October 12, 2004, Director of the Vietnam Motor Vehicle Inspection Authority)

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

1. Scope of Application

1.1. These regulations apply to technical safety inspections and environmental protection inspections for motor vehicles not meeting conditions for mechanical inspection lines (hereinafter referred to as semi-mechanical inspections), including:

- Trucks and special-purpose vehicles concentrated at major construction sites where it is difficult to transport them to inspection units.

- Vehicles operating in remote areas.

- Vehicles operating in island districts.

- Small transport vehicles (also known as "agricultural vehicles") that cannot travel on national highways to reach inspection units for inspection.

- Vehicles unsuitable for inspection equipment due to over-dimension, overloading, or special structures (three-wheeled vehicles, multi-wheel drive vehicles with rigid differential locks, special-purpose cranes, etc.).

1.2. These regulations serve as the basis for supervising and inspecting the work of motor vehicle inspections at inspection units.

2. To ensure the accuracy of inspection results, semi-mechanical inspections are not encouraged, and units may only apply them to the vehicles listed in Article 1.1.

3. For units with a number of inspectors sufficient for only one inspection line, to prevent semi-mechanical inspections from affecting unit operations, such inspections can be conducted on non-working days and must be agreed upon with the vehicle owners.

II. REQUIREMENTS FOR SEMI-MECHANICAL INSPECTIONS AND MANAGEMENT AND ISSUANCE OF INSPECTION DOCUMENTS

1. Semi-mechanical inspections must be carried out strictly according to Technical Safety and Environmental Protection Standard No. 22TCN224-01 and Inspection Procedure No. 152/2001ĐK.

2. The inspection site and tools for semi-mechanical inspections must comply with Station Standard No. 22TCN226-01.

3. In addition to the management and storage requirements for inspection documents stipulated in Decision No. 149/2001ĐK, for vehicles inspected outside inspection units, the following provisions must be implemented:

- Each batch of inspection documents must be kept separately in a file according to the order of inspection forms (this file does not include printed results from inspection equipment) along with other inspection documents of the same batch, including:

- A letter from the vehicle owner sent to the inspection unit, listing the vehicles attached (Form 01).

- A letter from the inspection unit and a list of vehicles inspected outside the unit approved by the Vietnam Motor Vehicle Inspection Authority, for vehicles in island districts or agricultural vehicles in remote districts without specific lists, the inspection unit must prepare a list after inspection.

- The decision of the inspection team leader (the head of the inspection unit or the person in charge of the inspection line) and a list of inspectors assigned to various inspection items, including inspectors checking old vehicles as stipulated in Circular No. 965/2002ĐK of the Vietnam Motor Vehicle Inspection Authority.

- A printed report of each batch of inspection results.

- Specifically, for the Inspection Form:

- For units equipped with computers and printers for semi-mechanical inspections, the inspection form must be printed from the management program of the Vietnam Motor Vehicle Inspection Authority.

- For units not equipped with computers and printers for semi-mechanical inspections, photocopies of the inspection form are allowed, with the inspection number and time permitted to be handwritten.

4. Inspection units may only print and issue certificates for motor vehicles after receiving inspection results. Inspection seals must be directly affixed by the inspector according to regulations, and they cannot be given to the vehicle owner to affix themselves.

5. Inspection units must immediately enter the data of semi-mechanical inspections into the computer database upon completion of the inspection period.

III. IMPLEMENTATION

1. The Vietnam Motor Vehicle Inspection Authority assigns the Motor Vehicle Inspection Department to collect the demand for semi-mechanical inspections, submit it for approval by the Vietnam Motor Vehicle Inspection Authority, and organize supervision of the implementation of inspections by units authorized to conduct semi-mechanical inspections.

2. Within ten days of each batch of inspections outside the unit, the head of the inspection unit must submit a detailed report on the inspected vehicles to the Vietnam Motor Vehicle Inspection Authority through the Motor Vehicle Inspection Department (Form 02).

3. During implementation, if there are difficulties, they should be promptly reported to the Vietnam Motor Vehicle Inspection Authority for resolution.
