Decree No. 190-CP provides detailed regulations for implementing the Law Amending and Supplementing Certain Provisions of the Military Service Law concerning the system and policies for professional soldiers, non-commissioned officers, and conscripts.

Detailed regulations for implementing the Law Amending and Supplementing Certain Articles of the Military Service Law concerning the system and policies for professional soldiers, non-commissioned officers, and conscripts

THE GOVERNMENT

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to the Law Amending and Supplementing Certain Articles of the Military Service Law dated June 22, 1994;

"Based on the proposal of the Minister of National Defense;"

DECREE:

Article 1. During their service period, professional soldiers shall enjoy the current salary and allowances according to the prevailing system; other systems and policies shall be implemented similarly to those for officers of the Vietnam People's Army at the same rank.
Article 2. During the concentrated training period and combat readiness inspection for first-class reservists, their families shall be subsidized as follows:

a) For first-class reservists who do not receive salary or wages, their families shall be subsidized daily at a rate of 0.1 times the minimum wage;

b) For first-class reservists who are receiving salary or wages from state agencies, social organizations, or economic organizations, their families shall be subsidized daily at a rate of 0.05 times the minimum wage.
The subsidy for the subjects mentioned in points a and b above shall be taken from the defense budget within the local government budget and paid directly once to the first-class reservist on the last day of the concentrated training and combat readiness inspection period.

Article 3.

Non-commissioned officers and conscripts serving from the 25th month onwards shall receive an additional 200% of the basic rank allowance of each grade monthly; from the 37th month onwards, they shall also receive an additional 50% of the basic rank allowance of each grade monthly.
The allowances from the 25th and 37th months onwards stipulated in this Article shall not apply to non-commissioned officers and conscripts studying at training institutions inside and outside the military. The Ministry of National Defense, in conjunction with the Ministry of Labor, Invalids, and Social Affairs, and the Ministry of Finance, shall specify the specific benefits for the aforementioned trainees.

Article 4.

The discharge allowance for professional soldiers, non-commissioned officers, and conscripts shall be implemented as per Decision No. 595-TTg dated December 15, 1993, of the Government Chairman regarding the system for military personnel and public security personnel upon discharge. Additionally, non-commissioned officers and conscripts serving for three years shall receive an additional two months' basic rank allowance of each grade upon discharge.
The "vocational training allowance" equivalent to three months' minimum wage for discharged military personnel, as stipulated in Point 3, Article 1 of Decision No. 595-TTg dated December 15, 1993, of the Government Chairman, is now referred to as the "employment creation allowance."

Article 5. This Decree takes effect from the date of signature. However, the provisions set forth in Article 3 of this Decree shall be implemented from July 1994.

Article 6. The Minister of National Defense shall coordinate with relevant ministries and sectors to guide the implementation of this Decree.

Ministers of ministries, heads of ministerial-level agencies and agencies under the Government, Chairmen of Provincial People's Committees directly under the Central Government shall be responsible for implementing this Decree.
